that actually led to action being taken. This was the main case that led to the Baby Doe rules. In these
cases, parents were refusing surgery that was set to correct the birth defect that babies were being born
with. Refusing these medical treatments was causing the babies to die because they were being
prevented from receiving the proper nutrition and hydration needed.
The case that set the Baby Doe rules was in Bloomington, Indiana in 1982 when a baby was with
down syndrome, his parents refused surgery that was meant to fix a birth defect and was required to be
performed immediately. The refusal of this surgery led to the death of the baby boy. There were
officials at the hospital that didn t agree with withholding the surgery from the baby boy and so
decided to take it the Indiana Juvenile Courts and the court had actually ruled in the favor of the

480,000 people die from tobacco use and exposure to secondhand smoke, making it the leading cause
of preventable death in this country? (CDC, 2017) How many of those people do you think have
children? Second hand smoke is just as dangerous as lighting up according to the Center for Disease
Control and Prevention. It causes numerous health problems in infants and children, including more
frequent and severe asthma attacks, respiratory infections, ear infections, and sudden infant death
syndrome. (CDC, 2017) Anti smoking advertisements began in 1998 as part of a 206 billion dollar
settlement. Major tobacco companies, including Philip Morris USA, R. J. Reynolds, Brown
Williamson, and Lorillard, were to pay for anti smoking ads due to a lawsuit from 46 states. The states
filed a lawsuit against the major tobacco companies for Medicaid and costs incurred while treating the
sick and dying cigarette smokers. (Public Health Law Center, 2015) In 2012, the federal government
took on an effort to attack the nation s tobacco addiction with a series of advertisements highlighting
