2. Similarities Between Phillis Wheatley And William Apess
Both Phillis Wheatley and William Apess include theological orientation and religious rhetoric
strategies in their writing but in different ways. Wheatley isn t necessarily concerned with narration
in her poetry as Apess is in his writing. Her focus isn t really action, but ideas. In her text, her goals
are to worship, discuss philosophies about Christianity, redemption, and history. The themes in her
poetrycommunicate ideas of Christian devoutness, ethics, righteousness and death. A more in
depth reading of her works will, however, reveal their anti slavery ideas as well as her objection
to the subjugation of her race. She protests, stresses vengeance, and uses her powerful imagery to
draw attention to her search for power, order, and progress.

Designing a gas pipeline requires four aspects, the first aspect determines the length and direction
of pipeline, the second aspect determines the size of pipes and compressors, the third aspect is to
determine pressure and gas flow distribution in the pipeline transmission system .The fourth
aspects considers the chance of demands for growing of gas over time so the capacity of the
system may be needed to be increased by adding other components in parallel or series. (O. A.
Almisned, 2002 ) Moreover, in this research a gas pipeline is designed taking into account the fluid
type, transportation distances, diameter, wall thickness, material selection and other properties to
determine the criteria for the pipeline. A computer programming Pipesim simulator is a steady
state, multiphase flow for designing and badge investigation of gas production systems. in addition
to, the programmer investigates flow line and performance of surface facility to produce full
production system analysis.
The cost of setting up underwater pipelines is an important factor in the utilization of offshore
natural gas economics. A suitable design of those networks can facilitate the costs of new
discovered fields into the gathering system which leads to lower prices to the customer and causes
profits. This study considers three main problems in designing pipeline networks expansion. The
first problem is the selection of pipeline network diameters, the second problem, is

4. Confidentiality In Military
This project will develop a strategy to help Unit Ministry Teams increase Soldier use of Army
Chaplain services by increasing Soldiers awareness of the absolute confidentiality of Chaplains.
Society generally understands confidentiality as keeping personal information secret or private.
However, this dissertation carries a more doctrinal understanding of the term confidentialityin the
context of privileged military communications.
In general, confidentiality refers to keeping personal information secret or private. However, there
are technical distinctions in the military when it comes to closely held communications, and
military Chaplains come across these in their ministry: privileged communication, confidential

Some of these Chaplains have communications that takes place as part of sacramental confession in
their denominations and endorsing agencies. Sacramental/confessional communications exist in a
religious relationship, where a confessing person communicates with a religious official. Generally,
the relationship and communication involve the confessing person finding solace or forgiveness
for sin. Oftentimes, the confessing person believes that the religious official mediates forgiveness.
The confidentiality of such communications is primarily governed by the clergy s religious group;
however, local and state laws have challenged the privileged nature of this penitent clergy or
sacramental/confessional communication. It should be noted that overlaying the licensing religious
group and state laws is the Army Regulation specifying that the confidentiality of sacramental
/confessional communication is to remain intact and cannot be waived by any authority including
the confessor. On the other hand, in non military chaplain contexts, sacramental/confessional
communication may not be fully protected as some mandatory reporting laws and some duties to

6. Eliot And His Problems In Shakespeare s Hamlet And His...
Eliot and His Problems
Among the twenty essays published by T.S Eliot in The Sacred Wood: Essays on Poetry and
Criticism , one cannot help but notice the provocatively titled critique of Shakespeare s play
Hamlet, Hamlet and His Problems . In his essay, Eliot argues that Hamlet is an artistic failure
(Eliot 1). Again, he bluntly states that one is to come to the irrefragable (Eliot 2) conclusion that
Shakespeare tackled a problem which proved too much for him (Eliot 4). Upon closer examination
of the play in question, one is to quickly find that Eliot s provoking thesis has no root in logic and
common sense. In fact, it is evident the title character s delayed revenge is validly explained in the
protagonist s characterisation; pathos is achieved throughout the play and that the emotion elicited
by the dramatist in the main character was expertly illustrated in the text contrary to the author s
expressed opinion.
To begin, Eliot argues that Shakespeare s Hamletis a non complete alteration of previous revenge
plays such as The Spanish Tragedy. For instance, he states that in the Shakespearean edition, the
theme of revenge is unexplained on grounds of necessity or expediency (Eliot 2). Again, he adds
that it is overtaken by a motive which is more important. Firstly, the author s argument is
incomplete as he fails to mention and argue the other motive which overtakes that of revenge. Also,
one is to come to the logical conclusion that the delay in revenge by Hamlet is

7. Opposition Death Penalty
The intent of this paper is to share the views of those who oppose capital punishment. I, for one,
am part of the majority that is in support of the death penalty. I am in agreeance of the old saying
of An eye for an eye . The death penalty is one of the most controversial issues in our criminal
justice system. There is an increase in opposition against the death penalty, not only in the United
States. Many Americans feel that capital punishmentis wrong. It is hard for people to fathom the
idea of putting someone else to death. It is not the physical mechanics involved in executions that
are hard to handle. It is the emotions involved in carrying out the process. Many feel that the death

Oppositionist feel that if a white or rich person committed the same crime would be sent away with
a lesser punishment or a slap on the wrist. Economic and racial bias is an argument that is made
across the board in our justice system. This is an argument that has caught the eye of many Civil
Rights unions. It has been said that with the use of capital punishment, violent crimes will be
reduced. This is the third argument. However, the opposition does not agree. There is no prove that
the rates of violent crimes have been reduced. The opposition argues that capital punishment does
not act as a deterrent for these crimes. They also argue that it is irreversible. The fourth and final
argument involves the amount of time that a prisoner spends on death row. Prisoners tend to spend
a lot of time on death row prior to executing day because retrials, technicalities, appeals, or other
delays. Due to those reasons the opposition argues that having a person wait for years for
execution is both costly and cruel. They feel that if a prisoner is going to wait that long then he or
she should be convicted of life imprisonment without the option of being

8. The Role Of Offred In The Handmaid s Tale
Margaret Atwood s novel, The Handmaid s Tale, is a dystopian story of a woman s worth and
role in society. The novel is in the perspective of Offred, a handmaid from the dystopian United
States: the Republic of Gilead. Women have always been told and perceived to be submissive to
men, since the beginning of time. This story, is no exception to this belief, as Handmaids are
women stripped of their rights as a human. Atwood s story The Handmaid s Tale suggests that the
desire for freedom is what all human beings seek for and captures this idea through the
protagonist, Offred. This desire cannot be suppressed by society or conditionings of the mind
because it is the sole reason of what makes a person, a human being. The main character of the

Before Offred was forced into the life of becoming a handmaid, she had a desire to be with a
man named Luke. However, he was already married at the time, and they had to sneak around.
Every time they were to meet in private, she would have many feelings before the meeting as
she states, I was nervous. How was I to know he loved me?...The knock would come at the door;
I d open, with relief, desire (Atwood 56). Even though the affair she had was considered wrong
in society, it did not stop Offred from going with what she desired. Her desire for Luke and his
love outweighed her concerns of what she was afraid of and what society deemed was right.
Offred s character experiences what humans feel. Atwood created Offred to display that people
desire freedom. Another example of Offred s desire of freedom to love, is evident when she
explains her thoughts to the reader. In the Republic of Gilead, the only women who are married are
the Commander s wives. This means that the other women are handmaids and therefore long for
love because they

11: Despite all terrible things God is gracious and merciful.
I believe the book of Jonah intends to teach us that God is a gracious and merciful Lord who will
grant salvation to those who desire to repent, by the virtue of; accepting the Lord with all your
heart, mind, and soul. This idea is evident by the content of the book. First, we understand that
one cannot seek God and flee from him simultaneously. He wants us to obey his will even if
adversity chooses to arise. However, Jonah refuses the Lord s will and chooses to disobey him.
Consequently, Jonah is thrown overboard and swallowed by a fish. Although, once Jonah prays
for forgiveness the Lord grants it. Subsequently, Jonah preaches the gospel and the king of
Nineveh as well as his people repent to the Lord and forgives. This angers Jonah, even though the
Lord forgave Jonah of his atrocious act just as he did with the Ninevites. In conclusion, we learn

Feeding Tube Refusal Dilemma A 28 year old female with cerebral palsy and debilitating arthritis is

her condition, she is having trouble eating and in order to help, the doctor believes that a feeding
tube (PEG tube) should be surgically inserted. When told about the treatment, the patient refuses
surgery. She is deemed competent and understands her situation. In this situation, I propose that the
care team should respect the wishes of the patient and let her die. It is clearly stated that the patient
is autonomous and aware of the potential risks of refusing treatment. She is willing to accept the
fact that if she does not receive the feeding tube, she will die of malnutrition. In addition, she is not
consenting to the surgery and they cannot legally force her to accept treatment to have the PEG
tube inserted. The conditions for consent include competence, understanding and appreciation of
information, and voluntariness free from coercion, and undue influence (Young, Ch. 44). She has
fulfilled the requirements for competence because the care team acknowledges that the patient
recognizes that there is a decision that needs to be made, clearly understands the information and
treatment options, and the risks involved with each decision (Orr, CBHD). There is no question
that the patient understands and appreciates the information because the care team is aware that

14. Development And Jean Piaget s Theories For Normal Child...
Over the years people have come to discover a pattern of the way children develop from the ages
of infancy (3 12 months) to Adolescent (13 18 years). Noticing normal behavior and physical
growth along with abnormal behavior and delayed growth. Different psychologists such as Jean
Piaget, Erik Erikson, Urie Bronfenbrenner, and Lev Vygotsky have come up with their own theories
for normal child development. Let s begin with Jean Piaget, a Swiss clinical psychologist, his theory
had four stages of cognitive development. He believed each stage would show the growth of
where a child s brain should be developing at a specific period of time during their early years. In
the article, Simply Psychology, there is a video that represents Piaget s cognitive stages with
different ages and certain tasks. Piaget set out a row of counters in front of the child and asked her
/him to make another row the same as the first one. Piaget spread out his row of counters and asked
the child if there were still the same number of counters. Most children aged seven could answer
this correctly, and Piaget concluded that this showed that by seven years of age children were able
to conserve number (McLeod). The first stage was described as the Sensorimotor stage (birth 2
years); this is where the child starts learning his/her surroundings through sensory or motor activity
with its environment. The sensorimotor stage comes with six substages throughout those 2 years.
The first month includes the infant

15. The Role Of Misreading Ian Mcewan s Atonement
In his essay Who Killed Robbie and Cecilia? Reading and Misreading Ian McEwan s Atonement
Martin Jacobi argues the role of misreading in Ian McEwan s Atonement and the consequences of
misreading and reading with preconception. Misreading is the incorrect or misinterpretation of a
reading. In McEwan s Atonement misreading is a key concept that allows Ian McEwanto persuade
readers into believing situations and conclusions that are not confirmed. Jacobi s main argument
examples focuses on the misreading and interpretation of two main characters deaths, Robbie and
Cecilia. The misreading in Atonement causes readers to believe they are dead even though it is not
confirmed. Jacobi further argues that along with misreading reading with preconceptions also leads
to misinterpretation, that when we read we have preconceptions about the novelwhich leads to
assumptions about what will occur. (Jacobi 71) While Jacobi argues the negative of having
preconceptions about a novel, having knowledge and information about A novel and the author can
be beneficial when trying to understand the novel and the why in the novel. Knowing information
about when the novel is set, what was happening during this time can be useful for understanding as
well as useful for avoiding misreadings. Although I agree with Jacobi s argument that misreading
and reading with preconceptions can lead to misinterpretation and wrong conclusions, I do believe
that having information and logical ideas around the literature can be beneficial in many ways.
McIwan in his novel, dramatizes misreadings and uses them to create many misinterpretations and
incorrect conclusions in the readers mind. McEwan uses misreadings in Atonement to persuade us
into believing Robbie and Cecilia are dead, that Robbie is the maniac that Briony described, while
confusing who the true author is.(McEwan, Atonement) Jacobi s argument doesn t only relate to
the misinterpretation of the readers, but also how McIwan uses misreadings in the novel to move
the plot and create conflicts in the novel. These misinterpretations and misinformed conclusions all
lead to Jacobi s argument that misreadings and preconceptions have consequences for the readers.
When we read, then, we let

America s Best and Worst Claims
Between the years of 1845 and 1848 America was on a mission to expand farther west. This was
mission was not something that was completed over night, but instead too many years to reach
the goal. There were multiple disagreements and even some wars erected from this operation. In
this paper I am going to discuss the how the Oregon Territory was one of the best claims we have
owned and how the California and Texas Territory was one of the worst claims we have owned.
The Oregon territory was originally occupied for many years by the Native Americans. During the
19th century the British and American citizens started moving into the territory and settling on the
land. American citizen predominantly settled in the fertile valleys because most of them were
farmers. As years passed by many people started migrating to the Oregon territory and the territory
started to become crowed. With the territory being crowed this would soon lead to conflict. James

Growing up in the depression was difficult for Morrison and her family, and being African

Toni Morrison s first published novel is The Bluest Eye, which was published in 1970. As Telgen
explains, The Bluest Eye tells the story of Claudia Macteer. The book opens in present tense but
continues to go back and forth between Claudia s present self, her nine year old self, and an
omniscient point of view. The novel mostly centers around Claudia, Frieda, who Claudia s sister,
and their attachment to a young black girl named Pecola Breedlove. Throughout the story the
narrators take turns showing the hardships of each family and how Claudia and Pecola
constantly wish for blue eyes, thinking that is they had them their lives would be much easier
and more enjoyable(68). Toni Morrison later published Sula, which also received a lot of
attention, in 1973. As Smith clarifies, Sula takes place in the African American part of a town
known as The Bottom in Medallion, Ohio. The novel centers around Sula Peace, but often tells
stories of her dysfunctional family also. Sula Peace is described as dark, and not just because of
her skin. Sula has a very dark personality that affects her family members in various ways(243).
Fourteen years later Toni Morrison published another hit novel, Beloved. As Napierkowski and
Stanley state, Beloved takes place throughout the Civil War and is centered around the struggles
of that Sethe, the main character, and her family face. Throughout the novel you see how
broken Sethe is because of slavery. She lives her live in her own small insulated world where she

has gotten her books very far, she did not always want to be an author. Toni Morrison says, I never
wanted to be a writer, but I was always an avid reader of fiction. I really began writing myself when

23. Chinese Essay Exam for Civil Service
The Chinese essay exams for civil service selections were known as the Imperial examinations,
which were instituted by Imperial Chinese to determine who among the population would be
allowed to enter the state s bureaucracy. The Imperial Examination System in China lasted from the
founding during the Sui Dynasty in 605 to its demise near the end of the Qing Dynastyin 1905.
These examinations lasted approximately 1300 years (Elman, 2002).
From the time of the Han Dynasty (206 BCE to 220 CE) until the implementation of the Imperial
Examination System, the majority of appointments were based on recommendations of prominent
aristocrats and local officials who would recommend individuals who were predominantly of
aristocratic rank. The ... Show more content on Helpwriting.net ...
In the late Imperial China, the examination system and associated methods of recruitment to the
central bureaucracy were major mechanisms by which the central government captured and held the
loyalty of local level elites. Their loyalty, in turn, ensured the integration of the Chinese state, and
countered tendencies toward regional autonomy and the breakup of the centralized system. The
examination system distributed its prizes according to provincial and prefectural quotas, which
meant that imperial officials were recruited from the whole country, in numbers roughly
proportional to each province s population. Elite individuals all over China, even in the
disadvantaged peripheral regions, had a chance at succeeding in the examinations and achieving the
rewards of holding office.
The examination system also served to maintain cultural unity and consensus on basic values. The
uniformity of the content of the examinations meant that the local elites and ambitious would be
members of those elites across the whole of China were taught with the same values. Even though
only a small fraction (about 5 percent) of those who attempted the examinations passed and
received titles. Those who failed to pass most of the candidates at any single examination did not
lose wealth or local social standing; as dedicated believers in Confucian orthodoxy, they served,

Many connections to famous books or movies can be made to the Headless Horseman or the
Heissan as he is referred to many times in the original Sleepy Hollow . The Headless Horseman
has a few key traits: engimatic, supernatural, and terror raising/feared. Only a few have ever
come face to face with the Horseman, the nemesis of Ichabod Crane (main character) Brom Van
Brunt has a supposed run in with the horseman and lives to tell the tale, while the village elders go
off of stories. When his name is spoken townsfolk quiver at the stories and terror brought about by
the mistery of the supernatural. This horseman is no ordinary horseman, he frightens the whole

On the contrary, the Heissan returned a malevolent spirit while Jason never really died in the

which I will call The Mask for simplicity s sake, was a more assertive, aggressive individual,
fearless in the face of any hardship or opponent. When Jason put The Mask on, he wasn t a little
boy any more. He was someone strong, someone powerful, not only capable of surviving, but
thriving in the wilderness surrounding Camp Crystal Lake. (Bloodsprayer psychology behind
Jason) When he goes into his innocent personality, Jason becomes a lot more clumsy and not as
well formed as his other half. In conclusion, the Headless Horseman can be compared to many

A contract is considered a legally binding agreement. A valid contract is an agreement that is
binding and enforceable. A contract is not enforced if one of the parties involved has a lack of
capacity. When lack of capacity is determiend a contract is voidable. A contract signed by a
minor can be avoided because anyone under the age of 18 is a minor and minors are not legally
capable of signing contracts. Since Alex signed the contract at the age of 16, it is not a binding
contract.
Quasi contracts are required by the court to prevent unjust enhancements when there is a dispute
over payment. Technically the courts could hold the Dunphy s responsible for payment. Quasi
contractual liability would not be imposed if the Dunphy s were on vacation in Hawaii and were

29. Symbolism In The Story Of Paul s Case By Willa Cather
Darkness of Bright Red Carnations
The color red means different things to different people; distress, love, or even lust. When the hue
is placed in the form of a flower, the meaning may shift moderately. A red carnation is worn to
symbolize admiration, love, or affection in a compassionate situation, however when worn in a
more distraught venue, the carnation could embody more meaning of death or dying. An analysis of
the red carnation in the story of Paul s Case reveals the underlying symbolism meant to interpret the
narrative.
In the story of Paul s Case by Willa Cather, Paul is observed as the uneducated, poverty lined boy
in a severely distressed situation. Paul is seen by his teachers as a disturbance and a sheer nuisance
in the classroom. During the review of his suspension, the teachers all form their crude opinions of
his situation, and glare at the red carnation dawning the button hole of his shirt. This ... Show more

Paul puts an end to the carnation, which has already began wilting away, by burying it into the
snow bank. The end of the carnation seems to be a metaphor for Paul s life as well. His burying
of the carnation symbolizes the burial of himself, the end of the carnation, the end of his life,
and the end of the life he always wanted to create for himself. He recollected the imagery of the
flowers seen previously, along with his perception of life, And it was a losing game in the end, it
seemed, this revolt against the homilies by which the world is run (p. 106). It seems as though
the wilting away of the carnation had the most symbolism towards Paul s life than others. The red
carnation has many meanings to many different people, however to Paul it was all he had. The
idea of death is reliving to Paul, although he quickly begins to think of all the things he will never
see. It is a sentimental moment in that it gives closure to the story and concludes the end of the red

Seneca Falls Convention The Seneca Falls Convention was the first woman s rights convention in
the United States. The assembly was organized by many women who were present in abolition and

The convention s main purpose was to bring attention to unequal treatment of women, and brought

Reality is merely an illusion, albeit a very persistent one , Albert Einstein. This quote from Einstein
touches on how reality is not something that one can fully grasp without questioning the reality that
you are in presently and both Plato and the Matrix address through their work. In Plato s Allegory
of the Cave, he discusses how society controls information so that the people know only what they
need to know and nothing more. In the Matrixthey show how society has used the control of

Which in society you have the choice to question society and look deeper into society and find
all the information that has been kept from you. This control of information is used to hide the
information that the government does not want to be common information or information that
has been misconstrued to uphold their dreamworld that they have created to keep the people
happy. Or you can just accept everything as you believe it to be and continue living in the
dreamworld that was created for you to live in. The next similarity is when Neal is in a womb
like container and he had numerous tubes connected to him, all of these tubes symbolize our
need for and ties to society. As an individual we are tied to society through the necessities of life
such as; clothing, housing, food, and jobs, and through these same aspects we are contributing
to society so it creates a cycle of dependency. We are dependent because we are unable to create
most of these things by ourselves without the help of society. for example to build a house in
order to get wood or lumber to build it you would need someone to manufacture it so that you
would have boards for siding and roofing, and beams and boards for walls and supports. This one
necessity is just an example of our dependency on society as an individual. Since we are so
dependent on society that corporations know that they can exploit us without us knowing it. An
example of this from the matrix would be when Morpheus is apologizing to Neal for having to
retrain his mind and he tells him it had to be done, I had no choice. He is talking about how Neal
is seen to be the Chosen one and so Morpheus felt like he had no choice but to make Neal retrain
his mind even though he is technically too old

In this research popular music is defined as well liked and well favoured (Middleton, 1990)
music for ordinary people (Shuker, 1994) that has wide mass media exposure, but usually only
for a fixed period of time. Its impact is either overstated or understated. Yet, it is an important part
of both a thriving cultural and entertainment environment. To some it is a business and to others it
is a way of life. While many would argue its cultural contribution to society (Adorno, 1941;
Horkheimer and Adorno, 1944; Peatman, 1944), few would argue its potential to impact and to
influence individuals. Advertising inspires ambivalence equal to that of popular music.
Advertising is defined as the paid, nonpersonal communication of information about products or
ideas by an identified sponsor through the mass media in an effort to persuade or influence
behavior (Bovee, Thill, Dovel, and Wood, 1995, p. 4). Ironically, communication theorist Marshall
McLuhan called it the greatest art form of the twentieth century (Andrews, 1987, p. 5). But
advertising pioneer David Ogilvy said he did not regard it as an art form but as a medium of
information (Ogilvy, 1983, p. 7). Both McLuhan and Ogilvy
would agree that advertising is everywhere throughout society. Whether you agree it cultivates or
contaminates, mirrors or manipulates that society, you cannot avoid it. While there is a

One of the first occurrences that is a reference to death is at the beginning of the movie. As

he is about to die.
Another detail of nature that is used to express this theme is the fact that the seasons keep
changing. In the introductory scene the trees are slightly barren like it is late fall, but after Peyton
escapes it is suddenly springtime. This is probably a detail put in by the director to emphasise that
late fall and early winter are usually depicted as the times that plants die. Mr. Enrico is also using
the fact that every time Peyton thinks that he has ... Show more content on Helpwriting.net ...

42. Literary Techniques Used in The Storm by Kate Chopin
This short story was really straight forward until it got to the end, where it had a twist, which
made me pick the story to write on. Kate Chopin did an outstanding job using symbolism, but this
novel is not for all ages, if you know what I mean. How the setting, tone and theme all tie all
together is what makes the story different from the others.
Is the storm literal or symbolic? This particular question really stood out and really made me think
and analysis the story. For example, the question asks about the storm if it is literal or symbolic. The
storm is a super obvious symbol. It s involved in practically every element of the story. First off,
it s the title. Second, it plays a huge role in the plot, forming the beginning and the end of the
story. It also plays a really important part in the middle by bringing Calixta and Alcee together,
pushing them into each other s arms and giving them the time and space to get physical before the
world outside returns to normal. Also, the storm is a frightening occurrence in the natural world.
Alcee describes it as a cyclone (Chopin 2.13), while Bobinot can tell right away that its sombre,
sinister, and threatening (Chopin 1.1). Chopin describes the rain pouring down with a repetition
and regularity that suggests rain itself. Of course, it s when all that rain is coming down most
passionately and brutally that Calixta and Alcee are also getting more and more passionate;
exploring their feelings for one another to the

43. The Pros And Cons Of Immigration In America
There always has to be a restriction on immigration as the U.S can t handle millions of immigrants
that are either crime ridden, diseased, or just poverty stricken people but are sure to let in
immigrants who are seeking opportunity. During the 18 19 centuries, immigrants from around the
world wanted to come to America as it was the land of opportunity. Presidents like Woodrow Wilson
set the bar for immigrationas he was a supporter of restriction but not selection. The U.S does not
need these type of people in the country as they give no benefit to the U.S. Of course not every
immigrant is crime ridden or diseased but that s why the U.S made special tests which can sift
out the unacceptable immigrants who will have a negative effect on the U.S and bring in the
acceptable immigrants who could enhance the U.S. As Woodrow Wilson once said, we have
generously kept our doors open to all who were not unfitted by reason of disease or incapacity
for self support or such personal records and antecedents as were likely to make them a menace to
our peace and order or to the wholesome and essential relationships of life. (Wilson Doc B). As
many others wanted to pass a bill for immigrants to take a test of their education but President
Wilson rejected the bill as it was unfair to the immigrants as some mainly come to the U.S for
education. There still must be tests that not select certain immigrants but restrict immigrants who
are unfit to come into this country. There s a difference

44. A Buyer s Failure
A buyer s efforts may not be thwarted if the buyer failed in their due diligence and if the physical
inspection of a property failed to find a discoverable material fact. Daly v. Kochanowicz, 67
A.D.3d 78 (N.Y. App. Div. 2009). In Daly, the buyer s inspector discovered evidence of water
intrusion on the property and recommended that the buyer talk to neighbors and contact
knowledgeable local officials regarding the defect. Daly v. Kochanowicz, 67 A.D.3d 78 (N.Y. App.
Div. 2009). The buyer failed to perform due diligence as required to investigate the possibility of
water intrusion affecting the property, consequently the seller did not thwart the buyer s efforts

Glazer v. LoPreste, 278 A.D.2d 198 (N.Y. App. Div. 2000). In see Matos, regardless of the seller
s conduct in concealing a material fact, the buyer should have discovered the pertinent
information if discoverable in the public record. Matos v. Crimmins, 40 A.D.3d 1053 (N.Y. App.
Div. 2007). Similarly, in Glazer, the material fact was discoverable in the public realm,
specifically through local news articles that were published within two years prior to contract of
sale, and the buyers were from the area the articles were published. Glazer v. LoPreste, 278
A.D.2d 198 (N.Y. App. Div. 2000). A buyer can reasonably discover a material fact through
publicity if the articles were published within a time frame relative to the sale of a property, and
if the buyer previously lived in the area where the articles were published. Glazer v. LoPreste,
278 A.D.2d 198 (N.Y. App. Div. 2000). In Boyle, the non resident buyers were arguably justified
in relying on the seller s claim that they would have an unobstructed view from the property.
Boyle v. McGlynn, 28 A.D.3d 994 (N.Y. App. Div. 2006). Per the seller s motion for summary
judgment, it was pled that the plans to build wind turbines on the adjacent property were
discoverable through a single, local news article. Boyle v. McGlynn, 28 A.D.3d 994 (N.Y. App.
Div. 2006). However, a buyer is not expected to discover a publicly disclosed material fact if the
buyer is not from the area of the published article and if the material fact has minimal news
coverage. Boyle v. McGlynn, 28 A.D.3d 994 (N.Y. App. Div.

As a kid, I grew up reading fictional stories; the first book I ever held was the story of Winnie the
Pooh and his friends (a gift from my parents when I got sick), watching and discovering sorts of
characters from animated shows; and that includes imitating Disney Princesses of course, and
many others. So when I was 7, I started wanting to become a successful artist, a writer, or any other
that was connected with the arts and crafts. Why? It started when I was little and flourished when I
entered school.
Now that I am 18, living a life with a purpose of reaching my goals, I wanted something unusual
to experience a situation wherein I have to dedicate myself to it, passionate enough to
accomplish that something. Hopefully, if ever I get a chance to talk to the 7 year old me, we
would have a fun chit chat; how I faced the struggles of my existence, how I build myself up, how
I learned from my mistakes, how to survive when you re on a cliff and many others. Also, maybe

47. Freud Defense Mechanisms
Sigmund Freud: Defense Mechanisms Sigmund Freud was a psychoanalytic theorist and
practitioner who strongly emphasized the unconscious processes and biological drives that guide
our behavior. He asserted that instincts are the propelling forces of our personality, and that they
originate in the id (the unconscious part of our personality that works on the pleasure principle,
and is a reservoir of our instincts and libido). In addition to the id, we have the ego (the conscious,
rational side of our personality that works on the reality principle) and the superego (the largely
unconscious, moral side of our personality that contains our conscience). In addition to
conceptualizing five psychosexual stages that cover childhood and... Show more content on

I use this defense mechanism relatively often. For example, I m a very irritable person.
Therefore, I get angry at people often. The other day, I was in an argument with my brother and
we were both becoming very frustrated. Rather than giving into my id impulse, which was to hit
my brother, I sublimated that impulse into something else exercise. Instead of fighting my
brother, I decided to go to the gym. Alfred Adler: Striving for Superiority and Fictional Finalism
Alfred Adler was a psychological theorist who placed much emphasis on the uniqueness of each
individual. Consequently, he disagreed with Freud, especially regarding Freuds idea of the
universality of biological motives in every person. Adler proposed that inferiority is a function
of the environment, and that it is the normal condition of all people. Furthermore, he asserted
that inferiority is the source for human striving, because people compensate for feelings of
inferiority by striving for higher levels of development. In other words, we strive for superiority,
and we have a strong will to work towards perfection or completion. Additionally, Adler asserted
that people have an imagined or potential goal that guides our behavior, which he called fictional
finalism. I feel as though my behavior is guided by striving for superiority, and by fictional
finalism. I strive for superiority on a daily basis, in most aspects of my life. First, I

48. Bob Dylan s The Sixties Counterculture
To understand the sixties counterculture, we must understand the important role of Bob Dylan. His
lyrics fueled the rebellious youth in America. Songs such as Blowin in the Wind and The Times are
A Changin made him favorable to anti war demonstrators and supporters of the Civil Rights
movement. He was commonly hailed as the spokesman for his generation. Dylan used lyrics to
allow the youth to find their own form of counter culture. The youth generation began to see the
effects racism, war, etc. effect the society in America. To combat this, the youth created their own
form of counter culture to promote a peaceful change within society. Some of their actions include
forming anti warprotests that opposed America s involvement in the Vietnam War, and supporting
African Americans/women get the rights they deserve through the Civil Rights Movement. Bob
Dylans music appealed to the young generation because he openly expresses his disapproval of the
establishment in order to influenced his audience to move in a direction for change. Counterculture
youth rejected cultural norms of the previous generation and their values and lifestyles opposed the
mainstream culture present in the 1950 s. The folk music revival of the early 1960s, as well as the
counter culture movement played an important role in advocating change. Bob Dylan wrote songs
that influenced the Civil Rights Movement, New Left Movement, and Anti War Movement.

The Efficient Markets Hypothesis (EMH) The classic statements of the Efficient Markets
Hypothesis (or EMH for short) are to be found in Roberts (1967) and Fama (1970) An efficient
market is defined as a market where there are large numbers of rational, profit maximizes
actively competing, with each trying to predict future market values of individual securities, and
where important current information is almost freely available to all participants. In an efficient
market, competition among the many intelligent participants leads to a situation where, at any
point in time, actual prices of individual securities already reflect the effects of information based
both on events that have already occurred and on events which, as of now, the market expects to
take place in the future. In other words, in an efficient market at any point in time the actual
price of a security will be a good estimate of its intrinsic value. (Fama, 1970) Strong form EMH In
its strongest structure, the EMH says a business sector is effective if all data applicable to the
estimation of an offer, whether by and large accessible to existing or potential speculators, is
rapidly and precisely reflected in the business cost. Case in point, if the current business cost is
lower than the quality advocated by some bit of secretly held data, the holders of that data will
misuse the valuing peculiarity by purchasing the shares. They

Cochlear Implantation is not as new of an idea as society may think. Interest in stimulating hearing
in deaf individuals can be traced back as far as the 18th century. Since then many scientists, doctors
and even audiologists from all areas of the world have worked to develop sophisticated high tech
implant systems. Which has resulted in varying viewpoints between the Deaf and Hearing
Communities.
In the 18th century Italian Physicist Alessando Volta developed the electrolytic cell. Volta

A cochlear implant does not restore normal hearing, but can give a deaf person a useful
representation of sounds in the environment and in some help with understanding speech. The
Cochlear implant consists of external components that usually are behind the ear and internal
components that are surgically implanted under the skin these two parts work together to allow
the user to perceive sound. The external components include a microphone, a speech processor,
and a transmitter. The microphone is located at the top of the speech processor, which resembles a
behind the ear hearing aid. It picks up sounds from the environment and transmits them to the
speech processor. The speech processor can either look like the behind the ear hearing aid or be a
small box worn in a chest pocket. It is a computer that analyzes, digitizes, and arranges the sound
signals picked up by the microphone and sends them to the transmitter. The transmitter is a small
magnetic disc or circle coil worn on the head just behind the ear it receives signals from the speech
processor and convert them into electric coded signals, sending them to the receiver/ stimulator
implanted just under the skin using a special radio frequency. The internal components include the
receiver/ stimulator and the electrode array. The receiver/stimulator decodes the electrical signals
from the transmitter and sends a corresponding pattern of rapid, tiny electrical pulses to electrodes
on the electrode array that has been surgically inserted and winds through the cochlea. The electrical
pulses stimulate the fibers of the auditory nerve where the brain categorizes the sounds and assigns
meaning to them. The Cochlear Implant to

52. Analysis Of The Stanley The Stanley Parable
The Stanley Parable (2013) was a game released to widespread acclaim about a man named
Stanley, whose coworkers mysteriously disappear from the office and whose actions and choices
are subsequently voiced by a narrator. While at first the game might seem simple and ordinary, the
longer spent in the gamethe more complex the narrativeis revealed to be. The game satirizes a lot of
conventions and narrative tropes used throughout the games industry, as well as commenting on
other facets tied heavily to the games medium, like hacks, bugs, and even gameplay. While that
might not be special in itself, what makes The Stanley Parable stand out is how it goes about
commenting on these things. By having the player control Stanley and have all their actions
chronicled by the narrator, the game has created these three distinct entities: The player, Stanley
and the narrator. The relationship between these three is the primary way the game is able to
explore certain themes such as player agency, and how much choice matters. According to Astrid
Ensslin, As players we are made to read [the game] as an allegory of illusory agency built into
games to give players the illusion of choice, power and control. In fact, we as players are all
Stanley because again and again we willingly or even enthusiastically subject ourselves to the
constraints set by the games we play (Ensslin 67). The many different endings contained within The
Stanley Parable interacts with these relationships in varying

Assess the importance of TWO of the following in the US decision to declare war against Spain in
1898: yellow journalism, sinking of the Maine, US business interests, Cuban revolution
America s short war with Spain in 1898 was the nation s first step on the pathway to becoming a
world power. The U.S. victory brought with it the unintended possession of the Philippines and a
vested interest in the politics of the Pacific region that would ultimately lead to conflict with Japan.
As an immediate outcome of the war, America found itself embroiled in an insurgency in the
Philippines that closely mimicked the conflict in Vietnam over 60 years later.
Cuba, a Spanish colony, had been in rebellion since 1895. The brutal Spanish response turned
American sympathies to the Cuban insurgents. The US Battleship Maine arrived in Havana Harbor
