Background: Parkland Memorial Hospital is located in Dallas, TX; it is the biggest county
hospital in the state. The hospital was cited many times for ethical violations; consequently, it was
under federal and state investigation for Medicare and Medicaid (CMS) fraud, substandard patient
care, and safety problems. In May 2013, the hospital entered into a five year corporate integrity
agreement (CIA) with the Office of Inspector General of the U.S. Department of Health and Human
Services (OIG) to correct its ethical violations and patient safety problems.
The purpose of this paper is therefore to make an interview with a quality care manager in this
Hospital I am currently working regarding the nurses role is in implementing the CIA that the
Hospital entered with OIG to improve patient safety and quality of patient care.
Summary of the Interview
I interviewed Mr. Jeremy Lewis who is an assistant manager of a float pool staff, and also is a
compliance committee member concerning the nurses role in the implementation the CIA that
Parkland made with OIG to improve quality and safety of patient care. Mr. Lewis started to tell me,

This was a very interesting simulation. As mentioned in the Flipchat video discussion, I have done
several other simulations during my undergrad schooling. Compared to this simulation they were
based in the financial realm focused on stocks and bonds. However, they all share a similar aspect
in regards that their ultimate goal to maximize profit. Ultimately I ended up doing three different
runs through the simulation that each had unique results. My best results showed a profit of $37.5
million and a market share of just under 50% for the state of Florida. During my first run through
of the simulations I had simple strategy which was to mimic the prices of the competition. I

However, at the same time I believed that because there was only a little gap in market share, the
reputation of Universal was greater than its competition and the price difference was the reason for
the market share gap. Therefore, I lowered the prices to be comparative to the competitor and my
theory was correct and the market share flipped and Universal gained more as the months
progressed. This process is what I would implement on a larger scale in my second simulation run.
Throughout my second run in the simulation I altered my strategy to have my prices lower then
competition and it backfired greatly on me. My thought process for this was that having lower
prices would definitely raise market share as consumers would chose the cheaper costs. At the
same time I envisioned the drop in prices would result in more consumers switching companies
and renting from Universal, but I was wrong. The results of this simulation ended with a loss of
over $11 million but a market share of over 50%. My error for this simulation was that I relied too
much on lowering prices. In the first simulation the last three months were the competition
increased their prices and there were no change to universal resulted in losses of profits. I took that

In this article I will consider whether the current claw defence of insanity is ineffective, out dated
and in need of reform. I will do so by contemplating several criticism of the insanity defence arising
from the M Naghten rules .
The concept of insanity as a defence was established in the early eighteenth century in the Arnold
s case (1724) and was further developed in the late 18th century in the Hadfield s case (1800), but
the standart test of criminal liability was only formed after the case of Daniel M Naghten (1843).
This case established the special verdict of ‚ not guilty by reason of insanity .
Over the years, academics have identified uncertainity in the insanity defence. First, the out dated
M Naghten rules cover crimes including non mental illnesses like in the case of Kemp (1957) and
also the epilepsy, diabetes and sleepwalking because the English courts accept that these defendants
(D) are of unsound mind when they are not. This mean that the insanity defence is weak and in
need of reform.
In murder cases, most defendants prefer to seek the other defence such as diminished responsibility
and non insane automatism due to stigma attached.
