Alternative Dispute Resolution Processes
Contrary to that, some observers have argued that it is not at all clear that informal processes like ADR
may be a disadvantage to minority groups any more than formal processes like settlement . Formality
may influence people to be on the right side of the law and play by the book, it risks imposing its own
obstacles to justice . The concept of justice is essential to ADR processes. In the framework of ADR,
the concept of justice involves the consent of the parties to play an active role in the resolution of their
disputes; to assert some degree of control over the aftermath of their disputes and to arrive at a
satisfactory, if not excellent settlements of their disputes, with regards to their interest. 3.3 Principles
and Mechanisms of ADR 3.3.1 General Principle Currently there is no particular ADR philosophy that
can acknowledge that one specific approach can best suit the true spirit of ADR . Nevertheless, by
taking a look at the main aim of ADR, one can establish whether there is one philosophy to ADR and
to what extent does it go to. Some of the main aims of ADR are; the principle of solving a problem
collectively, enabling of parties, avoiding delays and costs related to traditional litigation, conservation
or improvement of personal relationships; mainly business related and simplifying procedures. The
principle of solving a problem collectively is considered to be one of the main objectives of ADR
process, however it has been argued that some parties in

No Russian: The Modern Warfare Against Videogame Violence
While the movie industry has powerful rating boards such as the Motion Picture Association of
America (MPAA) that regulate and censor an offensive product, the video game industry does not
have a respectable, official rating board. Instead, the videogame industry has the Entertainment
Software Rating Board (ESRB), which is a non profit, self regulatory body that was created in 1994
by the Entertainment Software Association. The ESRB esteems itself as the vanguard of providing
concise and objective information about the content in video games and apps so consumers, especially
parents, can make informed choices (ESRB). To provide guidance about age appropriateness and
content, the ... Show more content on Helpwriting.net ...
Consequently, while the liberal nature of the ESRB as a voluntary board existing merely for guidance
has allowed for much artistic expression in videogames, the lack of clear, meaningful regulations have
enabled 21st century videogames to not only tread, but also violate an increasingly thin line of moral
boundaries concerning artistic expression.
As the elevator was rising, Russian ultranationalist terrorist leader Vladimir Makarov gazed intently at
his comrades and beckoned, Remember No Russian, initiating one of the most controversial moments
of videogame history. During the level Remember No Russian of the popular first person shooter
videogame Call of Duty: Modern Warfare 2, the player assumes the role of a deep cover CIA agent,
Joseph Allen, who is attempting to gather Intel on a highly dangerous Russian ultranationalist terrorist
group. What started as a simple intel mission led to Agent Allen participating in an armed plot to
massacre all the people in a Russian airport. As the elevator doors were opening, Vladimir Makarov
reminds the player and the other gunmen not to speak any Russian throughout the scene. As the
terrorists relentlessly fired their machineguns, blood splattered all over the airport as civilians fled in
terror from the oncoming slaughter. Amidst this bloodbath, some civilians displayed altruism as they
attempted to drag the injured to safety; however, those self less efforts were trampled on by more
shots and more deaths. At the end of

Leading Change Analysis
Week Four Discussion Forum
In this week s reading assignment in the book, Leading Change, by Mr. Kotter, I gained additional
insight in regards to aligning different parts of the business to result in a better outcome.
The first concept from this week s reading that resonated with me was in the interdependence section
of Chapter 9. The author outlines a company that has clear visibility and ownership allowing the
company to control the manufacturing, sales, marketing, and development. This is an optimal solution
in order to control your quality and speed. The part that I found interesting is that not many companies
have this capability anymore because it is not fast, customer focused and less costly. Garmin is
currently set up in this manner; owning its own manufacturing facilities and having its own marketing
agency in the building. My opinion is that because of this the company can quickly turn and change it
strategies with the market. This in contrast to the authors. At least in my experience when dealing with
third party companies there is a higher cost and slower timeline to change scope with the market. Let
me know what your thoughts are on ... Show more content on Helpwriting.net ...
I choose this technique because I felt that it was the most applicable for a current project that I am
working on in my professional career. Over the past year I have been attempting to position my
employer Garmin the action camera market. We offered our first product in 2013, although it did not
have an fast acceptance in the market, we stuck with it in hopes that the market share would increase.
Two years later we have launched our second generation product, but we are making many of the
similar mistakes that lead to our decreased in sales from the initial product offering. I felt that
performing this technique would help me in approaching senior management with a proposed set of
solutions and anticipated

Police Canine Police Dogs
Police canine dogs are rapidly becoming a major part of the criminal justice police force. You may ask
yourself why are they becoming such a large part of the operation. This spike in the use of canine
police dogs is the result of many different things. Three of them being the fact that they can smell
extremely well. They also can replace a police officer from having to enter a hostile location. Finally
dogs are extremely efficient trackers. This is why i believe dogs are a major asset to the police force
and are inexpendable to the force.
Dogs can smell very well. At first they tested dogs and their ability to smell a few particles per
million, then billion and even trillion and the dog was able to smell the particles and even track the
sent.

The Secret Behind the Peace
The Secret Behind the Peace
Issue Overview
Every year during March to April, is the months that the seal fisheries are active. This is known as the
seal hunting season, great amount of seals were killed for commercial purposes (Liberation BC, para
1). The hunting activities took place on the Newfoundland coast, the northern Gulf of St. Lawrence
and Inuit regions (Government of Canada, 2013, para 2). The seal hunt has been a dispute for years
between the support side and the oppose side. The argument is still being continued Seals are killed in
a cruel ways. Hakapik is a tool used by the fishers to hit the heads of the seals causing the seals to die.
Forty two percent of the seals are skinned alive (Liberation BC, para 9). The seal skins are warm and
waterproof; it is an excellent source to use to make coats, hats or scarfs for winter (Government of
Canada, 2012, para 3). It is illegal to kill seals that are under 11 days old because they haven t lost
their fur yet. Baby seals lose their white furs when they are 11 days old, and it is then legal to kill
them. Even though they are only babies (Liberation BC, para 2). The quota of the seal hunt was
400,000 in 2012. However, the quota suggested by the scientists was smaller (Liberation BC, para 1).
Fortunately, the numbers of seal hunters are starting to decrease. The reason is, that they do not make
much money out of it (Liberation BC, para 24). The action of hunting seals is not ecological because
the meat of the seals is

Disney, Racism, And The Renaissance Era
Lindsey Artz 12/3/14 ENGL 316 2 From Fact to Fiction: Disney, Racism, and the Renaissance Era.
Disney is a multi billion dollar industry. Originally founded by the Disney brothers, Walt and Roy E.,
the company has now become a world wide phenomenon, diversifying its company into live action
film production, television, and theme parks. It surrounds us every day, in almost every way possible.
More importantly however, the Disney industry is known to people world wide as being one of the top
leaders in children s popular films and subsequently, storybooks. The countless movies and short films
made over the years have not only provided joy and happiness to families and young children, but
have ultimately influenced the way that these young children see the world as they grow older. Many
of the traditional fairytales known throughout the ages have been Disneyfied and have become more
modern through their adaptations, in order to increase revenue and audience appraisal. In addition, a
vast majority of the films released are based on different cultures, countries, or a certain historical
group or figure to create a more wholesome atmosphere where children can learn and become
cultured. However, the responses to these films that are often overlooked are the ones that bring a
negative light to the Disney Company and their reputation as a whole. Disney was and is known for
creating well rounded, happy, and often romantic animated films for children and their family

Impact of Media on Politics Essay
Impact of Media on Politics
The role media plays in politics is undeniable. Our soundbite culture with its inherent limited attention
span dictates a McNugget of information. Unfortunately this often leads to misrepresentations being
accepted as fact. A glaring example of this was the Killian documents controversy. In September 2004,
the CBS program 60 Minutes Wednesday aired a report critical of President George W. Bush s service
in the United States National Guard. The four documents included criticisms of Bush s service in the
Guard during the 1970s. These documents were supposedly created by Bush s commander, the late
Lieutenant Colonel Jerry B. Killian. It was also reported that the documents were obtained by a CBS
News producer ... Show more content on Helpwriting.net ...
On a lighter note, presidential candidate Bill Clinton made a surprise appearance on The Arsenio Hall
Show during the 1992 Presidential Campaign. He was trailing in the polls at the time so it was a very
savvy attempt to capture the young voter. Mr. Clinton wore dark sunglasses and played Heartbreak
Hotel on his saxophone. In the end, Bill Clinton easily defeated George Bush and Ross Perot with 43
percent of the vote. Some pundits have suggested that this appearance turned the race around.
Easily the most polarizing force in media today is talk radio. In 1987 the FCC repealed the Fairness
Doctrine. This regulation had required that stations provide free air time for responses to any
controversial opinions that were broadcast. Now the opportunity was available for a level of flatly
partisan programming. As referenced by Wikipedia,
Talk radio provided an immediacy and a high degree of emotionalism that seldom is reached on
television or in magazines. Pew researchers found in 2004 that 17% of the public regularly listens to
talk radio. This audience is mostly male, middle aged and conservative. Among those who regularly
listen to talk radio, 41% are Republican and 28% are Democrats. Furthermore, 45% describe
themselves as conservatives, compared with 18% who say they are liberal.
Rush Limbaugh was the pioneer in the 1990s talk radio movement. Rush s unprecedented success

Why Panera Bread Is The Healthiest Fast Food Alternative
Begging the question is a type of logical fallacy that avoids the argumentative process (McInerny
109). An example of a begging the question fallacy is when my friend argued for his point that Panera
Bread is the healthiest fast food alternative restaurant. My friend, Tim, stated that Salads and fruit
smoothies are the healthiest types of food. Since, Panera Bread serves several types of salads and fruit
smoothies this makes Panera Bread the healthiest fast food alternative. Tim s statement exemplifies
begging the question fallacy because the conclusion, Panera Bread is the healthiest fast food
alternative , does not have logical premise and reasoning behind the argument. Tim did not provide
any factual information proving the fact that salads and fruit smoothies are the healthiest food option.
Also, Tim did not compare the actual calories in the food at Panera compared to a typical fast food
restaurant, such as McDonalds. In summation, Tim completely ignored the reasoning that backed up
his conclusion, which was Panera is the healthiest fast food alternative, thus making the conclusion a
begging the question fallacy.
A false assumption is a type of fallacy where a reputable assumption is made and can be demonstrated
to be false with facts stacked against the assumption (McInerny 111). A false assumption can also be
made when an arguer is assuming that his or her audience has a knowledge of certain kind when in
fact the audience doesn t (McInerny 112). An example

As Any Usual Day, I Went To Bed Early That Night So I Can
As any usual day, I went to bed early that night so I can wake up comfortably and go to university but
this time it was different. At 7am, the alarm rang, everything was normal, but something has changed,
my life. I jumped out of bed and found myself into the scariest and darkest place that I have seen in
my entire life. I turned around and found on the floor familiar heads cut out of the bodies. Days had
passed, and a week later, I saw the same people that I had seen that night. This time they were gone.
Recently, after experiences, I discovered that I have sixth sense. There are different meanings and

Moreover, he believes that in terms of the physiological nature or location of this organ, only that it is

But it is not an easy job to discover the exact place of the cognitive sense organ in the cortex which is
actually a jungle of about ten thousand million nerve cells.
The sixth sense is demonstrated in all the progression and inventions of human civilizations.
Sometimes, the inventions springs suddenly but after a long trials and sufferings; so that the inventor
attains his goal at once as if a sudden inspiration had illuminated his researches. The poets called this
inspiration an intuition and the sophists regarded it a heavenly discovery and unidentified suggestion.
Laurent, a French philosopher said that the inventor is an intuitive poet and Claude Bernard had also
revealed this special sense and this intuitive discovery in the creative scientific achievements. The
characteristics of memories and thoughts serve as a stimulus for the cognitive sense organ which
helped humans to exploit their abilities throughout ages. To invent tools and to develop the use of
language in order to ease their life and to cope with the variable circumstances. (Disney, 1954, p.327

Examples Of Consensus In 12 Angry Men
When someone is on trial for murder, it can be difficult for a stranger to realize that the person on trial
s life is in the hands of a small group of people. Therefore, due to jurors often being strangers, it can
be significantly difficult to put aside their biases and come to a proper consensus. In the film 12 Angry
Men, the process of coming to a consensus was troubling due to Juror Three s personal bias towards
the topic. Unlike looking at the situation rationally as Juror Eight did, Juror Three brought his
emotions, personal experiences, and bias into his fallacy riddled argument. Juror Three was arguably
the most difficult juror to convince that the boy was not guilty. Throughout the whole film, up until the
end, Juror Three stood his ground with his argument. Juror Three often disagreed with any
counterargument that Juror Eight made. Near the beginning of the film, Juror Three went off on an off
topic tangent about his son and how he was so ashamed in his actions and how he was also a teen.
Therefore, we are able to notice the motive behind the arguments that he made. Juror Three would
often try to counter someone else s argument by stating that he knows for sure the boy is guilty. For
almost every counter argument, he would provide little to no evidence to back his claims. In addition,
the most notable trait about Juror Three s arguments is that he refuses to acknowledge that there is,
indeed, reasonable doubt. For example, despite all the information about the

What Is My Culture Essay
I am familiar with my culture because my grandparents were able to impose their customs onto my
parents and their children. Without them I would not be eating traditional foods, celebrating the
Hispanic culture, or be aware of my family history. I am 100% Mexican, and I admire the Latin
culture to the fullest. The Mexican culture consists of a tight family, plentiful cuisine, Spanish
language, Latin music, and the Catholic religion. Growing up in a Mexican household has definitely
influenced my morals, values, and character. Although I remain living in a Hispanic household I
sometimes forget how important the culture influences the person I am today.

I would visit every day afterschool and it was the best adventure running through multiple gardens

city. My grandparents grow their own crops because to them it is a hobby, and they are able to sell
them when there is an exceeding amount of harvest. Agriculture is common in most Hispanic families,
whether it is owning a simple lemon tree or growing a small aloe vera plant, there is always something
sprouting. I found it unusual that no matter what oppression we were put through we were still able to
preserve our most important customs and values. Many other cultures were stripped of their identities,
and till today we are able to pass down our traditions. Learning about how my family traveled from
deep into Mexico to Southern California brining their culture with them is amazing. Being able to

Symbolism Of Humankind In Lord Of The Flies By William...
Humankind is an imperfect species with many flaws. Author William Golding shows these in the
novel Lord of the Flies. It is shown through a group of schoolboys crashing on an island without any
adults. Without the rules and constraints of civilization the children show humanity s true nature and
raw instinct. The imperfections of man are shown through symbols in the novel such as the scar on the
island, the beast, and the schoolboys who crashed onto the island.
The first symbol that is used in the novel was the scar on the island. The scar was where the plane
crash landed, leaving a destructive mark on the island. He looked up and down the scar. And this is
what the tube done. This quote explains that the scar was made by the fuselage crashing and ripping
into the earth leaving a giant gash on the island. The scar symbolizes mankind s destruction and how
humans can destroy nature just by entering it. The island was untouched and resembled paradise, at
the same time in the outside world a gruesome war was occurring. The carnage and havoc that reigned
over society is also evident on the island. There was a clean slate for them to build a society without
violence, but it did not happen because of destruction being a natural tendency of mankind. The scar
foreshadowed the destruction the island. During the children s stay, the island suffered through the
children s wrath. The children slaughtered pigs, picked the bushes dry of fruit, and also started forest
fires. What

Originated from Bassano del Grappa, more than 1600 years...
Originated from Bassano del Grappa, more than 1600 years ago, the famous Italian drink Grappa
becomes more and more famous all around the world. Not till 1960s, grappa transformed from a cheap
provincial Italian drink into a World Wide known drink. Traditionally made from byproducts of the
winemaking process (vinaccia): pomace, discarded seeds and stalks, Grappa was considered as a
cheap and low quality drink for farmers and other lower class workers. Very similar with the French
Brandies and Cognac, grappa is also a distilled beverage and can get up to 55 60 percent alcohol. The
main difference is that it is not distilled from the base wine , but from the grape pomace. The ideal

It was precisely this process of getting the fragrant essence out of things with fire, water, steam and an
invented apparatus. Patrick Süskind one of the most famous distillers of all times. The distillation
process allows the most volatile substances such as alcohol and water evaporate at the temperature of
about 79 degrees celsius (as a mixture) and be separated from the rest of the substance. To maintain a
great quality of the product the Distiller should remove the heads and tails from the distillate . In other
words, remove the unpleasant parts of the substance. At the end of this long process a yellow liquid is

this liquid, to make the taste more pleasant. To
reduce the alcohol content there is basically added water (demeniralised), until the percentage of
alcohol drops to the point about 45 50 percent. In order to give Grappa its crystal clear appearance the
last process is taking place, filtration. After of quite long journey the untasty and unpleasant red
substance is transformed in a crystal clear good tasting drink. At the same time as just an alcohol

Dancer in the Dark Film Review Essay
If I was to reduce my description of Dancer in the dark to one word, it would be daring. Its immediate
effect on me was stronger than that of maybe any other film I ve ever seen. It shook me, stirred my
emotions, made me think and reflect, it disturbed me in the most positive sense of the word and it still
does. Its radical make, boldness and consistency exceeds all expectations and probably everything that
s come before. This is the perfect example of a director s vision uncompromisingly realized.
To be fair, I have to say that Dancer in the dark is one of those films that people either deeply admire
and love or hate and find ridiculous. If you belong to the latter category, nothing I write will make you
rethink your opinion, due ... Show more content on Helpwriting.net ...
Selma, however, harbours a dark secret. She is afflicted with a hereditary blinding disease that eats
away at her sight as she grows older. She works horrendous hours of every day and night to save up to
pay for an operation that will give her son the chance of a life free of blindness. Selma is saved from
the crushing sadness of her existence by music. Music she hears on the factory floor, the passing train,
echoed footfalls, the air shaft in the wall. Every time she hears or feels a beat she imagines herself
breaking into a spontaneous song and dance routine like she had seen so many times in her childhood.
Any rhythmic sound source is likely to elevate her to the world of musicals. Sounds of her
surroundings are the bass line to an extravagant musical fantasy world, this not only allows her to
break away from the horrors of the situations she finds herself in, but also allows Von Trier to briefly
break away from the confines of his Dogma. As the movie progresses we get to witness her life
crumbling and falling apart around her.
There are many aspects about Dancer in the Dark that make it stand out so distinctly. Relating to the
songs, the first phrase that came to my mind after seeing the film was: a musical for people who
dislike musicals. The whole mood and depressing atmosphere formed a contrast to what we think of
when we hear musical. In addition, the songs were not embedded realistically in the film (that s

Forgiving In The Sunflower
We as humans tend to feel resentful towards those who have hurt us and we tend to keep that
bitterness inside of us when we remember the undesirable action others have made that have impacted
our lives. A way to overcome the feeling of resentment or revenge on people who have done us wrong
is to forgive. Forgiveness helps get rid of any hard feelings that occupies our mind and heart and
allows us to move forward in life. People who forgive tend to be more satisfy inside than those who
keep grudges. That anguish feeling of not forgiving only leads to arguments, and more conflicts, even
war. In The Sunflower, the author Simon Wiesenthal, a Jewish Austrian Holocaust survivor, shares his
personal struggle of keeping silent when Karl, an SS soldier,

to their lives that presents twists, tragedies, and heartbreaks. Narratives play an essential role in
understanding the subject of mental illness by recognizing that traumatic events, dysfunctional
families, and the introduction to an unaccustomed environment are routine occurrences that instigate
this condition. Trauma has sorrowfully touched upon the lives of millions of people worldwide. Many
sources of trauma are typically physical in nature, but many may also take a toll on the perceptual
state of an individual. Although trauma is a human s natural emotional response to a shocking
occurrence, it may leave a lasting impact on one s psychological stability. The exact moment of a
traumatic event is the initial launch of an individual s mental illness. Mitchard is able to provide us

Letter Of Recommendation For Electrical Engineering
Letter of Recommendation
I found this Letter of Intent an opportunity to express my zeal towards the area of study Electrical
engineering with Alternative Energy as a specialization. So far, Electrical engineering has been an
integral part of my academic life and my goals are crystal clear of translating my prior knowledge and
experience into real world system developments.
For the very first time when I saw gigantic windmills, I had a lot of questions on my mind. This was
the time when I was a school student and didn t have any prerequisite knowledge. Someone told me to

I remember myself as a bright student throughout my schooling. I was well versed in both academic
and extracurricular, especially in sports. My engineering was a bit of a different story. Over the four
years of engineering, I learned subjects related to Power Systems, Electronics, Analog and Electronic
Instrumentation, Microcontroller and Microprocessor, Control Systems, Electrical Machines. Etc.
Laboratory sessions of these subjects helped me to accumulate consciousness of practical usage of
electrical engineering. It gave me the opportunity to correlate theory to practical phenomena. This, in
turn, gave me a better understanding of the subject and newer lines of thinking. The course in
Electrical Engineering covered a wide panorama of subjects. I learned to program in C and MATLAB
which were extremely helpful in my practical works. My ideas and knowledge of electrical
engineering were first tested in the third year of engineering in the power electronics based project of

Thankfully, there are a number of ways to do this, including: encrypting data, securing websites,
securing IT systems and wireless networks, and providing adequate training to all employees
regarding the safe transmission, handling, and disposal of information (Steve Pain, 2007). The
improper disposal of information and the breach of confidentiality have been in the news on a regular
basis. This has ranged from employees improperly throwing out customer files, to laptops being
stolen, to hard drives not being properly wiped or erased. More often than not, it is reported that these
items contained customer social security numbers and financial records.
According to the British Security Industry Association, companies should be learning lessons about
the importance of protecting confidential information. (Steve Pain, 2007, para. 7). In fact, compliance
with the Data Protection Act is imperative and non compliance could result in prosecution by the

Descriptive Essay On A Dreamy Island
Imagine a place of pure bliss, where time is seemingly endless, simplicity is valued and relaxation is a
top priority. In our everyday lives where stress is customary and chaos is routine, it is hard to visualize
a place of such carefreeness. I too believed there could be no such place until I found it for myself.
When I close my eyes and imagine, I can still clearly hear the gentle splash of the waves lapping the
shoreline, and feel the slight ocean breeze whizz through my hair, sending it flying in every direction.
During phases of anxiety and trouble, there is one place in particular that my heart longs to be. Marco
Island, Florida.
My father proposed the idea of vacationing on Marco Island before the summer of 2016 after hearing
multiple people rave to him about the breathtaking beaches and unforgettable experiences. My mother
and I had never heard of Marco Island, but after five short minutes of browsing through images online
of the picturesque island, we were instantly captivated and could not wait to see it for ourselves. After
what seemed like an eternity of waiting for our trip to commence, we finally arrived on the dreamy
island. Grinning from ear to ear, we buckled ourselves into the rental car, feeling anxious to explore.
Unlike in Missouri, glossy green palm trees lined every street, which made us feel like we had entered
an alternate universe. Rather than staying at a hotel, we rented a beach house that was supposedly only
a six minute walk from Marco

Summary Of Chris Mccandless And Henry David Thoreau
To some, adventurers like Chris McCandless are young, idealistic, and resolute people with high
moral standards. They want to take everything they can out of life, and they want to experience every
facet of it. However, this isn t a view everyone shares. To others, McCandless was an irrational kid
with no experience who couldn t handle his family issues. On the other hand, Henry David Thoreau is
viewed as a calm, steady, and contemplative man with a dedicated love of nature. Chris McCandless
and Henry David Thoreau share many similarities, but they also have defining differences. Chris was
different from Thoreau because he was running from his past whereas Thoreau wanted to go to the
woods, and Chris overestimated himself whereas Thoreau was more level headed, but they were
similar in that they both didn t believe in material objects. Chris went into the wild because he wanted
to escape his past and because of his general hatred towards prejudice against society, while Thoreau
was more positively motivated to go to the wilderness. His motivation to go to the woods was
negative because he was running away from something. Although his friends and family described
him as very independent and motivated to go against everything he was taught, his real motivation
was because of his family struggles. Chris s father, Walt, never fully divorced his ex wife, Marcia, and
he still had relations with her despite being married to Billie. When Billie found out, she was very
hurt, and so were Walt and Marcia. However, to make amends, Walt finalized the divorce with Marcia.
They resolved the problem and moved on. When Chris unearthed this truth, he was unbelievably
upset, but he didn t address it directly. Instead, he waited years to talk about it, occasionally shunning
his parents and judging them behind their backs. Chris was very self righteous, and he took every
opportunity to denounce his father even though the issue of the divorce had been resolved. He
expressed his anger in a very passive way, and because he never found real closure, his anger
accumulated. He decided to release his anger indirectly. This is why he took classes on racial
inequality, and why he was so mad about poverty in the United States. His outrage

size of the painting is 2.2 x 1.95m. This art work is mostly known for its symbolism and fantastic
unsettling imagery. The Garden of Earthly Delights is made up of three panels. On the left panel, the
story begins with Adam and Eve in the garden of Eden. By looking closely, you can see some
mysterious and different creatures such as unicorns, a white giraffe, and an elephant. The painting
ends with the Last Judgement on the right panel which shows people suffering. The center panel

The Law And Its Effect On Family Provision
In the legal context, the ability to leave property to any person you desire upon death is called
testamentary freedom. The concept of testamentary freedom is perhaps the reason why many people
contemplate death and attempt to ensure that they meet all the formalities in executing a valid will. It
is important to note that testamentary freedom is not a notion that is absolute. Family members of the
individual who feel they have an entitlement under the will can bring a claim for contesting a will
against the estate. These family provision claims are becoming more common in our society and are
arguably undermining the testator s use of their free will. The courts have implemented the use of
mediation as a strategy to assist them in processing these applications. This effective and inexpensive
mechanism is a compulsory step in some states before approaching the courts while in other states
mediation is highly recommended but not compulsory. Through critical analysis of the law and its
effect on family provision claims, it will be depicted that testamentary freedom as a legal right is
adversely affected by compulsory mediation.
MEDIATION IN AUSTRALIA
Queensland
In Queensland, the legislation does not stipulate that mediation is compulsory in family provision
claims but it is imposed by virtue of the District Court s practice notes. This practice note states that a

Representation of Women in Early British Literature
In most early British literature a woman is often presented as only one thing: an object. They can be
objects of desire, objects of beauty, or merely objects to be owned, but it is rare that a woman is
anything more than that. It is even more uncommon to find a female character in literature that is
presented as an equal to the men around her. In William Congreve s The Way of the World he plays on
the similarities of both his female and male characters to establish just how much of an issue gender
really is because though their actions might be similar, the consequences are not. The tangled web of
relationships that connect each character in this story are what drive Congreve s play forward. With
each past affair (or current) affair that ... Show more content on Helpwriting.net ...
Even a man who s character isn t as upstanding as a woman s still makes out better than her in the end.
Congreve seems to establish that women are merely at the whim of the men around them, they do not
control their own fates because they are naturally submissive. Lady Wishfort, try as she might, cannot
do anything to stop Mirabell s actions and he, therefore, comes out the winner. The most important
fact that was overlooked in class was the true nature of Mirabell and Millamant s relationship. One
question never broached in discussion was, why all the plotting in the first place? If Mirabell truly
loved Millamant like he claimed, why did he need to fight so hard to get the money she was expecting
from her aunt? There s no evident reason why they couldn t have lived without such money or her
aunt s blessing and yet it seems as if Mirabell practically refuses to marry Millamant without her
inheritance. Millamant, the female and again the submissive one, goes along with her beloved s
scheming because she loves him and will do whatever it takes to get him to marry her. Millamant, the
man, uses his dominance to get her to agree because it seems he will only marry her if he gets her
money as well. The woman seems like a fool for only focusing on love and only gets what she wants
as a result of her man s intelligence and cunning, but he certainly wasn t just in it for the love. John

The Three Types of Ancient Chinese Rulers
In ancient China, many different rulers tried to unify and rule the country using a variety of methods
Confucianism, Daoism, and Legalism to name a few. Each philosophy had its own set of rules of how
people should act both in public and privately. The overall goal of each philosophy was to set a
standard of acceptable living that would ensure harmony and success for the society. However, each
was different and thus had different results. Legalism is a philosophy emphasizing strict obedience to
the legal system. It was one of the main philosophic currents during the Warring States period and
when it was most prominent. The school s most famous proponent and contributor, Han Fei believed
that a ruler should use the following three tools to govern his subjects: law, method, and legitimacy.
The law code must be clearly written and made public. All people under the ruler were equal before
the law. Laws should reward those who obey them and punish accordingly those who dare to break
them. Thus it is guaranteed that actions taken are systematically predictable. In addition, the system of
law, not the ruler, ran the state, a statement of rule of law. If the law is successfully enforced, even a
weak ruler will be strong. Especially important is that no one can fathom the ruler s motivations, and
thus no one can know which behavior might help them get ahead, other than following the laws.
Legitimacy is the position of the ruler, not the ruler himself or herself, that holds the

Alternative Dispute Resolution Processes Contrary to that, some observers have argued that it is not at all clear that informal processes like ADR may be a disadvantage to minority groups any more than formal processes like settlement . Formality may influence people to be on the right side of the law and play by the book, it risks imposing its own obstacles to justice . The concept of justice is essential to ADR processes. In the framework of ADR, the concept of justice involves the consent of the parties to play an active role in the resolution of their disputes; to assert some degree of control over the aftermath of their disputes and to arrive at a satisfactory, if not excellent settlements of their disputes, with regards to their interest. 3.3 Principles and Mechanisms of ADR 3.3.1 General Principle Currently there is no particular ADR philosophy that can acknowledge that one specific approach can best suit the true spirit of ADR . No Russi The Modern Warfare Against Videogame Violence No Russian: The Modern Warfare Against Videogame Violence While the movie industry has powerful rating boards such as the Motion Picture Association of America (MPAA) that regulate and censor an offensive product, the video game industry does not have a respectable, official rating board. Instead, the videogame industry has the Entertainment Software Rating Board (ESRB), which is a non profit, self regulatory body that was created in 1994 by the Entertainment Software Association. The ESRB esteems itself as the vanguard of providing concise and objective information about the content in video games and apps so consumers, especially parents, can make informed choices (ESRB). Consequently, while the liberal nature of the ESRB as a voluntary board existing merely for guidance has allowed for much artistic expression in videogames, the lack of clear, meaningful regulations have enabled 21st century videogames to not only tread, but also violate an increasingly thin line of moral boundaries concerning artistic expression. As the elevator was rising, Russian ultranationalist terrorist leader Vladimir Makarov gazed intently at his comrades and beckoned, Remember No Russian, initiating one of the most controversial moments of videogame history. During the level Remember No Russian of the popular first person shooter videogame Call of Duty: Modern Warfare 2, the player assumes the role of a deep cover CIA agent, Joseph Allen, who is attempting to gather Intel on a highly dangerous Russian ultranationalist terrorist group. What started as a simple intel mission led to Agent Allen participating in an armed plot to massacre all the people in a Russian airport. As the elevator doors were opening, Vladimir Makarov reminds the player and the other gunmen not to speak any Russian throughout the scene. As the terrorists relentlessly fired their machineguns, blood splattered all over the airport as civilians fled in terror from the oncoming slaughter. Amidst this bloodbath, some civilians displayed altruism as they attempted to drag the injured to safety; however, those self less efforts were trampled on by more shots and more deaths. • 5. Leading Change Analysis Week Four Discussion Forum In this week s reading assignment in the book, Leading Change, by Mr. Kotter, I gained additional insight in regards to aligning different parts of the business to result in a better outcome. The first concept from this week s reading that resonated with me was in the interdependence section of Chapter 9. The author outlines a company that has clear visibility and ownership allowing the company to control the manufacturing, sales, marketing, and development. This is an optimal solution in order to control your quality and speed. The part that I found interesting is that not many companies have this capability anymore because it is not fast, customer focused and less costly. Garmin is currently set up in this manner; owning its own manufacturing facilities and having its own marketing agency in the building. My opinion is that because of this the company can quickly turn and change it strategies with the market. This in contrast to the authors. At least in my experience when dealing with third party companies there is a higher cost and slower timeline to change scope with the market. Let me know what your thoughts are on ... Over the past year I have been attempting to position my employer Garmin the action camera market. We offered our first product in 2013, although it did not have an fast acceptance in the market, we stuck with it in hopes that the market share would increase. Two years later we have launched our second generation product, but we are making many of the similar mistakes that lead to our decreased in sales from the initial product offering. • 6. Police Canine Police Dogs Police canine dogs are rapidly becoming a major part of the criminal justice police force. You may ask yourself why are they becoming such a large part of the operation. This spike in the use of canine police dogs is the result of many different things. Three of them being the fact that they can smell extremely well. They also can replace a police officer from having to enter a hostile location. Finally dogs are extremely efficient trackers. This is why i believe dogs are a major asset to the police force and are inexpendable to the force. Dogs can smell very well. At first they tested dogs and their ability to smell a few particles per million, then billion and even trillion and the dog was able to smell the particles and even track the sent. ... • 7. The Secret Behind the Peace The Secret Behind the Peace Issue Overview Every year during March to April, is the months that the seal fisheries are active. This is known as the seal hunting season, great amount of seals were killed for commercial purposes (Liberation BC, para 1). The hunting activities took place on the Newfoundland coast, the northern Gulf of St. Lawrence and Inuit regions (Government of Canada, 2013, para 2). The seal hunt has been a dispute for years between the support side and the oppose side. The argument is still being continued Seals are killed in a cruel ways. Hakapik is a tool used by the fishers to hit the heads of the seals causing the seals to die. Forty two percent of the seals are skinned alive (Liberation BC, para 9). The seal skins are warm and waterproof; it is an excellent source to use to make coats, hats or scarfs for winter (Government of Canada, 2012, para 3). It is illegal to kill seals that are under 11 days old because they haven t lost their fur yet. Baby seals lose their white furs when they are 11 days old, and it is then legal to kill them. Even though they are only babies (Liberation BC, para 2). The quota of the seal hunt was 400,000 in 2012. However, the quota suggested by the scientists was smaller (Liberation BC, para 1). Fortunately, the numbers of seal hunters are starting to decrease. The reason is, that they do not make much money out of it (Liberation BC, para 24). Originally founded by the Disney brothers, Walt and Roy E., the company has now become a world wide phenomenon, diversifying its company into live action film production, television, and theme parks. It surrounds us every day, in almost every way possible. More importantly however, the Disney industry is known to people world wide as being one of the top leaders in children s popular films and subsequently, storybooks. The countless movies and short films made over the years have not only provided joy and happiness to families and young children, but have ultimately influenced the way that these young children see the world as they grow older. Many of the traditional fairytales known throughout the ages have been Disneyfied and have become more modern through their adaptations, in order to increase revenue and audience appraisal. In addition, a vast majority of the films released are based on different cultures, countries, or a certain historical group or figure to create a more wholesome atmosphere where children can learn and become cultured. However, the responses to these films that are often overlooked are the ones that bring a negative light to the Disney Company and their reputation as a whole. • 9. Impact of Media on Politics Essay Impact of Media on Politics The role media plays in politics is undeniable. Our soundbite culture with its inherent limited attention span dictates a McNugget of information. Unfortunately this often leads to misrepresentations being accepted as fact. A glaring example of this was the Killian documents controversy. In September 2004, the CBS program 60 Minutes Wednesday aired a report critical of President George W. Bush s service in the United States National Guard. The four documents included criticisms of Bush s service in the Guard during the 1970s. These documents were supposedly created by Bush s commander, the late Lieutenant Colonel Jerry B. Killian. It was also reported that the documents were obtained by a CBS News producer ... In the end, Bill Clinton easily defeated George Bush and Ross Perot with 43 percent of the vote. Some pundits have suggested that this appearance turned the race around. Easily the most polarizing force in media today is talk radio. In 1987 the FCC repealed the Fairness Doctrine. This regulation had required that stations provide free air time for responses to any controversial opinions that were broadcast. Now the opportunity was available for a level of flatly partisan programming. As referenced by Wikipedia, Talk radio provided an immediacy and a high degree of emotionalism that seldom is reached on television or in magazines. Pew researchers found in 2004 that 17% of the public regularly listens to talk radio. This audience is mostly male, middle aged and conservative. Among those who regularly listen to talk radio, 41% are Republican and 28% are Democrats. Furthermore, 45% describe themselves as conservatives, compared with 18% who say they are liberal. • 10. Why Panera Bread Is The Healthiest Fast Food Alternative Begging the question is a type of logical fallacy that avoids the argumentative process (McInerny 109). An example of a begging the question fallacy is when my friend argued for his point that Panera Bread is the healthiest fast food alternative restaurant. My friend, Tim, stated that Salads and fruit smoothies are the healthiest types of food. Since, Panera Bread serves several types of salads and fruit smoothies this makes Panera Bread the healthiest fast food alternative. Tim s statement exemplifies begging the question fallacy because the conclusion, Panera Bread is the healthiest fast food alternative , does not have logical premise and reasoning behind the argument. Tim did not provide any factual information proving the fact that salads and fruit smoothies are the healthiest food option. Also, Tim did not compare the actual calories in the food at Panera compared to a typical fast food restaurant, such as McDonalds. In summation, Tim completely ignored the reasoning that backed up his conclusion, which was Panera is the healthiest fast food alternative, thus making the conclusion a begging the question fallacy. A false assumption is a type of fallacy where a reputable assumption is made and can be demonstrated to be false with facts stacked against the assumption (McInerny 111). A false assumption can also be made when an arguer is assuming that his or her audience has a knowledge of certain kind when in fact the audience doesn t (McInerny 112). An example ... Sometimes, the inventions springs suddenly but after a long trials and sufferings; so that the inventor attains his goal at once as if a sudden inspiration had illuminated his researches. The poets called this inspiration an intuition and the sophists regarded it a heavenly discovery and unidentified suggestion. • 12. Examples Of Consensus In 12 Angry Men When someone is on trial for murder, it can be difficult for a stranger to realize that the person on trial s life is in the hands of a small group of people. Therefore, due to jurors often being strangers, it can be significantly difficult to put aside their biases and come to a proper consensus. In the film 12 Angry Men, the process of coming to a consensus was troubling due to Juror Three s personal bias towards the topic. Unlike looking at the situation rationally as Juror Eight did, Juror Three brought his emotions, personal experiences, and bias into his fallacy riddled argument. Juror Three was arguably the most difficult juror to convince that the boy was not guilty. Throughout the whole film, up until the end, Juror Three stood his ground with his argument. Juror Three often disagreed with any counterargument that Juror Eight made. Near the beginning of the film, Juror Three went off on an off topic tangent about his son and how he was so ashamed in his actions and how he was also a teen. Therefore, we are able to notice the motive behind the arguments that he made. Juror Three would often try to counter someone else s argument by stating that he knows for sure the boy is guilty. For almost every counter argument, he would provide little to no evidence to back his claims. In addition, the most notable trait about Juror Three s arguments is that he refuses to acknowledge that there is, indeed, reasonable doubt. For example, despite all the information about the ... • 14. Symbolism Of Humankind In Lord Of The Flies By William... Humankind is an imperfect species with many flaws. Author William Golding shows these in the novel Lord of the Flies. It is shown through a group of schoolboys crashing on an island without any adults. Without the rules and constraints of civilization the children show humanity s true nature and raw instinct. The imperfections of man are shown through symbols in the novel such as the scar on the island, the beast, and the schoolboys who crashed onto the island. The first symbol that is used in the novel was the scar on the island. The scar was where the plane crash landed, leaving a destructive mark on the island. He looked up and down the scar. And this is what the tube done. This quote explains that the scar was made by the fuselage crashing and ripping into the earth leaving a giant gash on the island. The scar symbolizes mankind s destruction and how humans can destroy nature just by entering it. The island was untouched and resembled paradise, at the same time in the outside world a gruesome war was occurring. The carnage and havoc that reigned over society is also evident on the island. There was a clean slate for them to build a society without violence, but it did not happen because of destruction being a natural tendency of mankind. The scar foreshadowed the destruction the island. During the children s stay, the island suffered through the children s wrath. To others, McCandless was an irrational kid with no experience who couldn t handle his family issues. On the other hand, Henry David Thoreau is viewed as a calm, steady, and contemplative man with a dedicated love of nature. Chris McCandless and Henry David Thoreau share many similarities, but they also have defining differences. Chris was different from Thoreau because he was running from his past whereas Thoreau wanted to go to the woods, and Chris overestimated himself whereas Thoreau was more level headed, but they were similar in that they both didn t believe in material objects. Chris went into the wild because he wanted to escape his past and because of his general hatred towards prejudice against society, while Thoreau was more positively motivated to go to the wilderness. His motivation to go to the woods was negative because he was running away from something. Although his friends and family described him as very independent and motivated to go against everything he was taught, his real motivation was because of his family struggles. Chris s father, Walt, never fully divorced his ex wife, Marcia, and he still had relations with her despite being married to Billie. When Billie found out, she was very hurt, and so were Walt and Marcia. However, to make amends, Walt finalized the divorce with Marcia. They resolved the problem and moved on. When Chris unearthed this truth, he was unbelievably upset, but he didn t address it directly. Instead, he waited years to talk about it, occasionally shunning his parents and judging them behind their backs. Chris was very self righteous, and he took every opportunity to denounce his father even though the issue of the divorce had been resolved. He expressed his anger in a very passive way, and because he never found real closure, his anger accumulated. He decided to release his anger indirectly. This is why he took classes on racial inequality, and why he was so mad about poverty in the United States. His outrage ... Get more on HelpWriting.net ...

  • 33. The Law And Its Effect On Family Provision In the legal context, the ability to leave property to any person you desire upon death is called testamentary freedom. The concept of testamentary freedom is perhaps the reason why many people contemplate death and attempt to ensure that they meet all the formalities in executing a valid will. It is important to note that testamentary freedom is not a notion that is absolute. Family members of the individual who feel they have an entitlement under the will can bring a claim for contesting a will against the estate. These family provision claims are becoming more common in our society and are arguably undermining the testator s use of their free will. The courts have implemented the use of mediation as a strategy to assist them in processing these applications. This effective and inexpensive mechanism is a compulsory step in some states before approaching the courts while in other states mediation is highly recommended but not compulsory. Through critical analysis of the law and its effect on family provision claims, it will be depicted that testamentary freedom as a legal right is adversely affected by compulsory mediation. MEDIATION IN AUSTRALIA Queensland In Queensland, the legislation does not stipulate that mediation is compulsory in family provision claims but it is imposed by virtue of the District Court s practice notes. This practice note states that a draft order to the court must comprise of a dispute resolution plan . The rationale behind this note is to ... Get more on HelpWriting.net ...
  • 34. Representation of Women in Early British Literature In most early British literature a woman is often presented as only one thing: an object. They can be objects of desire, objects of beauty, or merely objects to be owned, but it is rare that a woman is anything more than that. It is even more uncommon to find a female character in literature that is presented as an equal to the men around her. In William Congreve s The Way of the World he plays on the similarities of both his female and male characters to establish just how much of an issue gender really is because though their actions might be similar, the consequences are not. The tangled web of relationships that connect each character in this story are what drive Congreve s play forward. With each past affair (or current) affair that ... Show more content on Helpwriting.net ... Even a man who s character isn t as upstanding as a woman s still makes out better than her in the end. Congreve seems to establish that women are merely at the whim of the men around them, they do not control their own fates because they are naturally submissive. Lady Wishfort, try as she might, cannot do anything to stop Mirabell s actions and he, therefore, comes out the winner. The most important fact that was overlooked in class was the true nature of Mirabell and Millamant s relationship. One question never broached in discussion was, why all the plotting in the first place? If Mirabell truly loved Millamant like he claimed, why did he need to fight so hard to get the money she was expecting from her aunt? There s no evident reason why they couldn t have lived without such money or her aunt s blessing and yet it seems as if Mirabell practically refuses to marry Millamant without her inheritance. Millamant, the female and again the submissive one, goes along with her beloved s scheming because she loves him and will do whatever it takes to get him to marry her. Millamant, the man, uses his dominance to get her to agree because it seems he will only marry her if he gets her money as well. The woman seems like a fool for only focusing on love and only gets what she wants as a result of her man s intelligence and cunning, but he certainly wasn t just in it for the love. John ... • 35. The Three Types of Ancient Chinese Rulers In ancient China, many different rulers tried to unify and rule the country using a variety of methods Confucianism, Daoism, and Legalism to name a few. Each philosophy had its own set of rules of how people should act both in public and privately. The overall goal of each philosophy was to set a standard of acceptable living that would ensure harmony and success for the society. However, each was different and thus had different results. Legalism is a philosophy emphasizing strict obedience to the legal system. It was one of the main philosophic currents during the Warring States period and when it was most prominent. The school s most famous proponent and contributor, Han Fei believed that a ruler should use the following three tools to govern his subjects: law, method, and legitimacy. The law code must be clearly written and made public. All people under the ruler were equal before the law. Laws should reward those who obey them and punish accordingly those who dare to break them. Thus it is guaranteed that actions taken are systematically predictable. In addition, the system of law, not the ruler, ran the state, a statement of rule of law. If the law is successfully enforced, even a weak ruler will be strong. Especially important is that no one can fathom the ruler s motivations, and thus no one can know which behavior might help them get ahead, other than following the laws. Legitimacy is the position of the ruler, not the ruler himself or herself, that holds the ... Get more on HelpWriting.net ...

Each location within Emma s world holds a distinct reality and expectation she must live according to, due to the strong influence it has on her state of mind. Within each city Emma undergoes specific types of emotions and attachments that essentially become the drive to her great depression. Tostes, Yonville, Rouen, and Paris bind together for a single purpose in order to display the overall theme of dissatisfaction and repression, which ultimately become the reason for Emma s ironic death. It mirrors her extreme naivete when she observes each and every detail of the ball such as, the clear complexion that is heightened by the pallor of porcelain, the shimmer of satin, and the veneer of old furniture (35). Emma s distinctive vivid imagination results in an interference within reality when Charles discovers the cigar case with a green silk border (37) on their way home from the ball at La Vaubyessard. For Emma, the case comes to symbolize all the allure, sentimental relationship of the ball itself, and the universe of highborn simplicity and extravagance it represents. Despite the fact that, she sees the physical, subtle elements of the ideal setting of the ball, she doesn t consider the entanglements of what this sort of way of life may bring desire, triviality, or depression.
