Chapter 9 Business Law Outline
Chapter 9 Outline Chapter 9 Legal Capacity to Contract Contractual capacity is defined by the law to
mean the ability to understand the consequences of a contract. * What is Capacity? * Parties who have
special contractual rights due to a legally recognized lack of such capacity include minors, the
intoxicated, and mentally impaired. All of these parties are said to be incapacitated. * Minors are
defined as individuals under the age of majority to contract. This is the age at which a person is
entitled to the management of his/her own estate (18 in most states). * A person who has not yet
reached the age of majority is called a minor. * Minority, or the state of being below the age of
majority, ends the ... Show more content on Helpwriting.net ...
* Who has contractual capacity in organizations? * Some people who work for businesses or other
types of organizations have the capacity to bind the organizations to contracts. * Scope of authority
range of contractual acts the organization has authorized a person to be responsible for. * Capacity to
contract can be granted when the employer tells an employee that he or she is authorized to bind the
organization. * Capacity can be created when the organization leads others to believe that a person has
certain authority. Disaffirmance means a refusal to be bound by a previous legal commitment.
Generally, a person lacking contractual capacity can disaffirm a contract for necessaries or goods or
services that are not necessaries * Any time while still under the incapacity * Within a reasonable time
after attaining capacity * WHAT MUST BE DONE UPON DISAFFIRMANCE? After attaining
capacity, a person may ratify the contract made while under an incapacity. Ratification is action by the
party indicating intent to be bound by the contract. Ratification may consist of either of the following:
* Giving a new promise to perform as agreed, or * An act that clearly indicates the party s intention to
be bound. * WHAT MUST BE DONE UPON DISAFFIRMANCE? In all states, when a minor
disaffirms, anything of value the minor received and still has must be returned. The minor in then

Student Loan Repayment Calculator Analysis
A student loan repayment calculator is an essential tool in figuring out exactly how much money you
owe on your student loans and how long it will take you to pay them back. Tuition and fees are
currently so high at most universities that hardly any students can matriculate and graduate without
incurring debt. Whether you are a potential student trying to figure out how much money you should
reasonably borrow or a graduate trying to plan your repayment schedule, a student loan repayment
calculator can help you with the details.
Interest Rates:
In order for a student loan repayment calculator to compute the amount of your monthly payments or
how long it will take you to get out of debt, you will need to know the interest rate on your loans. ...

However, that is not always an option for some people. If you feel like you want more time to repay
your loan, you should speak to your lender. Most loans are on a standard repayment plan which is the
above mentioned ten year term. However, some loans do qualify for the extended repayment plan. To
qualify for extended repayment, your loans should be more than $30,000 and they should be Direct
Loan Debt. This plan offers you two payment options: fixed and graduated. Fixed payments are just
like installment loans. You will pay the same amount every month for the length of the loan s term.
Graduated loans let the monthly payment grow every two years. Therefore, your payments start small
but they get bigger. Speak to your lender about your

A Study On Faith And The United States Of The Philippines
Faith Daniel is a forty six year old Chinese female resident of Montgomery, Texas. Faith was born in
the Philippines. However, she is profoundly influenced by her Chinese ancestry. Faith has three
sisters. Faith has a teaching degree and has taught in the private school sector. She can speak English,
Mandarin, French, and knows sign language. Her ancestors moved from China to the Philippines due
to a World War. Male children are valued more in the Chinese culture than females because males
carry on the family name. Therefore, when Faith s mother was pregnant with her fourth female child
she was offered to trade her child with a cousin s male child. Faith s parents refused to give up their
daughter. The refusal to trade for a male baby was a significant disgrace for the family. Consequently,
her father moved his family to the United States of America where her mother instilled the importance
of education in each of her daughters. She considers her father s decision to move the family to the
United States of America as a significant event that shaped her life. She feels that she and her sisters
are much more educated than cousins that eventually moved to the country later in their lives. Faith
possesses a fascinating set of life experiences along with an intriguing Chinese culture that has
influenced her character. Faith s favorite childhood memories include Christmas time with her family.
The children in the family created and performed skits of Bible

An analysis of porters value chain
To analyse the specific activities through which firms can gain a competitive advantage, it is useful to
model the firm as a chain of value creating activities. For this purpose, Porter identified a range of
interrelated generic activities common to a wide range of firms. The resulting model is known as the
value chain.
According to Porter (1985),
Competitive Advantage arises out of the way firms organise and arrange discrete activities .
Through using the Value Chain, the activities performed by a firm competing in a particular industry
can be grouped into categories as shown in the model below:
Upstream Activities Downstream Activities
Porter distinguishes between primary activities and support activities. Primary activities are ... Show

As mentioned, gaining competitive advantage requires that a firm s value chain be managed as a
system rather than a collection of separate parts. Reconfiguring the value chain by relocation,
reordering or even eliminating certain activities can often lead to a major improvement in competitive
position.
Upstream and Downstream
A firm s value chain links to the value chains of the upstream suppliers and downstream buyers. The
result is a larger stream of activities known as the value system. The development of a firm specific
competitive advantage not only depends on the firms value chain but also on the value system of
which the firm is a part. In most industries, it is rather unusual that a single company performs all
activities from product design, production of components, and final assembly to delivery to the final
user by itself. Most often, organisations are elements of a value system or supply chain. Hence, value
chain analysis should cover the whole value system in which the organization operates.
Within the whole value system, there is only a certain value of profit margin available. This is the
difference of the final price the customer pays and the sum of all costs incurred with the production
and delivery of the product/service. It depends on the structure of the value system, how this margin
spreads across the suppliers, producers, distributors, customers, and other elements of the value
system. Each member of the system will use its

One Tree Hill Character Analysis
The show, One Tree Hill, has many characters with different types of personalities. One in particular,
Nathan Scott, known as the best basketball player in his High School, is known to be a popular jock
type guy, selfish and rude. He wants to become the best basketball player and beat his dad, Dan Scott,
one day. Throughout the show, Nathan Scott makes many different mistakes but he gets to know other
characters that help him to grow from the person he once was. Even though he was once self
conceited, he also starts to become a family centered person and someone who sacrifices for others. In
the show, One Tree Hill, James Lafferty plays the character of Nathan Scott who has transformed
throughout the show from personal experiences and influences of others, signifying his ability to
distinguish between right and wrong, as Catholicism holds strong beliefs between the two. In the
beginning, the character of Nathan Scott was a person who was rude and a bully. Nathan Scott is the
head of his basketball team and he is also a popular person. Elke Van Damme and Sofie Van Bauwel
says, Nathan is a typical example of a jock, whose clothes show the importance of basketball in his
life even when he is not actively practicing the sport (Van Damme and Van Bauwel 26). Basketball
was something that meant a lot to Nathan. He would do anything to play and be the head person of
basketball. He also did not want anyone else to come and join the basketball team and take his spot

Difference Between Pop Culture, Art And Craft And Pop Culture
Historically here there are a lot of art movements such as Art Deco, Art Craft and Pop Culture, and all
of the art movement has changed the way the people see and design things. In this essay, I will be
discussing the difference between Pop Culture and Art Deco and how this two movement has changed
the style of people. Now let s talk about why I would choose these two art movements because these
two art movements are part simple but there was a lot of different distance contexts the art was created
as well as general history in these art movements.
First Pop art is the start in 1952 in London it was started by a group called The Independent Group
they were called as the pop art pioneer. It was a composition by a group of young artist, Sculptor,
architect, writer and critic, and they were challenging the Modernist Methodology of Art in that time,
question the artistic point of view and the idea of art in 1952.This group had discussed the main focus
is on the Impact of Popular Advertising, Film, Design Products, Animation, Technology and Science
Fiction how its effort pop art. In 1952 the first meeting of The Independent Group co founder, artist
and sculptor Eduardo Paolozzi use a series of double collage works in all of those designs there s one
call I was a Rich Man s Plaything use the word Pop for the first time to imitate the sound of a bullet
fired. From then on, The Independent Group started to put the focus on the American popular culture,
especially mass advertising.
The most famous artist for is Andy Warhol (1928 1987) he is the Pop godfather, he started of modern
pop art, it lets people have a more colourful visual art to enjoy. The age of his lifetime, in that time
society, is in a Hippogriff, peace, capitalism and gender dysphoria etc. Warhol believe art and business

between art and business; in his point of view, making money is part of the art, working is also a part
of art, and the profitable industry is the best art. Then he develops Popular art to the highest. And urban

The Federal Bureau Of Investigation
After the terrorist attacks in San Bernardino, the United States government, specifically the Federal
Bureau of Investigation was in a dispute with the technology company Apple. The FBI seized the
iPhone of Syed Farook who along with his wife Tasfeen Malik killed 14 people and injured 22. Farook
and his wife were then killed in a shootout with the police. However, the FBI could not bypass the
security code that Farook placed on his phone, and access information within the device. Therefore,
the bureau requested that Apple create a backdoor which is a mean of access to a computer program
that bypasses the programs security measures. Apple refused to comply with the bureau s request as
the company argued that it would jeopardize the privacy of their customers and is an overreach of
state power. Thus, the conflict was going to be decided legally, until the FBI canceled the first court
hearing with Apple. The FBI was able to unlock Farook s phone without Apple s help through a third
party company. But the government s actions set in place a dangerous precedent. By creating a back
door, the government is able to access information on any Apple device and has weakened the
company s cyber security. To prevent further legal disputes, Congress and the president should create
a modern law that can balance the interests of national security and privacy in the 21st century. Sheri
Pym, a California district court magistrate judge, ordered Apple to create new software or a backdoor

Hills Like White Elephants Character Analysis
How does the way people portray themselves reveal more about them and the life they live? Paying
close attention to the emotions of a character and their actions can allow for more comprehension. The
use of characterization within the story Hills Like White Elephants aids the reader to further
understand the persona of an individual. In return, this allows the reader to understand them on a
deeper level with a powerful connection. Without characterization, it would be difficult for the
individual reading to form a bond with the man and the girl because they wouldn t truly understand
what they re going through. In Hills Like White Elephants , by Ernest Hemingway, the American s
dialogue, the way the girl converses and where their eyes wander give insight on how the man and the
girl have communication difficulties.
Throughout the story, it s made evident through dialogue that the man has a strong need to assert his
dominance which damages his relationship with the girl. Firstly, the man appears to have total control
within their relationship, even with uncomplicated factors. When they order drinks, the man says, Let
s drink beer. , and he simply orders them following this statement. The girl can easily make this
straightforward decision herself, but the man feels the need to take complete control. Also, when it
comes to crucial life matters, the American still asserts his dominance. The need for the man to have
control when it comes to important matters is seen when

The Age Discrimination In Employment Act (ADEA)
Define and explain ADEA The Age Discrimination in Employment Act (ADEA) is the federal law
governing age discrimination. It was ordered in 1967 to advance the work of more seasoned
specialists in view of capacity as opposed to age, avoid discrimination, and help take care of the issues
that emerge with an aging workforce. The ADEA precludes a business from refusing to contract,
firing, or for the most part discriminating against a delegate age at least 40 prepared, only on the start
of age. Along these lines, a business can t deny a delegate pay or fringe benefits when the main
support is age. Nor may a business portray delegates into gatherings of an age group in a way that
outlandishly precludes workers from claiming work openings. For instance,

As a result he was not obliged to take the post in order to mitigate the losses.
SCRUTINY OF CAUSATION AND REMOTENESS OF DAMAGES
To avoid undue hardship to the defaulting party a line must be drawn separating damages resulting
from his breach for which he should be liable and damages which, although in the broad sense of the
word are as a result of his breach, are so remote to extent that he should not be liable for them. This
line is drawn when separating General (intrinsic) damages from Special (extrinsic) damages.
The courts insist that the damages should be direct rather than indirect. Direct damages are also known
as general or intrinsic damages. They flow naturally and generally from the kind of breach of contract
in question.
Indirect damages are special or extrinsic damages, which are only recovered in special circumstances
attending the conclusion of the contract.
In Zimbabwe there is only one possible test that could be applied to decide whether special or
extrinsic damages can be recovered for breach of contract. This test is the contemplation principle.
The test applied under this principle is to check whether the contracting parties actually or
presumptively foresaw that the breach of contract in question would result in the type of loss being
sued for. Case in point is that of Collective Self Finance Scheme (CFC) v Asharia (A) year 200 in
which CFC contracted to buy a property from the respondent and paid a deposit. CFC later repudiated

The Pros And Cons Of Minority Voting
Jacob Frazer
Louis DeSipio
Pol Sci 61A
20 November 2017
There are many difficulties minorities face when trying to take an active part in society, specifically
voting. Since the Voting Rights Act of 1965 passed there have been many changes to the law to break
the barriers between the minorities and non Hispanic whites, but there are still factors that discourage
minority voters. Thesis: There are various factors widening the minority voting gap including voter
identification, early voter registration requirements, and strict voting procedures. Some internal factors
also include family voter participation and voting education.
The first factor that leads to the widening of the minority gap is the requirement of voter
identification. Since ... Show more content on Helpwriting.net ...
The best way to fix this problem is to stop requiring photo ID at the polling booths which would allow
anyone to go vote. There are ways to identify voter fraud instead of requiring a photo ID.
Another major factor that hinders minority voters is early voter registration requirements. This means
that if a voter wasn t registered to vote weeks or even months before an election, so if one were to go
to vote and haven t registered, they would be turned away. Minorities are less likely to be registered
and are unable to participate in elections if they develop interest in the weeks immediately before the
election. People who move regularly (which disproportionately includes young adults and people who
rent rather than own their own homes) are also more likely to fall out of registration by failing to
reregister at their new address. (Shaw et. al. 2015: 281) By requiring registration weeks in advance,
many voters won t be able to vote and have their voices heard. Another way institutions suppress
minority voters is by maintaining the voter registration lists and purging nonparticipating voters. There
is little to no regulation on how long it takes to be purged from the list, so those who voted only every
four years only during the presidential election the list could have been purged the third year without
voting, which would take them off the list and they would have to

Two Main Ways Scientists Learn About Earth s Interior

how scientists learned about Earth s interior. Crust, Mantle, and Core

the ocean floor. Scientists discovered that the older rocks were further away and younger rocks were

The Popularity of A Christmas Carol by Charles Dickens Essay
The Popularity of A Christmas Carol by Charles Dickens
I Think that A Christmas Carol by Charles Dickens is still popular today because it has a good moral
story and people still enjoy a good old fashioned ghost story. This is because a lot of us are still
interested in the afterlife and if such things as ghosts even exist we are fascinated by them and a novel
with ghosts in, we cannot put it down. The moral story which seems even in modern day society to
stick with us and we are still very much obsessed with Christmas and the joy that goes with it. Also

A Christmas Carol has changed from the days that Charles Dickens wrote it by constantly updating
itself. There are numerous ways a book can update itself but A Christmas Carol has been made in to a
funny film A Muppets Christmas Carol which scrooge is played by Michael Caine which makes it
more interesting to the generation of the times. It also makes the plot more appealing to the younger
generation who will read books such as A Christmas Carol . The Muppets have done a fantastic job of
recreating the story and is told by two Muppets who follow scrooge around the story commentating to
the scenes that need playing. Also a major part that has changed is the language; this version has got
rid of confusing and mind baffling words in some of the newer versions of the classical story. An
example of this is Spectre and Humbug which is a way of saying someone has been annoying or
talking a load of nonsense. Now they use words that even the youngest of people will recognize. This
also makes the book more interesting because it does not seem as old or as outdated, which in most
cases is a good thing.
Dickens describes his characters in such a way that they leave a lasting effect on you and a visual
description or appearance in your mind.

The Weight Loss Journey For Wrestling

within a three month span in 1997 all from cutting weight (Litsky). Cutting weight is when someone
will try to drastically reduce their weight in a short period of time through a variety of methods. The
deaths of these three collegiate wrestlers resulted in a hasty decision from the NCAA in an attempt to

that policy banned the use of rubber suits and saunas for use in weight cutting practices because they
drastically increase body temperature and dehydration, which was the root cause for the deaths of
these three wrestlers (Larimer). Larimer also explains changes the NCAA made to the weight classes,
adding a seven pound weight allowance to all of the weight classes so that athletes would not have to
lose as much weight, with the stipulation that all weigh in times for competitions would be held 2
hours prior to the event rather than 24 hours (Larimer). This rule was enacted to discourage athletes

girl. These challenging events are life changing at times, which forces her to make adult decisions at
young age. The life Esperanza is forced to live is unfortunately a reality to many Mexican families that
made the move to the United States in search of the American Dream. Events faced by Esperanza s
family alongside workers of the El Rancho de las Rosas, which Esperanza s family owned, forces
Esperanza to change into a mature young teenage female. Munoz Ryan shows Esperanza s character
change by challenges she is faced with. The outcome of these events show growth within her young
life by the emotions Esperanza expresses. Throughout the book Munoz Ryan uses symbolism to show
growth and change within all characters. However; it is obvious to see the symbolic aspects the author
provides related to Esperanza s changes. The author faces Esperanza with different events to help
remind her of a once wealthy life along with her current immigrant life style. As a whole many factors
influence Esperanza s change. In the onset of Esperanza Rising, Esperanza is a wealthy, spoiled and
dependent eight year old child, due to life changing events, she matures into an independent and
mature teenage female. Esperanza is faced with several major events that forces her to mature at a
young age. In these events readers can see how she grows as her emotions change. In the beginning of
the book, Esperanza s father passes away (p. 22) and their family home on the ranch, El Rancho de las
Rosas, catches on fire (p.40). This is the beginning of Esperanza s quickly changed young life. As a
young girl she realizes life will never be the same. She once was wealthy and lived life with the help
of housekeepers. Papa also had field workers to help with his needs on the farm. Raised with a
positive perspective on life, her hopes and dreams are soon challenged. Esperanza is forced to leave
everything she has ever known to move to the United States. The fire is symbolic because the family
is forced start all over, in life, along with her social

Persuasive Animal Shelter
I met my best friend ten years ago. He has thick, brown, black, and white hair, brown eyes, and white
feet. He loves stuffed animals that squeak, riding on the golf cart, hunting for lizards and squirrels, and
eating any time of day. His name is Sam and he s ten years old. Oh, did I mention that he s a dog? He
does not know it though. When I was seven years old, my mom, brother, and I went to the local
animal shelter to look at the animals. We found two adorable puppies one was solid white and the
other was brown, black, and white and my brother and I begged to have the white one. But, a couple
days later, we came home from school and saw that sweet brown, black, and white puppy lying on our
dad s chest taking a nap. The white one had ... Show more content on Helpwriting.net ...
The most popular dog breeds like Pugs, German Shepherds, Yorkshire Terriers, Bulldogs, and Boxers
all have extremely highhealth risks. Pugs and other short nosed dogs often have breathing problems.
Pugs can also get diabetes, spinda bifida because of the tightly curled tails, and dislocation of joints.
German Shepherd can have chronic pelvic pain, hip dysplasia, and at least eight different heart
problems. Yorkshire Terriers have a high risk of having a collapsed trachea, seizures, diarrhea, and
hepatitis. Bulldogs are known to develop brain and spine tumors and skin infections. They also often
have to be artificially inseminated and give birth by Cesarean section because their heads are too big
and their hips are too narrow to give birth. If humans have to surgically produce and give birth to
bulldog puppies, they should not be having puppies; there are plenty of other breeds that do not have
to go through so many traumas to give birth. Boxers also have breathing problems, can develop
several types of cancer, have respiratory problems, and eye ulcers. If you buy a pure bred dog, you
should also be ready to pay for very expensive veterinary

The Beach Carrier Essay example
Q1: What is the nature of the product? What are its strengths and weaknesses?
A1: The Beach Carrier is a new product concept developed by Mary Ricci. It is a large, lightweight,
durable bag that is designed to carry everything required for a day at the beach, including a chair. The
Beach Carrier can be folded down to a 12 inch by 12 inch square for easy storage when not in use. It
comes with an adjustable strap and various sized pockets for carrying all types of items to the beach or
other outdoor activities (i.e. concerts, picnics, and barbecues).
The Beach Carrier possesses several strengths relative to competitive products in the market,
including the following:
1. First, the overall product concept of a single bag that can carry ... Show more content on

4. The fluorescent colors of the Beach Carrier are see through and considered trendy , lessening the
perceived quality of the bag.
Q2: What are the limitations to the assumptions Ricci has made in determining the market potential?
What risks do these present?
A2: In assessing the market potential for the Beach Carrier, there are several assumptions that Ricci
made that could significantly impact the overall market share potential. These include the following:
1. First of all, Mary Ricci has made the general and often popular assumption that bigger is better .
However, a 36 inch by 36 inch bag is huge and would be extremely heavy if completely filled. People
may prefer to have a smaller bag and limit the items that they bring to the beach or on another outing.
2. Second, the Beach Carrier utilizes an adjustable shoulder strap for carrying and Mary has assumed
that this method would not be viewed as a negative when compared to the Caddy Shack (backpack
type) or the Wonder Wheel (oversized wheels). However, many consumers would likely view these
other carrying methods as an advantage, especially if one is packing lots of stuff including chairs and
umbrellas.
3. Next, Mary based her market research on all people who use suntan and/or sunscreen products. This
may be a significant overstatement of the market as many people who use these products

The Book Of The Courter Castiglione Summary
Would Castiglione Like Competition Shows?
Competition television shows have made the world a better place! In The Book of the Courtier there is
a discussion about characteristics of a good courtier. One of the characteristics was sprezzatura. This
characteristic means that the courtier should go about showing off their skills and talents in a
nonchalance way, even if they worked hard behind the scenes. If Castiglione watched television today
his least favorite genre would be completion shows.
Importance Of Sprezzatura
Castiglione thought that sprezzatura was important to show skill as an effortless talent. He highlights
this point flat out by saying Practice in all things a certain sprezzatura [nonchalance], so as to conceal
all art and make whatever is done or said appear to be without effort and almost without any thought
about it (Bizzell Herzberg, 2001, p.661). Even if a person practiced for hours on end they should not
let others know. Instead the skill should be presented as a natural talent. Presenting a skill in this way
keeps the audience in the dark on the preparation that went into making the speaker come off as
effortless. Consequently this point leads me to believe that Castiglione would dislike completion
shows because this goes against nonchalance.

The offhandedness of the model s expression heightens anxiety in the reader by concealing the back
breaking labor that went into the time consuming and prohibitively expensive task of being
fashionable (Harris, 1993, p. 133). While the model in the moment they may have to push past
obstacles in their way to maintain a nonchalant attitude. Previously I mentioned that Castiglione
would disapprove the competition show Americas Next Top Model, but I think he would appreciate
print work. The magazine shows the nonchalance clearly and the audience is ignorant to the details of
the time and effort put into getting the

Analyze the security mechanisms needed to protect the DMS systems from both state employees and
users accessing over the internet:
Department of Management Services (DMS) has chosen to expand their applications and services via
TCP/IP and Internet access. DMS uses a widely used proprietary scheme: IBM s Systems Network
Architecture (SNA) which provides support for TCP/IP (Transmission Control Protocol/Internet

Thus, all distributed applications, including remote logon, client/server, email, file transfer, Web
access, and so on, can be secured (Stallings, 2009). Finally, Stallings (2009) has noted, another
relatively general purpose solution is to implement security just above TCP by using Secure Sockets
Layer (SSL) and the follow on Internet standard Transport Layer Security (TLS). For full generality,
SSL, (TLS) could be provided as part of the underlying protocol suite and therefore be transparent to
applications. Alternatively, SSL can be embedded in specific packages.
Critique the transition process performed by the DMS in the case study. Then, recommend two (2)
alternatives to the IP Infrastructure or applications not already mentioned in the case study: By the
early 1990s, the Florida department of management services (DMS) had built up a large information
systems network that serve state government agencies in 10 regional sites and connected these to the
data center in Tallahassee. The network was based on the use of the proprietary systems network
architecture (SNA) from IBM and mainframe at the data center that housed most of the applications.
Although relatively happy with the SNA application and services by providing TCP/IP capability and
internet access. The goal was met in a remarkably short time. Over the course of 30 months, DMS
built a statewide TCP/IP network, began

How Does Power Control In Macbeth
It is the human instinct that the more power one wants the more degenerate activities one must do to

utilizing Macbeth who undermines under the prospect of having control over others. Macbeth winds

loathsome deeds, for example, submit regicide.

Theme Of Politics And The English Language By George Orwell
George Orwell s 1946 essay, Politics and the English Language, brings forth themes of deception,
honesty, and political bias through the eyes of the author himself. Orwell begins the narrative by
refuting standard assumptions of the English Language, and that language is a reflection of the shape
of society. Our civilization is decadent and our language so the argument runs must inevitably share in
the general collapse (127). The essay s deeper concerns of how language is shifting and perhaps
limiting expression are troubling yet serves as a reminder of Orwell s Newspeak in 1984. Orwell s
extensive use of metaphors, similes, and imagery depict his growing concerns of contemporary
writing styles.
Orwell s introduction gives insight into his beliefs of the collapse of the English language through his
distaste for meaningless words. Most people who bother with the matter at all would admit that the
English language is in a bad way, but it is generally assumed that we cannot by conscious action do
anything about it (127). He argues that English is a tool and its erosion is human made rather than a
natural process. Orwell further suggests simplifying language without convoluting the meaning.
Complex words such as loquacious or ebullient could be better understood by readers if simplified to
talkative or cheerful. The essay begins to shift its focus from Orwell s view of contemporary English
to bringing five examples of written pieces that exemplify the prior

Peter Singer s The Singer Solution To World Poverty
The Declaration of Independence guarantees everyone the rights of life, liberty, and the pursuit of
happiness. In many ways, those inalienable rights are tied into many aspects of the stereotypical
American lifestyle. There is the idea of the American Dream, consisting of a nuclear family living in a
nice house with a white picket fence, a well cared for lawn, and a car in the driveway. As we all know
this is a very atypical scenario for most of the planet. According to DoSomething.org, more than three
billion people live on less than $2.50 a day, with 1.3 billion of those people living in extreme poverty,
characterized by extreme poverty (less than $1.25 a day) ( 11 Facts About Global Poverty |
Dosomething.Org | Volunteer For Social Change ). With such a large economical gap shouldn t people
feel more compelled to act up and donate money to a cause? This is the question that author Peter
Singer explores in his essay The Singer Solution to World Poverty, with entails people being radically
philanthropic, giving away all money that isn t used on necessities. While this method seems like the
most charitable course to take, humans enjoy luxuries and do not care for everyone equally. There are
many moral dilemmas in which there is a deviation from what is right in the utilitarian point of view
and the morals that current society holds.
While it is important to look at Singer s specific argument, it is also important to take a step back and
look at where he is

The Effects Of Digital Etiquette In The Digital Age
Digital etiquette is a modern variation of the old adage treat others the way you want to be treated
(Behrens, n.d.) . This is an important yet difficult lesson to teach children in the digital age because
they spend less time participating in face to face encounters and more time behind a screen. In fact
children ages 8 18 spend approximately 7.5 hours using technology and social media (New Research,
2014). What makes this lesson so difficult is the fact that because children spend so much time behind
a screen interacting with people, they spend less time reading people s emotions and seeing how their
words affect other people. In fact, many adults struggle to come to this realization as well. Based on
my own personal experience on social media, many adults still react to situations they come across
online emotionally and do not necessarily think about what they are posting and how their words
affect the people that are reading them. This is evident with the amount of arguments that occur
mostly in the comment section on social media. In fact, social media is an excellent source of poor
digital etiquette with all of the fights, swearing, and belittling of others that occurs on these platforms
(Digital Etiquette, 2008). This is largely because of the misinterpretations that can happen when
communicating digitally verses communicating face to face. It is difficult to interpret the context from
which someone is speaking. It is essential that adults slow down with their

Nt1310 Unit 1 Patient 1
DISCUSSION
For each of the seven patients, I have come up with the diagnosis and explanations for what the next
steps are for each patient. I used the module book for most of the explanations that help to explain
what the next steps are and what further tests they require.
Patient 1 has a negative diagnosis, as all the cells are lower than 33%. Their average nuclear to
cytoplasmic ratio was 13.32%, which is the lowest overall and is below 33%. This means patient 1 is
not required to have any further tests done. They will just need to come for screening tests every 3
years. Patient 1 s cells were all blue, which means only a haematoxylin stain, was used. The blue
indicates nuclei.
Patient 2 was diagnosed as low grade dyskaryosis for one ... Show more content on Helpwriting.net ...
This drug works by damaging the DNA in cancer cells and stopping them from multiplying. It binds
together the strands of DNA so that cells can t grow and divide (Cancer Research UK, 2015).
Papanicolaou test fails to detect, on average, 50% of clinically significant pre cancers and cancers that
are present at the time of testing. The interpretation of Papanicolaou smears is subjective, and cellular
abnormalities may be missed because of the reader s fatigue and distraction. Another drawback of the
Papanicolaou test is the need for highly skilled cytotechnologists, the training of whom takes several
years (Louvanto, Chevarie Davis, Ramanakumar, Franco, Ferenczy, 2014).
This means there are problems with the Pap smear, as it doesn t always recognise pre cancerous cells
at an early stage. Especially if they might have missed a cervical screening in between. In addition,
some pre cancerous cells may not be picked up until three or four tests later.
However even though there are many problem with the Pap smear, the most important error is failure
of women to get a Pap smear (Dziura, 2009). As it is harder to monitor any changes in the cervical
cancer if you don t turn up for regular

Summary Of Bernard Goldberg s Bias
Bernard Goldberg is a 72 year old American journalist, author, and political commentator. In the early
1970s, Goldberg worked as a producer and reporter for CBS news. In 2001, Goldberg released his first
book, Bias: A CBS Insider Exposes How the Media Distort the News, which became the number one
New York Times bestseller. In addition to Bias, he has also written four other books Arrogance, 100
People Who Are Screwing Up America, Crazies to the Left of Me, Wimps to the Right, and A
slobbering Love Affair. Goldberg s outstanding journalism has earned him the title as the winner of
fourteen Emmy Awards. Having served nearly thirty years at CBS News, Mr. Goldberg had earned a
reputation as one of the most original writers and thinkers in broadcast journalism. However, when he
observed his own industry, he realized the liberal media had completely missed their mission to give
honest news. After years of sharing his observations and promoting more balanced reportings,
Goldberg soon realized that no one listened because they believed they were doing the right thing. The
liberal bias continued, therefore Bernard Goldberg decided to take the situation into his own hands
and expose the distortion of the media himself. Goldberg s breathtaking and shocking best seller book,
Bias, reveals the close mindedness of the news culture and their mission to entertain rather than share
facts. In Bias: A CBS Insider Exposes How the Media Distort the News, Bernard Goldberg

The Functions And Mechanisms Of Homeostasis
The purpose of this report will be to examine the functions and mechanisms of homeostasis and how
this applies to osmotic regulation in humans. It will then explain the processes behind osmotic
regulation and discuss the significance of the system, including how it can be affected by various
conditions. Homeostasis refers to a series of processes that allow the body s internal environment to
maintain stability despite a fluctuating external environment. This occurs in all living organisms in
some way as it is necessary for life. Some of the factors affected by homeostasis are temperature,
glucose levels, water levels, pH level and blood pressure, among many others. The reason homeostasis
is necessary for life depends on the factor being affected. Usually (at least in the case of temperature
and pH) the factors have an influence on how effective the enzymes in the body are. Enzymes are
natural catalysts that speed up processes in the body that rely on chemical reactions. This includes
respiration which allows us to generate energy. Enzymes work by having a part called the active site
which carries out the enzyme s task. When an enzyme is exposed to temperatures that are too high the
active site will become damaged and the enzyme will denature. However if they are too cold then the
speed at which they are able to work will slow down. Because enzymes are responsible for so many
important functions this means they need to be kept at the optimum environmental range, hence why

Is the emphasis on a Color Blind Society an Answer to Racism?
Racism is a word that sparks a nerve in many individuals today. As hard as it is to believe, racism is
still a big factor in what we as a society know as a unified America. Although, it is not as obvious as it
was in the past, it still goes on, just in ways that are less noticeable. We ask the question, is the
emphasis on a color blind society an answer to racism. Ward Connerly claims it is a way to stop the
segregation and make America a whole as it has been striving to be for the longest. Eduardo Bonilla
Silva believes color blind racism is the new racial ideology and still brings about racial inequality. As
the solution to the question progresses, we ask ourselves, will a ... Show more content on

He is the founder of the American Civil Rights Institute and an outspoken supporter of equal
opportunities for all Americans. He expressed his views on racism by discussing an encounter he had
with a woman. While explaining his desire to succeed at having a color blind government, the woman
commented by replying what he was doing was going to be best for his people. Although, she may not
have realized her remark offended him, situations similar to that occur all the time especially with
blacks and minorities. Persons may do it without the intention to insult, but that just proves that
everyone is viewed more so by color than by characteristics and personality. Many minorities will
always be judged by their color because whites believe that they will never have higher power. Even
though Ward Connerly went through rough obstacles growing up involving race, rather than focusing
on the bad experiences he had, he claimed that if you take people at face value and give them an
opportunity, race is irrelevant. He supports the emphasis on a color blind society so people won t use
discrimination based on the color of one s skin. He used examples such as classifications and how
there was no need to classify people by race. After the Civil War, with having separation for
bathrooms, poll taxes and water fountains, distinguishing differences between people should have
been stopped. He decided to place the Racial Privacy

Student Loan Repayment Calculator Analysis A student loan repayment calculator is an essential tool in figuring out exactly how much money you owe on your student loans and how long it will take you to pay them back. Tuition and fees are currently so high at most universities that hardly any students can matriculate and graduate without incurring debt. Whether you are a potential student trying to figure out how much money you should reasonably borrow or a graduate trying to plan your repayment schedule, a student loan repayment calculator can help you with the details. Interest Rates: In order for a student loan repayment calculator to compute the amount of your monthly payments or how long it will take you to get out of debt, you will need to know the interest rate on your loans. ... Most loans are on a standard repayment plan which is the above mentioned ten year term. However, some loans do qualify for the extended repayment plan. To qualify for extended repayment, your loans should be more than $30,000 and they should be Direct Loan Debt. This plan offers you two payment options: fixed and graduated. Fixed payments are just like installment loans. You will pay the same amount every month for the length of the loan s term. Graduated loans let the monthly payment grow every two years. However, she is profoundly influenced by her Chinese ancestry. Faith has three sisters. Faith has a teaching degree and has taught in the private school sector. She can speak English, Mandarin, French, and knows sign language. Her ancestors moved from China to the Philippines due to a World War. Male children are valued more in the Chinese culture than females because males carry on the family name. Therefore, when Faith s mother was pregnant with her fourth female child she was offered to trade her child with a cousin s male child. Faith s parents refused to give up their daughter. The refusal to trade for a male baby was a significant disgrace for the family. Consequently, her father moved his family to the United States of America where her mother instilled the importance of education in each of her daughters. She considers her father s decision to move the family to the United States of America as a significant event that shaped her life. She feels that she and her sisters are much more educated than cousins that eventually moved to the country later in their lives. Faith possesses a fascinating set of life experiences along with an intriguing Chinese culture that has influenced her character. • 5. An analysis of porters value chain To analyse the specific activities through which firms can gain a competitive advantage, it is useful to model the firm as a chain of value creating activities. For this purpose, Porter identified a range of interrelated generic activities common to a wide range of firms. The resulting model is known as the value chain. According to Porter (1985), Competitive Advantage arises out of the way firms organise and arrange discrete activities . Through using the Value Chain, the activities performed by a firm competing in a particular industry can be grouped into categories as shown in the model below: Upstream Activities Downstream Activities Porter distinguishes between primary activities and support activities. Primary activities are ... Show more content on Helpwriting.net ... As mentioned, gaining competitive advantage requires that a firm s value chain be managed as a system rather than a collection of separate parts. Reconfiguring the value chain by relocation, reordering or even eliminating certain activities can often lead to a major improvement in competitive position. Upstream and Downstream A firm s value chain links to the value chains of the upstream suppliers and downstream buyers. The result is a larger stream of activities known as the value system. The development of a firm specific competitive advantage not only depends on the firms value chain but also on the value system of which the firm is a part. In most industries, it is rather unusual that a single company performs all activities from product design, production of components, and final assembly to delivery to the final user by itself. Most often, organisations are elements of a value system or supply chain. Hence, value chain analysis should cover the whole value system in which the organization operates. Within the whole value system, there is only a certain value of profit margin available. This is the difference of the final price the customer pays and the sum of all costs incurred with the production and delivery of the product/service. It depends on the structure of the value system, how this margin spreads across the suppliers, producers, distributors, customers, and other elements of the value system. Each member of the system will use its ... Get more on HelpWriting.net ...

One in particular, Nathan Scott, known as the best basketball player in his High School, is known to be a popular jock type guy, selfish and rude. He wants to become the best basketball player and beat his dad, Dan Scott, one day. Throughout the show, Nathan Scott makes many different mistakes but he gets to know other characters that help him to grow from the person he once was. Even though he was once self conceited, he also starts to become a family centered person and someone who sacrifices for others. In the show, One Tree Hill, James Lafferty plays the character of Nathan Scott who has transformed throughout the show from personal experiences and influences of others, signifying his ability to distinguish between right and wrong, as Catholicism holds strong beliefs between the two. In the beginning, the character of Nathan Scott was a person who was rude and a bully. Nathan Scott is the head of his basketball team and he is also a popular person. Elke Van Damme and Sofie Van Bauwel says, Nathan is a typical example of a jock, whose clothes show the importance of basketball in his life even when he is not actively practicing the sport (Van Damme and Van Bauwel 26). • 8. The Federal Bureau Of Investigation After the terrorist attacks in San Bernardino, the United States government, specifically the Federal Bureau of Investigation was in a dispute with the technology company Apple. The FBI seized the iPhone of Syed Farook who along with his wife Tasfeen Malik killed 14 people and injured 22. Farook and his wife were then killed in a shootout with the police. However, the FBI could not bypass the security code that Farook placed on his phone, and access information within the device. Therefore, the bureau requested that Apple create a backdoor which is a mean of access to a computer program that bypasses the programs security measures. Apple refused to comply with the bureau s request as the company argued that it would jeopardize the privacy of their customers and is an overreach of state power. Thus, the conflict was going to be decided legally, until the FBI canceled the first court hearing with Apple. The FBI was able to unlock Farook s phone without Apple s help through a third party company. But the government s actions set in place a dangerous precedent. By creating a back door, the government is able to access information on any Apple device and has weakened the company s cyber security. To prevent further legal disputes, Congress and the president should create a modern law that can balance the interests of national security and privacy in the 21st century. • 9. Hills Like White Elephants Character Analysis How does the way people portray themselves reveal more about them and the life they live? Paying close attention to the emotions of a character and their actions can allow for more comprehension. The use of characterization within the story Hills Like White Elephants aids the reader to further understand the persona of an individual. In return, this allows the reader to understand them on a deeper level with a powerful connection. Without characterization, it would be difficult for the individual reading to form a bond with the man and the girl because they wouldn t truly understand what they re going through. In Hills Like White Elephants , by Ernest Hemingway, the American s dialogue, the way the girl converses and where their eyes wander give insight on how the man and the girl have communication difficulties. Throughout the story, it s made evident through dialogue that the man has a strong need to assert his dominance which damages his relationship with the girl. Firstly, the man appears to have total control within their relationship, even with uncomplicated factors. When they order drinks, the man says, Let s drink beer. , and he simply orders them following this statement. The girl can easily make this straightforward decision herself, but the man feels the need to take complete control. Also, when it comes to crucial life matters, the American still asserts his dominance. The need for the man to have control when it comes to important matters is seen when ... It was ordered in 1967 to advance the work of more seasoned specialists in view of capacity as opposed to age, avoid discrimination, and help take care of the issues that emerge with an aging workforce. The ADEA precludes a business from refusing to contract, firing, or for the most part discriminating against a delegate age at least 40 prepared, only on the start of age. Along these lines, a business can t deny a delegate pay or fringe benefits when the main support is age. Nor may a business portray delegates into gatherings of an age group in a way that outlandishly precludes workers from claiming work openings. For instance, ... Get more on HelpWriting.net ...

SCRUTINY OF CAUSATION AND REMOTENESS OF DAMAGES To avoid undue hardship to the defaulting party a line must be drawn separating damages resulting from his breach for which he should be liable and damages which, although in the broad sense of the word are as a result of his breach, are so remote to extent that he should not be liable for them. This line is drawn when separating General (intrinsic) damages from Special (extrinsic) damages. The courts insist that the damages should be direct rather than indirect. Direct damages are also known as general or intrinsic damages. They flow naturally and generally from the kind of breach of contract in question. Indirect damages are special or extrinsic damages, which are only recovered in special circumstances attending the conclusion of the contract. In Zimbabwe there is only one possible test that could be applied to decide whether special or extrinsic damages can be recovered for breach of contract. This test is the contemplation principle. The test applied under this principle is to check whether the contracting parties actually or presumptively foresaw that the breach of contract in question would result in the type of loss being sued for. • 12. The Pros And Cons Of Minority Voting Jacob Frazer Louis DeSipio Pol Sci 61A 20 November 2017 There are many difficulties minorities face when trying to take an active part in society, specifically voting. Since the Voting Rights Act of 1965 passed there have been many changes to the law to break the barriers between the minorities and non Hispanic whites, but there are still factors that discourage minority voters. Thesis: There are various factors widening the minority voting gap including voter identification, early voter registration requirements, and strict voting procedures. Some internal factors also include family voter participation and voting education. The first factor that leads to the widening of the minority gap is the requirement of voter identification. Since ... Show more content on Helpwriting.net ... The best way to fix this problem is to stop requiring photo ID at the polling booths which would allow anyone to go vote. There are ways to identify voter fraud instead of requiring a photo ID. Another major factor that hinders minority voters is early voter registration requirements. This means that if a voter wasn t registered to vote weeks or even months before an election, so if one were to go to vote and haven t registered, they would be turned away. Minorities are less likely to be registered and are unable to participate in elections if they develop interest in the weeks immediately before the election. People who move regularly (which disproportionately includes young adults and people who rent rather than own their own homes) are also more likely to fall out of registration by failing to reregister at their new address. (Shaw et. al. 2015: 281) By requiring registration weeks in advance, many voters won t be able to vote and have their voices heard. Another way institutions suppress minority voters is by maintaining the voter registration lists and purging nonparticipating voters. There is little to no regulation on how long it takes to be purged from the list, so those who voted only every four years only during the presidential election the list could have been purged the third year without voting, which would take them off the list and they would have to ... However, many consumers would likely view these other carrying methods as an advantage, especially if one is packing lots of stuff including chairs and umbrellas. 3. If Castiglione watched television today his least favorite genre would be completion shows. Importance Of Sprezzatura Castiglione thought that sprezzatura was important to show skill as an effortless talent. He highlights this point flat out by saying Practice in all things a certain sprezzatura [nonchalance], so as to conceal all art and make whatever is done or said appear to be without effort and almost without any thought about it (Bizzell Herzberg, 2001, p.661). Even if a person practiced for hours on end they should not let others know. Instead the skill should be presented as a natural talent. Theme Of Politics And The English Language By George Orwell George Orwell s 1946 essay, Politics and the English Language, brings forth themes of deception, honesty, and political bias through the eyes of the author himself. Orwell begins the narrative by refuting standard assumptions of the English Language, and that language is a reflection of the shape of society. Our civilization is decadent and our language so the argument runs must inevitably share in the general collapse (127). The essay s deeper concerns of how language is shifting and perhaps limiting expression are troubling yet serves as a reminder of Orwell s Newspeak in 1984. Orwell s extensive use of metaphors, similes, and imagery depict his growing concerns of contemporary writing styles. Orwell s introduction gives insight into his beliefs of the collapse of the English language through his distaste for meaningless words. Most people who bother with the matter at all would admit that the English language is in a bad way, but it is generally assumed that we cannot by conscious action do anything about it (127). This is an important yet difficult lesson to teach children in the digital age because they spend less time participating in face to face encounters and more time behind a screen. In fact children ages 8 18 spend approximately 7.5 hours using technology and social media (New Research, 2014). What makes this lesson so difficult is the fact that because children spend so much time behind a screen interacting with people, they spend less time reading people s emotions and seeing how their words affect other people. In fact, many adults struggle to come to this realization as well. Based on my own personal experience on social media, many adults still react to situations they come across online emotionally and do not necessarily think about what they are posting and how their words affect the people that are reading them. This is evident with the amount of arguments that occur mostly in the comment section on social media. In fact, social media is an excellent source of poor digital etiquette with all of the fights, swearing, and belittling of others that occurs on these platforms (Digital Etiquette, 2008). It will then explain the processes behind osmotic regulation and discuss the significance of the system, including how it can be affected by various conditions. Homeostasis refers to a series of processes that allow the body s internal environment to maintain stability despite a fluctuating external environment. This occurs in all living organisms in some way as it is necessary for life. Some of the factors affected by homeostasis are temperature, glucose levels, water levels, pH level and blood pressure, among many others. The reason homeostasis is necessary for life depends on the factor being affected. Usually (at least in the case of temperature and pH) the factors have an influence on how effective the enzymes in the body are. Enzymes are natural catalysts that speed up processes in the body that rely on chemical reactions. This includes respiration which allows us to generate energy. Enzymes work by having a part called the active site which carries out the enzyme s task. When an enzyme is exposed to temperatures that are too high the active site will become damaged and the enzyme will denature. However if they are too cold then the speed at which they are able to work will slow down. Because enzymes are responsible for so many important functions this means they need to be kept at the optimum environmental range, hence why ... Get more on HelpWriting.net ...
