Within these instruments, we can find the customs public warehouses, which facilitate the process of importing goods. This document presents a general overview of the most important aspects of the custom warehouses, the benefits that they represent to Companies, the different types deposits and a list of existing public warehouses registered before the Colombian Tax and Customs Authority (DIAN).

(Concept, benefits, types and main obligations)
PRESENTATION: 1. CONCEPT
Over the last ten years, the Colombian government has been
developing and implementing several policies on foreign trade

and services) in order to achieve greater benefits for economic
growth and development, such as Vallejo Plan, International Trade
Agreements and the Single Window for Foreign Trade (VUCE),
among others. Within these instruments, we can find the customs
public warehouses, which facilitate the process of importing goods.
This document presents a general overview of the most important
aspects of the custom warehouses, the benefits that they represent
to Companies, the different types deposits and a list of existing
public warehouses registered before the Colombian Tax and Customs
Authority (DIAN)
The customs warehouses are spaces in which it is allowed to store
merchandize whose import formalities have not yet been completed.
This scheme allows carrying out preparatory activities for the
distribution without paying custom duties, which include:
• Conditioning
• Handling
• Improvement of the
presentation.
• Assemble
• Package.
• Repackage.
• Classification.
• Marking.
• Repair or cleaning.
The custom warehouses offer the following benefits to companies:
• Provide an option for companies that require storing their products without
having to purchase or lease a property;
• Provide a service of conditioning goods for its commercialization;
• Facilitate the process of foreign trade procedures;
• Ensure the care of the goods during the time spent in the reservoir;
• Improve the cash flow of the company by allowing customs taxes to be
paid at the moment when the product is shipped to the final client.
The applicable legislation of custom warehouse is set out in Article 47 and
following of the Colombian Customs Statute.

There are several types of customs warehouses. Among them we can
distinguish the following:
2.1. Private custom warehouses
Private custom warehouses are places authorized by the tax and customs
authority -DIAN to store products belonging to a specific company that owns
the warehouse. The DIAN, at the beneficiary’s request, may authorize the
storage of the merchandize belonging to the subsidiaries of the company.
There are several types of private warehouses, such as:
• Private warehouses for transformation or assembly, used by the
automotive industry.
• Private warehouses for industrial processing.
• Private warehouses for international distribution.
This publication does not include a list of private custom warehouses.
2.2. Public warehouses
Public warehouses are places authorized by the DIAN to store products of
any foreign trade user, which may remain stored for a period of one (1)
month (extendable for another month) from the date of its arrival to the
national territory, while the import procedures are completed.
The merchandise stored in public deposits is not subject to the payment of
customs duties.
2. TYPES OF CUSTOM WAREHOUSES:
3. OBLIGATIONS OF THE WAREHOUSES:
There is a special type of public warehouse called “public warehouses
of international logistic support” (DALI), authorized in airports, ports and
docks for the storage of foreign goods which are subject to a process of
preservation, packaging and repair, among others. The product may be
maintained in this special warehouse for a period of one (1) year, from the
date of arrival of the goods into the country. In this guide you will find the
list of currently DALI available in the country.
The warehouses authorized by the DIAN must comply with the following
obligations:
• Receive, preserve and store only goods which can remain in their
enclosures;
• Receive, preserve and store the goods subject to the system of import,
export or transshipment mode;
• Register in the Customs informatics system the information related to
the reception of the cargo;
• Elaborate and send to the customs authority a report of inconsistencies
found between the information provided in the shipping declaration and
the goods received, or alterations in the document;
• Comply with the measures ordered by the customs authority to ensure
the compliance with customs regulations;
• Provide an adequate security and communications equipment according
to the regulations of the DIAN;

• Provide the necessary equipment for loading, unloading, weighing,
storing and preserving goods;
• Perform regular maintenance to the equipment for loading, unloading,
weighing, storing and preserving of the goods;
• Facilitate the control measures performed by the customs authority;
• Provide the necessary areas to undertake physical inspection of the
goods and other customs proceedings by the customs authority.
• Allow the physical examination of the merchandise by the Customs
Intermediation Companies.
• Have a clear identification of the following groups of merchandise: Those
that are in process of importation; in process of exportation; under the
modality of transshipment; apprehended; forfeited; or those that have
been authorized to rise, except in the case of bulk goods stored in silos
or in special tanks;
• Keep records of the entry and exit of goods in accordance to the
requirements and conditions indicated by the DIAN;
• Report any irregularities to the customs authorities and provide the
information requested as a consequence of such reports;
• Public and private warehouses must deliver the merchandise only to the
company when the DIAN has given the required authorization and the
custom duties have been paid.
• Hand over the goods that the customs authority orders;
• Store and guard the merchandize that has been abandoned, seized and/
or confiscated in their enclosures;
• Constitute the guarantees required by Law;
• Maintain or adjust the requirements and conditions under which the
authorization to operate the warehouse was granted.
Public warehouses liable for obligations arising from the deposit contract
and the applicable civil and commercial law.
