PETITION
PETITIONERS by counsel, unto this Honorable Court, respectfully state:
1. Petitioner-spouses ERICSON TAGABI and EVANGELINA TAGABI
are both of legal age, Filipinos, married to each other, and residents of #2
Real St. Brgy. 1, Laoag City, Ilocos Norte at which address they may be
served with summons and other processes of this Honorable Court;
2. Petitioners herein desire to adopt minor MARIA LYNN DAVID
(hereinafter adoptee), aged 3 years old, who is the child of Jessica David
out of wedlock. A copy of the Birth Certificate of said minor to be
adopted is hereto attached as Annex “A”;
3. This Petition for Adoption is with the consent of the adoptee’s biological
parent JESSICA DAVID. A copy of the Affidavit of Consent is hereto
attached as Annex “B”. However, the father has abandoned the family
since February 2014 and has not given any support to the mother and
child;
4. The said adoptee has been under the care and custody of the petitioner
spouses since February 20, 2015 up to present.
5. Considering the fact that the adoptee has been under the care and custody
of petitioners, they have developed emotional attachment, love and
fondness to the herein adoptee;

6. Petitioners have all the qualifications and none of the disqualifications to
adopt pursuant to the provisions of Republic Act (RA) No. 8552,
otherwise known as the Domestic Adoption Act of 1998;
7. Petitioners are of legal age and more than sixteen (16) years older than
the adoptee as shown in the Certificate of Live Birth of petitioners
Ericson Tagabi and Evangelina Tagabi, a copy of which is hereto
attached as Annex “C” and Annex “D”, respectively;
8. Petitioners are in full possession of civil capacity and legal rights; are of
good moral character, and have not been convicted of any crime
involving moral turpitude. Copy of the NBI Clearance of petitioner
Ericson Tagabi is herewith attached as Annex “E” while copy of the
NBI Clearance petitioner Evangelina Tagabi is herewith attached as
Annex “F”;
9. Petitioners are in a position to financially and morally support and care
for the adoptee in keeping with means of their family;
10. Petitioners have undergone pre-adoption services as required under
Section 4 of RA No. 8552;
11. This adoption will serve the best interest and well-being of the minor
sought to be adopted
12. If the instant petition is granted by this Honorable Court, the adoptee is
to be known and registered as MARIA ANGELI TAGABI; and
13. The change of name being asked for by the petitioner-spouses is not
substantial, and will not cause any confusion since the adoptee will
continue using her first name which is MARIA. On the other hand, the
name ANGELI is intended to incorporate the name of petitioner
Evangeline. Furthermore, the adoptee has already become familiar with
the name MARIA ANGELI, as are petitioners who have become
accustomed to calling her by that name. Since the time that the adoptee
came to petitioners’ home, she has been habitually and continuously
called MARIA ANGELI, the name by which she is known to petitioners,
their immediate relatives and friends.

PRAYER
WHEREFORE, premises considered, it is respectfully prayed that this
Honorable Court, after due notice, publication and hearing, render judgment as
follows:
1. Declaring the minor MARIA LYNN DAVID as the child of the
petitioners by adoption for all legal intents and purposes with all
the rights, obligations and privileges of a legitimate child;
2. The name of the adoptee be changed from MARIA LYNN
DAVID to MARIA ANGELI TAGABI;
3. Declaring the petitioner-spouses as exempt from the trial custody
of the adoptee considering that the latter has been in the care and
custody of the former since February 20, 2015 continuously up to
the present, or for a period of over one year and seven months
now;
4. Ordering the City Civil Registrar of Laoag, Ilocos Norte to
annotate and enter this Decree of Adoption in the Local Civil
Registry Book and to amend the Certificate of Birth of said minor
MARIA LYNN TAGABI in accordance with this Decree of
Adoption.
Petitioners pray for such other reliefs and remedies that are just and equitable
under the premises.

1. We are the petitioners in the above-entitled case;
2. We caused the preparation and filing of the foregoing Petition;
3. We have read and understood the same and that the contents thereof are true and
correct to the best of our personal knowledge or based on authentic records;
4. We have not commenced another action or proceeding involving the same issues
and parties in any court, tribunal or agency and to the best of our knowledge, no
such other action or claim is pending therein;
5. If we should thereafter learn of any such pending action, we undertake to report
that fact within five (5) days therefrom to this Honorable Court.

Laoag City, after having been sworn to in accordance with law, hereby depose and

I am the biological mother of MARIA LYNN DAVID;
Spouses Ericson and Evangelina Tagabi filed a Petition for Adoption of my
child, Maria Lynn David;
I hereby freely and voluntarily give my consent to the adoption of Maria
Lynn David by the spouses Ericson and Evangelina Tagabi believing that the
proposed adoption will work for the greater welfare and benefit of the child Maria
Lynn David.
