officer authority to stop and search a suspicious character if they deem him/her to be as such. They
don t need a warrant, or see you commit a crime. 5They simply need to deem you suspicious to violate

assault from happening.
The origin of stop and frisk lies in a Supreme Court ruling in the case of Terry v. Ohio 1968. 3When a
group of three men were suspiciously walking back and forth looking into a store, a plainclothes
officer suspected that they were planning to commit a robbery. When he confronted them, he was
unsatisfied with the answers they were giving him, so he searched them and found an illegal firearm.
A key issue in this case was probable cause. By definition, probable cause is a collection of facts or
single fact that would lead a competent police officer to believe that a crime was committed. While the
officer suspected a crime was about to be committed, no crime had yet been committed and therefore
there was no probable cause. While the cop had reason to suspect an illegal activity was about to
occur, he did not have probable cause to conduct the search. The Supreme Court ruled in favor of the
defendant on the grounds that a stop and frisk is less intrusive than a full blown search. They also
ruled that requiring probable cause would place the officer and other bystanders in danger. According
to the court, the only justification of a stop and frisk is to find illegal firearms, knives, or other

Although using different teaching strategies is necessary in a differentiated music class, simply using
them is not necessarily differentiating instruction. I like to think of strategies as the delivery of
communication and differentiated instruction as the specific individual implementation of strategies.
For example in a music class, one of my strategies of keeping students engaged is to use simple
percussion instruments for developing rhythmic proficiency. The differentiated instruction is provided
by taking individual needs into consideration. For example, a student who is easily aurally overloaded,
I would hand that student a quieter instrument and/or suggest he/she use body percussion or ask them
to sit where they feel comfortable in class relative to the sound being produced. For younger children
who are sound sensitive, I would suggest using earplugs or head sets. It is important to remember that
using a variety of teaching strategies is not the same as differentiating the instruction. In this case
engagement was the overarching strategy and the differentiated instruction was specific to each
student while still keeping them engaged.
Differentiated Instruction is a student focused way of thinking of teaching and learning. It is important
to establish clear and concise guidelines for independent and group work, as well as movement within

further their social skills. Every student needs to be rewarded and disciplined to keep a calm and fair
environment.
I will start off with having the students explain to me signs they already know or what they have come
up with themselves. It will help me to see where we are starting off at and what are our strong suits.
This is how I will begin any lesson on a new set of signs where they will tell me all the animals they
already know. Then I will start over with all the animals and repeat the animal signs over. I will use
scaffolding, for example, by explaining that the sign for a cat looks like your petting a cat this will
give them something to associate it with. The students will start to get into groups and have
conversations with each other. For example, one student can spell out the animal, while the other does
the sign for the word. This will help them with working and being social with others. Once they know

congress or any state legislature recommend the death penalty for murder and other capital crimes.
Majority of the states are favor in death penalty, roughly around 32 states are favor and 18 states are
against death penalty. In most cases, many argue that death penalty has violated the 8th amendment,

Another tool used to help with the overcrowding issue facing prisons and jails is the court s utilization
of community based corrections. This type of sentencing is utilized for lesser offenses when a judge
feels that an offender may not warrant prison or jail time. One popular tool within community based
corrections is electronic incarceration, also referred to as house arrest (Schmallager, 2011). The
offender is fitted with an electronic device, usually around the ankle. The device sends a signal to
officials monitoring the offender if they violate the electronic radius that the device is programmed to
