Essay on Eminent Domain
Eminent Domain
Eminent Domain is the inherent power of the state to take over a citizen's property for public use without the owner's consent. This is commonly done
when the acquisition of property is needed for the completion of a project. These projects can be for transportation such as highways or bridges or even
for buildings such as schools or government buildings. This excerpt states that ''The Fifth Amendment to the Constitution says 'nor shall private property
be taken for public use, without just compensation.' This is a tacit recognition of a preexisting power to take private property for public use, rather
than a grant of new power.''160 Eminent domain ''appertains to every independent government. It requires no ... Show more content on Helpwriting.net

To help the public, eminent domain may have to be put in to work to be used to build a highway in order to alleviate traffic problems or to build a
school to help out overcrowding at other schools. These are just some issues that may arise for the need of eminent domain in which the engineer
has to look out for and may help to further the growth of the city. There are issues that arise when the engineer is working for the developer who is
seizing property by eminent domain. The legal battle that may be going on at the time has an impact on the engineer since he has to work with the
schedule being presented while everything is being done to seize the property. The engineer might have to design for two or three different
scenarios depending on if they get the property or not and/or if the property they get has different dimensions than originally speculated. Also the
engineer might be involved in the eminent domain procedure by using his expertise to provide concrete evidence to why they need this land and
what for and also if its suitable or not for the project at hand. Also, the engineer might have to make calculations on whether it is more financially
beneficial to go ahead and try to look at other places to build or if taking over the land to build is a better financial plan. I think engineers should be
able to advocate for public entities for economic

Domain Name System Case Study
The United States government announced on March 14, 2014 that they had intentions to bring to an end their role in the supervision of the Domain
name system (Post, & Kehl, 2015). Known as the IANA transition it is of a grave importance in the chronicle of the worldwide grid and the rapport
among government control and network governance. The DNS to the Internet is certainly a notable business accomplishment, and its efficient
performance has been strategic to the stunning development of the Internet throughout the past twenty years. To ensure that the system operates
properly and to accomplish its objective of widespread name uniformity, the doings of millions of discrete domain operatives has to be coordinated by
some means. ... Show more content on Helpwriting.net ...
The changeover in 1998–1999, was a victory and those surfing the internet barely took notice when it occurred (Post, & Kehl, 2015).
In 2001, 2003, and 2006 ICANN and NTIA would move into an agreement towards the execution of the IANA functions. NTIA on July 2, 2012
gave ICANN a genuine reasonable procurement procedure, the current contract of IANA functions (Ntia.doc.gov, n.d). The indenture extends from
October 1, 2012 to September 30, 2015, and has option periods of two years if the two periods are put into practice the expiration for the agreement
will be on September 30, 2019 (Ntia.doc.gov, n.d.). ICANN, as the IANA functions operator executes organizational duties allied by means of the
registries that are linked to the three main IANA functions. It is a crucial receptacle for protocol number and name registries utilized in scores of
Internet procedures. ICANN upholds several of the numbers and codes within Internet proprieties. It organizes distributions of Internet procedures and
Autonomous System numbers to the Regional Internet Registries, and in turn, ISP is allocated the numbers along with others within their
geographical districts. Root zone file change requests are processed by ICANN for TLDs and a Root Zone WHOIS databank is available publicly with
recent and corroborated contact data for every TLD registry operator. ICANN, in all three cases, as the IANA functions operator,

Individual Property Rights vs Eminent Domain
These days there have been many issues surrounding the topic of private property and eminent domain. I feel that eminent domain is a good way to
keep the needs of the community and each person's individual property rights balanced. Even though I believe individual property rights are more
important that the needs of the community, I also believe the government sometimes has to take that property away for the better good of the
community. At the same time I also understand how people feel when they talk about "NIMBY" (not in my back yard), and also about their personal
needs.
Let me take you back into the history of the American land. After the18th century, Americans turned their backs ... Show more content on

This compensation was not seen in the case with the English and the Indians. These public uses have normally been railroads, highways, bridges, parks

land from being taken away to build malls, casino's and factories. This is one of the many examples of the abuse of eminent domain.
This is where NIMBY is introduced. NIMBY, which stands for "not in my backyard" is used to 1. "Express opposition by local citizens to the
locating in their neighborhood of a civic project." Some examples of these "civic projects" are: a jail, garbage dump, drug rehabilitation center, or
anything that the community considers unsightly, dangerous and likely to lead to property values decreasing. From this is how they derived the
compensation and eminent domain laws.
It is strange how they come up with these laws to compensate you after they have taken your land. This is where we come to the development of the
property law. How did the protection of your private property come about? Protection and content are given to the ownership of property by custom
or law. The type of property law in a society may be taken as an index of its social and economic system. Even though there is a difference between

Research Paper Outline & Thesis: Eminent Domain
Some people simply are not prepared for the new neighbors moving into America: the abuses of eminent domain. Although it has been around a great
deal of time, eminent domain is unjustly taking land from the American people at an alarming rate. Eminent domain really is defined as being the
government power exercised to purchase land or property from the people in order to develop the land or property for economic or community
expansion. This topic is of importance to me and the general audience as it directly confronts rights of the citizenry, which I believe we all are
concerned about. Really, powers are given and they can be taken away; eminent domain is up for grabs and only one thing must ... Show more content

In addition, societal welfare can at times be undervalued in a case such as this where lives are so easily seen as commodities and this is the best time
to address it. This idea is supported by the Framer's who recognized the governments have this duty to correct for inequalities that occur naturally and
in the market. In fact, this is just one of the facts explored by Elizabeth F. Gallagher of the Fordham Law Review in her publication titled Breaking
New Ground: Using Eminent Domain for Economic Development.
Reliance on the political process to safeguard private property rights is consistent with the original intent of the drafters of the Fifth Amendment. The
words 'public use' may never have been intended to be an absolute limit on eminent domain power at all. Rather, the words described when
compensation was required – when property taken by eminent domain is put to public use. The Takings Clause does not leave property owners without
any protection against abuses of eminent domain (Gallagher). Gallagher continues with her arguments but one significantly standing out is that
eminent domain may be the only way redevelopment can occur because in order to redevelop, investors must acquire large parcels of land and a single
landowner can thwart all efforts. Redevelopment brings jobs, increases the tax revenue, and this benefits the most needy with better schools and housing

Eminent Domain : Zoning And Land Use
Eminent Domain – Zoning and Land Use
Missouri concept and process of eminent domain Eminent domain is where the government has the power to take a private property and convert that
into a public property, but the government can only exercise this power if they provide the just amount of compensation to those property owners. This
is the main concept however each state has its own laws. In Missouri it's now a little stricter when they revised their laws in 2006 to make it more
balanced to protect the private property rights of an owner and as well as the need for cities to eliminate the blight conditions. The term "public use"
differs between states for what a government can take and use for public use purposes. In the state of Missouri the term "public use" can be taking
land to build public roads, to taking land for use by private railroad companies, and to taking land to build private businesses to spur the economic
growth (Missouri law review 1). The government can only use eminent domain where there are blight conditions, which in Missouri; blight is property
which constitutes an economic or social liability or menace to public health, safety, morals, or welfare in its present condition and use (Law of
Missouri 2). Most states have the just compensation towards the private property owners as giving them compensation that is market value for their
property. Missouri generally appoints three commissioners to report of any damages that the owner suffers as a result of the

Eminent Domain is the actual inherent power of the government to take over a citizens' property for public use without the owner's consent. This was
initially a part of public policy that originated in the middle ages throughout the world. It was adopted by into British Common law before reaching the
Americas where it was then established into the U.S. Constitution in 1791 called the Due Process Clause of the Fifth Amendment. This grants the
federal government the right to exercise eminent domain, provided protect to citizens, and protect the property rights of citizens. Shortly after the Just
Compensation Clause of the Fifth Amendment was introduced making the federal guarantee of "just compensation" applicable to the states. Property

Also, state and local governments are required to pay just compensation for property they take under the power of eminent domain. The use of eminent
domain power is used to promote economic development, especially in urban area of the United States leaving this to be a very controversial topic
even in present day. In most circumstances when eminent domain used for the public good projects intended for the good such as highways, bridges,
schools, and even government buildings. This policy pertain to every federal, state, local governments and it does not require very much constitutional
recognition and is usually considered an attribute to the sovereign law makers in power. There have been many cases that have been brought up against
the government in an attempt to regulate the power of the governments use to seize private property. Such a political push to reform eminent domain

On the performance and analysis of DNS security extensions The domain naming server plays a vital role in the internet as it is needed and is
involved in every internet application. DNS now works well and it is also sometimes mentioned that any new changes added to the present DNS may
contribute to interruption to its functionality and can also contribute towards additional complexity which is undesirable. Current networks and the
future networks relay essentially on DNS and it is important that the DNS should be a secured one. The DNS can be easily attacked and such an
attack can cause dire consequences so it specifies the importance to use a secured version of DNS to avoid such consequences. To employ such a
version involves more cost.... Show more content on Helpwriting.net ...
Cost for increasing security to DNS varies depending on the kind of name server used. When the data is static then PK–DNSSEC is suitable and when
the data is dynamic, better option would be to consider SK–DNSSEC. Caching resolvers computational cost is large in PK–DNSSEC and
non–recursive servers computational cost is high in SK–DNSSEC [2]. Hybrid approach is used to eliminate these computational costs. SK–DNSEC
cryptographic core contributes less to the total cost in producing symmetric certificates and thus a better performing efficient and fast cryptographic
core can be used to improve the performance. If a new resolver is added or when existing root certificate becomes invalid then public key cryptography
is used by the SK–DNS. In these cases root server can take care of the load caused by valid requests whereas the root server enabled with
SK–DNSSEC is sensitive to reject of service attack. Security and performance both can be achieved by using hybrid approach. It can be used with
PK–DNSSEC for the top level domain of DNS tree and for SK–DNSSEC for lower level domain of DNS tree. Size of the response packets of DNS are
increased by producing higher network traffic and latency in PK–DNSSEC. SK–DNSSEC is considered to be a possible alternative for PK–DNSSEC
for few of the important reasons like key management is made easy with SK–DNSSEC, smaller response packets which require small memory for
caching. [1]

Pros And Cons Of Eminent Domain
Proponents of eminent domain point to the potential use of eminent domain as a component of urban renewal projects. They view eminent domain as a
tool that can be used as part of urban renewal to help revitalize the economy of depressed areas by creating new jobs, building infrastructure, remedying
unsafe conditions and housing, and improving the overall economic well–being of an area. For example, the construction of Minute Maid Park (a
baseball stadium in Houston, Texas) "brings millions of people every year into downtown Houston, a place that had previously been a long way from
being a lively 24/7 environment...Around the ballpark, developers have created loft dwellings for young professionals, old buildings have been
transformed into hotels, and a new high–rise residential tower is under development" (Lewis). Proponents assert that the societal gains that occur from
these projects are a fair tradeoff for individual's relocation and loss of property. Eminent domain expert David Lewis points out that using eminent
domain enjoys strong public support when used in projects such as constructing dams in ... Show more content on Helpwriting.net ...
When evaluating urban renewal projects, Professor Steven Cord found that "By far most of the housing destroyed was low cost housing," (184).
The statistics in Kelo also showed that 56 percent of nonwhites and 38 percent of whites displaced by urban renewal were qualified to receive public
housing due to their low incomes. Further, the destruction of housing forces individuals to seek relocation housing. Relocation housing is not
guaranteed to be readily available or to be superior to the housing destroyed (Cord 185). Eminent domain has broken up neighborhoods and forced out
longtime residents (Cord 184). Businesses that are relocated often lose their customer base and often must pay higher rents (Cord 185). Nearly a third
of relocated businesses never reopen at all (Cord

Expansion of domain name for the benefit of users and companies as proposed by Internet Corporation for Assigned Names and Numbers (ICANN)
has many major flaws. According to Association of National Advertisers:ICANN's proposed program for increasing competition, promoting, innovation,
addressing an alleged shortage of Internet addresses and helping differentiate products and services – is deeply flawed. (Association of National
Advisers , 2011). The justification to expand the domain name, that new gTLDs would facilitate customer search, promotes consumer welfare, even
though the registration cost for a new domain is excessively high and would harm the brand name is flawed. The expansion of domain name will open
internet for criminal activity where felons can cyber squat in the name of trusted brands. Objections raised by stakeholders had not been addressed
adequately and the decision is mostly influenced by the parties getting directly benefits from this program and not those going to get affected. Since
beginning ICANN is proposing introduction of new gTLDs without completing the comprehensive economic study of the domain name registration
market and, without having a completely developed understanding of the economic realities of the domain marketplace. Thus, various communities are
raising concerns for introduction of new gTLDs. (Association of National

Would you be okay with the government taking your house and relocating you even if it meant that you got compensated for the sacrifice you are

have never seen it in action will not fully understand how it truly works. Here is an example to help clarify. A highway is being made through a
portion of a town and one person or family is refusing to sell their land/home. Eminent domain gives the government the right to forcibly remove the
owner and cease their land even if the land owner doesn't agree to it. The government then will, even in this case, provide compensation for the land

New York City 1978 and Kelo vs. City of New London. In the Penn Central vs. New York City 1978 Penn Central Transportation Company wanted to
construct a very tall office tower above its already existing railroad station and smaller office building, known as Grand Central Terminal. The
Commission ruled that Penn Central could not go through with the project because the new development would change the existing landmark way too
much. Penn Central sued in court, saying that the city's regulation of landmarks amounted to an Eminent Domain Clause "taking" of their private
property rights. They said if the city was allowed to regulate them in this way, they should be compensated according to the 5th Amendment Eminent

could seize land, through the use of the Eminent Domain Clause, private homes that were in good condition, and transfer them to another private
property developer, for a local economic development project. The home owners then sued the city, claiming that the only reason for taking their land
was not for "public use," as required by the Eminent Domain Clause, but rather for private use

When Should Eminent Domain be Used?
When should a city or state use their eminent domain powers? Over the past few years there have been a couple of cases that raised the questions of
when eminent domain should be used. One of the most controversial cases in the history of the United States was the Kelo v New
London Supreme Court ruling. In order to generate tax revenue, add jobs, and to prevent bankruptcy, the government's right to initiate eminent domain
for public good is a necessary evil.
Eminent domain in definition is "the right or power of public purposes without the owner's consent on payment of just compensation" ("Eminent

Which would cause the city to grow and that would provide more money to the government with the increased tax revenue from all of the new
families. This could create more jobs, because more companies might be interested in locating there due to all of the growth. Eminent domain should
also be used by a city or state if it prevents it from going bankrupt.
A city or state should use eminent domain if it prevents it from going bankrupt. If a city is near bankrupt then it cannot provide all of the necessary
items that a city needs in order to run like it is supposed to. For example, if a city is short of funds then it would have to reduce its budget in places
that would harm the city. It would have to cut money from the police, and fire departments. However, by using their eminent domain powers a city
could keep all of this from happening by letting a business come that would create thousands in tax dollars, and add jobs to the city. This means that a
reduction in the police and fire departments would not happen and the city would still run smoothly.
The cities and states that use eminent domain to acquire land in order to keep themselves running smoothly is sad; however, these cities and states
are looking out for what is best for their areas. These cities and states are not trying to make families move out of their homes in order to earn a quick
dollar. These cities and states are only

The Benefits Of Imminent Domain
America is renowned for the honorable rights that she gives her people and it is commonplace to hear her referred to as "the land of the free". The
United States Supreme Court, however, has recently decided to take this land away from the free in a daft decision that gave the government the power
to demolish family homes in the name of "public use" under the Constitution's Fifth Amendment. This decision should not have been made and has
rightfully angered citizens across the country.
The act of eminent domain has traditionally been interpreted as a way to build public roads, schools, and courthouses. Local governments, however,
have been invoking these two words for far less principled reasons such as building new shopping malls or new more

The Domain Name Management Industry
Introduction
The domain name management industry deals with domain name registry, transfer and management. Domain name is unique address within the
internet network, similar to a physical address in real world. Some of the example of domain name are: google.com, apple.com or amazon.com.
The domain name management industry has thrived over last few years. Companies across the globe are increasing their online presence, coupled
with individuals' desire to establish personal web space (Panteva, 3013). Now a day's online presence is critical for business expansion and their
branding. NAICS code of companies involved in sale of domain name management is 541511 (Custom computer programming servers) (Panteva,
3013). Total revenue of the United States industry is expected to reach to 3.3 billion by the year end of 2013. Annual growth of the industry from
year 2008 to 2013 was 2.9 percent (Panteva, 3013). During next five years (from 2013 to 2018), it is projected to grow at the rate of 6.2 percent
(Panteva, 3013). Out of seventeen top level domains (YLDs), ICANN has accredited 1543 registrars in one or more TLDs (ICANN, 2015).
More than 650 new gTLDs are delegated. This will create lot more opportunity in domain name management industry. Industry is in growth life cycle
state. But competition among existing players is too high due to large number of registrars. For example, GoDaddy charges only $ 0.99 cents for new

Eminent Domain Should Be Used For The Good Of Mankind Essay
Imagine getting a visitor at your front door, and the visitor offers you a very generous amount of money for them to take you property for public use.
For some people it is the property they grew up on, and for others it is the property that has been passed down through family generations. That is what
happens when private property owners experience eminent domain. Eminent domain can be a wonderful thing for big companies and powerful
leaders. On the other hand, people lose their homes, or perhaps their farmland. Those who offer eminent domain often have big plans that can benefit
a community, but the huge loss here is people losing their homes. Most companies will only enforce eminent domain if they have no other choice.
Other companies do it purely for themselves. Eminent domain should be used for the good of mankind, because it has the power to put some good
places in this world if done correctly. Doing some research on eminent domain I came across the April 2010 issue of the Yale Law Journal. One of the
notes in that issue mentioned the history of eminent domain, and it was called "Eminent domain due process" by Zachary Hudson. Hudson talks about
how after eminent domain was founded; it was argued that it the power of eminent domain was or was not in the Constitution. Hudson says that
"Congress did not pass a statute authorizing the use of eminent domain more generally until 1867 when it did so to aid in the development of national
cemeteries following the civil war"

This may seem controversial as some people may not be able to understand how public parks benefit anyone. Public parks may seem purely aesthetic
and ornamental, adding no true value to society, therefore some would argue that the government has no justification for taking their property.
Eminent Domain was even used in World War II; "During World War II, the Lands Division oversaw the acquisition of more than 20 million acres of
land. Property was transformed into airports and naval stations , war materials manufacturing and storage , proving grounds, and a number of other

In a podcast on his church and Eminent Domain, "a New York church's founder, Reverend Fred Jenkins, says the town of North Hempstead in 1998
exercised eminent domain and took the sanctuary as part of plans for a shopping and housing complex. Jenkins says that was a blow to his
congregation." Why does one church even matter? Are the shopping and housing complex not going to directly benefit the public as people shop or
look for residences? Jenkins thinks otherwise, explaining, "We'd been feeding people that were hungry and paying for their lights when their lights was
out and buying Pampers for their kids when their babies was in need. If you put an apartment building there, nobody in that apartment building would
do the same thing for the people that the church will do." The church not only represents an institution of faith and prayer; it represents a home that
people can turn to in times of struggle. Which should be more supported: the close–knit feeling of community that the church provides, or the economic
profit by way of a mall and apartment building? Can or should religious liberty ever be sacrificed for economic redevelopment? As Mr. JOHN
MAUCK (Attorney to Jenkins) puts it, "The ability to have a place to assemble, to come together, is integral to almost every faith. It's fine to say you

Eminent Domain Purposes
1.When does a taking occur for eminent domain purposes? Refer to the Lucas case. Eminent domain refers to the inherent power of the state to take
or seize the private property of its individual citizens. Property taken through eminent domain is mainly set aside for the development of public
utilities or assigned to a third party who is then supposed to use it for the general good of the public (Larson, 2004).
There are generally four types of takings employed by the state through eminent domain. These are:
a.Complete Taking – This is where the state seizes an entire property in for public use. In the case of Lucas v. South Carolina Coastal Council (1992),
the plaintiff was entitled to compensation as a result of the complete taking of his land. However the Supreme Court denied him any compensation
stating that the restriction imposed on the use of the land was in the interest of the general public due to the intended use of the land. Therefore the
Takings Clause does not apply in this case in spite of the economic benefits lost incurred as a result of the complete taking of his property.
b.Partial Taking – The state in this case takes a portion of a particular property mainly for the expansion of the existing utilities. The owner of the
property is liable for compensation in regard to the piece of land seized and any resulting decline in the value of the remaining property.
c.Temporary Taking–The government may require a piece of land to be used as a site when

Pros And Cons Of Exercise Eminent Domain
Although eminent domain is sometimes necessary, there should be limits placed on it to ensure that individual property rights are never trampled on.
This essay will explain at what times government officials should have the right to exercise eminent domain, the extent of which the current occupant
should be satisfactorily compensated, and an engineer's duty to the public to only accept projects where the previous property owners are content in the
arrangements of their dismissal.
The government should exercise eminent domain cautiously to ensure that individual property rights are seldom taken away. In 2005, the ruling of Kelo
v. City of New London "allowed state and local governments to take private property and transfer it to other private owners to promote 'economic
development'" (Somin 1). The promotion of economic development, however, is not sound reasoning to transfer private property from one private
owner to the next. The only instance when this may be acceptable is when the property in mention is no longer in use. Some examples include ... Show

Essay on New London Eminent Domain
Justice Stevens believes that is it the right of the government for taking land from private owners under eminent domain and using that land for public
use. Steven believes that eminent domain is constitutional as long as the public welfare is increased such as increasing tax and other revenues and
stimulating a troubled city. New London was an economically insufficient city compared to the averages in Connecticut. He believed that making the
city more attractive was making good use of the Takings Clause in the U.S. Constitution. He also thinks that the city carefully constructed a plan in
order to benefit the community rather than hinder it. Overall, Stevens believes that by helping and benefiting the city New London should follow their...

The authors of these majority and minority opinions are quite different. Steven believes that making a city more attractive and profitable is worth using
eminent domain while O'Connor believes that it makes every home and business be put in jeopardy for an unnecessary use of overused power.
Although both agree that in some instances eminent domain is appropriate, they disagree on this particular case of the New London
community. Before I began to read this case I made my own assumptions about eminent domain. Although I believe that it is not alright for eminent
domain to be applied to all cases, I do believe that eminent domain is necessary in this case. The city was very apparently deteriorating and it is
part of the cities job to make the community appealing again. Like it was stated, the population has not been as low as 24,000 residents since 1920.
That was over 50 years ago. I may not always agree with using eminent domain in all instances but to make a city more profitable and more appealing
to residents seems to me like a good use of property. Just compensation is something I may have a problem with. From what I have heard, the

Introduction
Question: Is the policy of eminent domain providing for the public welfare, through the taking of privately owned property, using a rightful procedure
involving due process and just compensation as it was intended to do when the policy was founded?
Eminent domain is the inherent power of the government to take over a citizen's property for public use without the owner's consent. Initially, this
public policy originated in the Middle Ages throughout the world. It became part of the British common law before reaching the United States where it
was then illustrated in the US Constitution in 1791 (Britannica: eminent domain). The Fifth Amendment granted the federal government the right ...

The constitution puts it out clear that the person whose private property has been seized for public use is entitled to just compensation, which is a
fair current cash market value of the property in question. This is quoted to be the price that a willing buyer would give and a willing seller would
accept for the property. This is why it is referred to as the fair price because it was where the buyer and seller would reach at a consensus. Eminent
Domain has affected very many people across all the counties in the United States of America each and every year. One such instance is that which
occurred in 2002 in Long Beach, NJ. At this time, the government promised a number of redevelopment projects in efforts to try and improve the
lakeside community. Uncountable number of locals, even the lifelong residents who knew long beach as their home fell victims of eviction. This was
done with false promises from the government that there was an oncoming improvement in the financial environment and the improvement of the
general aesthetic value of the town. Instead, a massive block of several up market shops sprouted that the locals never came to realizing their dreams
of reaping direct benefits from the projects. Instead, it was the

Eminent Domain is the government's right under the Fifth Amendment to acquire privately owned property for public use – to build a road, a school
or a courthouse. Under eminent domain, the government buys your property, paying you what's determined to be fair market value. In recent years,
there has been much debate over the appropriateness of eminent domain, and further its legality in specific instances. The government is allowed to
seize personal property for private use if they can prove that doing it will serve what's called "the public good". There have been many cases brought up
against the government in attempt to regulate the government's power in seizing private property. There is a political push for reform to the eminent ...

ft for homes in a specific neighborhood. In an area with older houses, many of these qualifications may not be met, which would in turn classify certain
houses as blighted. This does not imply that the homeowners have failed to maintain there property properly, but infers that the area can be used for a
higher and better use.
Amongst topics of conversation regarding eminent domain, one will find regulatory usage of land, seizing of land for public use, and the most
controversial of late, the seizing of land from a private owner and giving it to a more economically beneficial, often politically connected private
owner. Kelo v New London (US 2005), has prompted dozens of proposals to reform eminent domain practices legislatively. Most of these proposals
would restrict the use of eminent domain to transfer property from one private individual to another. It is one thing to have a city claim property to
further the development of the city by building roads, schools, etc. It is another thing altogether for the government to seize a property so as to gain
money from higher taxation. For many years, however, courts have read the public–use restraint broadly, enabling governments to take property from
one owner, often small and powerless, and transfer it to another, often large and politically connected, all in the name of economic development, urban
renewal, or job creation.
With the media's focus on cases like Kelo v New London, the public is

Essay On Domain Name Search
CAN I GET A DOMAIN?
The first thing that comes to mind when you start a business is to secure a domain name, which establishes a unique identity online. But, you go online
to buy one and discover your domain name is not available.
The next step is to tweak or find related names by adding hyphens (–), underscore (_). Domain name search often leads to confusion because domain
names are not case–sensitive and some names can be misrepresented if there is a space, punctuation or capitalization. Example, a therapist with a room
that chose therapistroom.com as an online presence can be misread as the rapist room, Who Represents, a database of celebrities, Agents,
Representatives and Agencies chose whorepresents.com which can be misread as whore ... Show more content on Helpwriting.net ...
When buying or registering a domain name, make sure you are the domain owner or administrative contact, that is, registered under your name or
company; If possible, add a current phone number, a designated email address (such as contact@domain.com just to avoid spammers) and a
physical address or a P.O. Box. This makes it easier for users to verify your credibility with an offline presence. There are several ways to verify a
domain, but the fastest way is whois.net. Also, be careful when choosing an expired domain name. Some are affected by copyright or trademark
infringement, some have a history of bad representation or ban from Google searches for violating a Google term.
After buying a domain name, what next? Domain in simple term is a plot of land. When you secure a domain name, you secure a digital plot of land
on the internet. That security comes with an identification label to prove ownership or control. That ownership acquired from a Domain name
Registrar (such as godaddy.com, domains.google.com) does not confer outright ownership or legal ownership of the domain, but only an exclusive
right of use for a particular period of time (usually for 1 year, 2 years, 5 years or 10 years). After securing a domain name, you have to host it.
Hosting is to build a house on your digital plot of land. Without hosting or host name, you cannot build and without a domain, you cannot host.

Eminent Domain Case Analysis
This seems to be the fundamental issue underlying the paper: a pernicious sense of what is valuable. Multiple times, the paper asserts that the be–all,
end–all metric of value ought to be economic value, specifically the value derived from synergistic arrangements of real property. But viewing a
situation through this lens dehumanizes the situation. It leads to situations where we can, with a straight face, describe human settlement as clutter to
be disposed of. Indeed, alternative metrics of value exist which add nuance to the situation. Sentimental or cultural value, for example, may be entirely
at odds with economic value. Were a city to grow and encompass sacred Native American land, would it not be fair to consider such interests alongside
those of the capital class? What about a family with ancestors... Show more content on Helpwriting.net ...
One of the crucial assumptions underlying the paper's analysis is that a redevelopment effort will necessarily create positive economic value. But
what if it does not? Kelo serves as a perfect example. What was supposed to be a profitable facility is currently an empty lot collecting storm debris.
At least with eminent domain, voters have some form of cathartic recourse. They can vote out the individuals who made the decision to condemn their
homes for an ultimately disastrous product. In a callable fee or floating fee situation, voters have little ability to seek redress, instead nurturing feelings
of political disenfranchisement and anti–establishment resentment. Further, the threat of losing their seats incentivizes politicians to carefully examine
any proposed development and only exercise their power when reasonably sure of its success, minimizing potential mishaps. Thus, voters are both
empowered and incentives are put in place to encourage careful decision–making concerning development

In the eminent domain hypothetical, my town has been outsourcing most of the manufacturing to cheaper overseas labor markets in China and India.
There has been an increased demand for revenue for police, fire, schools, and other essential infrastructure. Because of the high unemployment rate in
the town, young people are not returning after finishing college. This had led to a downward economical spiral. There is a small Indian reservation on
the outside of town. The state laws now permit full Las Vegas–style gambling but only on Indian reservations. The town council requests my position

farmers and give to the local Indian tribe for gambling will result in decreased unemployment rates and increased revenue. While the farmers may suffer
with a sentimental loss of their families' land, they will be compensated for the cost. With weighing the costs to the farmers against the benefits to the
town and community as a whole, it is in the best interest to exercise eminent domain. Society will benefit from the increased revenue and decreased
unemployment rates. As the unemployment rate decreases, the amount of unemployment pay decreases. New opportunities will entice the younger
generation to finish college and return home to pursue their careers. The schools receiving more funding and revenue will continue to operate and be

It is a well–known fact that the government makes laws that benefit it, and sometimes to the detriment of the average citizen. Take, for example, the
tax laws. You would be hard pressed to find a taxpayer who believes that paying taxes is fair. In fact most people would complain that they pay taxes
all year by having an amount held out from their check, only to owe additional monies every April 15. This form of governmental taking is probably
the most popular, but there are other actions that result in a private citizen losing their property to a governmental agency. However not every instance

The Optical-Time Domain Reflectometer
The OTDR is a device that measures distances to a reflection surface by measuring the time it takes for a lightwave pulse to reflect from the surface.
Reflection surfaces include the ends of fiber cables, breaks in the fiber, splice locations, and connector locations. The ability to provide these
measurements simplifies the fault location procedure for fiber systems.
The OTDR measures the scattered and reflected light returning from a pulse of transmitted light. Pulses of light are generated from the OTDR, and
reflected light is displayed on the oscilloscope portion of the OTDR. Knowing the time delay of the reflected light pulse and knowing the speed light
travels in the fiber determines the distance to the discontinuity of the fiber. Discontinuities or impedance changes of the fiber cable reflect light back to
the OTDR. It is important to know the index of refraction of the fiber core to accurately determine distance. This setting must be correctly set on the
OTDR. Keep in mind that power level is displayed on vertical axis, and distance is displayed on the horizontal axis of the screen. Abrupt changes in
reflected power can represent fiber "open" conditions. The OTDR will display small losses from couplers and connectors.
The accuracy of the OTDR can be in the order of .01 dB splice seen more than 40 km (25 miles) away to within 1 meter of the problem. Loss
performance of new installations is usually recorded on floppy disks and/or hard copy printouts for future

The land owners and others in the Nebraska and other states feel differently on the position of eminent domain for the building of pipelines. I would
have to agree that decisions and positions of the past should not be used to blindly decide on the future. Within the court cases by private land owners,

the methods for obtaining eminent domain condemnation. The ruling stated that the law divested the state's public utilities commission of their

The Domains Of It Infrastructure
In this paper we will discuss some cases within the Seven Domains of IT infrastructure in which some bad things that could happen. Most cases are
within the possibility of reality while some are very far out there and most likely would not happen. This is based on a Kansas Marketing Firm. The
first domain is the user domain. The most logical thing that could go wrong is that an employee could and most likely will at some point, forget security
policies and accidentally exposed the networks to malicious files or code. This is done by uploading something off a foreign data transfer device
such as a flash drive. This could cause problems with the entire system if the malicious program is a virus. A more non logical problem would be if
a disgruntled employee purposely tries to take down the system or steals information that is considered sensitive. While this happens it is less logical
than accidently exposure. The worst thing that could happen is that the malicious code wipes out your servers, removes all data and causes massive
production loss and most likely a loss of profit. This is countered with strong policies and physical security to derail these problems. The second
domain is the workstation domain. The threats to this would be similar to the first domain because if a user does something malicious on that
workstation, it would affect a larger area of the domain. Another problem is that workstations run programs that are susceptible to bugs and crashes. If

Jason Swartwood Wisdom
Wisdom is a bit of an elusive topic. There seems to be a general consensus of what counts as wisdom, however, when asked for a definition 'acting
with regards to knowledge and understanding' is commonly used. While this definition is certainly workable, it does not go very deep into this vast
concept. How exactly do knowledge and understanding interact to reach the level of wisdom? There is not a whole lot of work done analyzing the
process of acting wisely. One such attempt is made by Jason Swartwood, who claims that wisdom can be thought of as an expert skill. He claims that
wisdom is the same kind of epistemic achievement as expert decision–making. This approach to wisdom allows for interesting insight into this topic
and can begin to look ... Show more content on Helpwriting.net ...
One of the more pressing questions is the ability to identify wisdom. Identifying wisdom is something that is fairly common among people even
without such in depth knowledge. Along the lines of identifying wisdom, how do heuristics play into this discussion? Heuristics are any sort of
approach to solving a problem that is sufficient in achieving immediate goals. Typically when applied to games, they are approaches at playing in
the most optimal fashion in the widest variety of scenarios. One of the great things about heuristics is that it is not always necessary for these
heuristics to be developed by an individual and can be passed to people who may be very new to these situations or scenarios. Someone fairly new to
the game of chess could be given a set of heuristics with which to play by such that they could fair very well in the tournament. There are a couple
main components to the notion of heuristics, which could cause interesting cases under Swartwood's account for wisdom. This beginning chess player
could very well appear to be acting wisely in this tournament, but would they actually acting wisely? The first aspect of heuristics is their ability to
achieve short–term goals. Now the part of Swartwood's argument that this would focus on is the domain in which his argument is concerned and the
ability to grasp success reasons to perform an

Eminent Domain Of Economic Development
According to Bowman and Kearney, economic development is the "process by which a community, state, or nation increases its level of per capita
income, high–quality jobs, and capital investment (Bowman & Kearney, 2014, p. 370). Throughout our readings, it is presented that economic
development exists because of the gradual decline of our metropolitans. More recently, it's been explained that economic development has become a
local issue that localities are attempting to resolve due to the stale mate federal government and partly the Great Recession, and doing this with a
deteriorating tax base in the form of population and jobs which increase the deteriorating infrastructure.

that 27 had no measurable economic impact, and in 3 cases, economic activity actually decreased. These findings have been repeated since then and tell

Analysis Of Disney Company 's Recreation Of Public Domain...
Once upon a time there were gripping tales shared between generation to generation and continuously passed down. The listener 's focus was on the
story's message and not its possible profit allowed those listeners to live happily ever after. Storytelling began long ago traditionally told orally before
there was a shift to written stories and eventually as technology developed became a digital market. Some of the most famous digitalized tales are fairy
tales. Previous to digital development, copyright laws on fairy tales were slim because there was less concern over copying. This is also how the story's
focus was more on the message and its creative development than the potential profit. The Walt Disney company's recreation of public domain fairy
tales demonstraights how copyright laws have hindered artistic creativitity within America.
The Walt Disney company, is a beloved as well as infamous company worldwide also notoriously known for their strict copyright laws. Original
American copyright laws stated artistic works were protected for 28 years and these laws were eventfully extended to a 56–year time frame. The term
continues to increase with the present law set at 75 years. Large companies like Disney continue to fight for stricter and longer laws because of the
revenue they will continue to bring it. (Washington post). One apparent problem from the extensions is public lacks the ability to build on Disney
stories since they are not in public domain. In the 1997 report

Effective Domain
Affective domain is the only domain that does not reflect what we teach our students as in specific skills or knowledge, but more of how the students
use the information that we have given them, and then add in an emotional component. Not all students come from a caring, loving or compassionate
back ground or family life, so the classroom may be the place to start the learning of respect, positive attitude and values necessary for a successful
medical professional. The affective domain learning brings the lesson into an active student centered learning environment where emotions can be a
highly motivating tool. Bloom's Taxonomy disseminates the affective domain into five learning levels; receiving, responding, valuing, organizing, and
characterizing. Although cognitive in nature, the first or basic level is simply receiving the information, whether done by hearing, seeing or reading.
Three additional levels brings the student to the final level of characterizing, which is considered mastering the domain. Characterization is obtained
when the student's behavior pattern has inscribed the values they have learned, allowing these values to enhanced their patient care. ... Show more

Statistical Weather Prediction And Regional Climate...
One–way nested Limited–Area Models (LAMs) are used in numerical weather prediction and regional climate modelling to downscale
coarse–resolution global/regional simulations or analyses that are provided as the time–evolving Lateral Boundary Conditions (LBC). The LAM
integrations are sensitively dependent on infinitesimally small modifications. The so–called twin simulations, i.e., LAM integrations identical in all
respect, except having slightly different initial conditions, may with time lead to substantially different solutions. This phenomenon has been referred
to as internal variability (IV) in the existing literature [e.g., Giorgi and Bi, 2000; Christensen et al., 2001; Rinke et al., 2004; Lucas–Picher et al.,
2008a; CrГ©tat et al., 2011; Done et al., 2014].
Internal variability is usually quantified in terms of the inter–member standard deviation between the simulations pertaining to the different initial
conditions. In extended–range LAM integrations conducted over months to years, the IV varies with several factors that include the synoptic situation,
season of a year, the size and position of the computational domain and the spatial and temporal scales under consideration. For computational domains
centered over midlatitudes, IV is typically larger in summer [e.g., Caya and Biner, 2004], increases with the size of the computational domain
[Alexandru et al., 2007; Rapaić et al., 2011] and increases downstream with respect to the inflow lateral boundaries [e.g.,

Domain Name System Or Dns Is A Mechanism For Resolving...
Domain Name System or DNS is a mechanism for resolving host names into Internet Protocol (IP) addresses and IP addresses back into host
names. This is important because personally I feel as though it can be kind of challenging to remember IP addresses so like a phone book if you
don't know a person's number but you can remember their name it can make things a whole lot easier. So basically DNS is essentially providing
that same service to computers. Paul Mockapetris originally designed DNS at the University of California, Irvine in 1983 but many others have
helped in the development of DNS to make it what it is today. Before that a protocol name Advanced Research Projects Agency Network
(ARPANET) was being used but a rapid growth of networks required a new system for maintaining the host names and addresses. ARPNET was
created by Dr. Jon Postel. In 1984, a couple UC Berkeley students wrote the first Unix name server implementation. It was called the Berkeley
Internet Name Domain (BIND) Server. In 1985 it was revised and has since been then it has been a widely distributed mostly on Unix systems, and
which is still the most widely used DNS software on the Internet. Before I go into more details about DNS, I will go through a quick run through on
how to install DNS. It is actually pretty simple to install/configure DNS but you need to make sure you have the prerequisites installed before DNS
can be setup. Installing a DNS server involves adding the DNS server role to an

Dns, A Domain Name System
2.1.2 DNS SPOOFING: DNS is a Domain Name System. DNS contains all IP addresses and name of the websites in its database in the form of records
called resource records and are placed in the hierarchal manner. DNS spoofing is a similar type of MITMA when compared to ARP cache poisoning.
DNS spoofing is a technique used by hackers to provide false DNS information to the host while accessing a website. When users try to gain access
to a particular website, a request will be first sent out the local DNS server for the IP address of the website which the user wants to access. Once it
receives the request the DNS server does a search in the database to find the particular IP address of the website, once if identifies the ip address of
the website it immediately send a response to the user browser regarding the IP information.
FIGURE 2: DNS Request Query If the requested IP address is not found in the database of the DNS server, it will then forward the request to a
higher level DNS server in the hierarchy. It is due the hierarchical nature of the DNS structure of the internet, DNS server need the ability to
communicate with each other in order to find the ip addresses of the websites requested by the users. It is reasonable to expect the local DNS server
to know the name mapping to the local intranet server. It is termed as Recursion, the request from one local DNS

Essay On Eminent Domain

  • 1. Essay on Eminent Domain Eminent Domain Eminent Domain is the inherent power of the state to take over a citizen's property for public use without the owner's consent. This is commonly done when the acquisition of property is needed for the completion of a project. These projects can be for transportation such as highways or bridges or even for buildings such as schools or government buildings. This excerpt states that ''The Fifth Amendment to the Constitution says 'nor shall private property be taken for public use, without just compensation.' This is a tacit recognition of a preexisting power to take private property for public use, rather than a grant of new power.''160 Eminent domain ''appertains to every independent government. It requires no ... Show more content on Helpwriting.net ... To help the public, eminent domain may have to be put in to work to be used to build a highway in order to alleviate traffic problems or to build a school to help out overcrowding at other schools. These are just some issues that may arise for the need of eminent domain in which the engineer has to look out for and may help to further the growth of the city. There are issues that arise when the engineer is working for the developer who is seizing property by eminent domain. The legal battle that may be going on at the time has an impact on the engineer since he has to work with the schedule being presented while everything is being done to seize the property. The engineer might have to design for two or three different scenarios depending on if they get the property or not and/or if the property they get has different dimensions than originally speculated. Also the engineer might be involved in the eminent domain procedure by using his expertise to provide concrete evidence to why they need this land and what for and also if its suitable or not for the project at hand. Also, the engineer might have to make calculations on whether it is more financially beneficial to go ahead and try to look at other places to build or if taking over the land to build is a better financial plan. I think engineers should be able to advocate for public entities for economic ... Get more on HelpWriting.net ...
  • 2. Domain Name System Case Study The United States government announced on March 14, 2014 that they had intentions to bring to an end their role in the supervision of the Domain name system (Post, & Kehl, 2015). Known as the IANA transition it is of a grave importance in the chronicle of the worldwide grid and the rapport among government control and network governance. The DNS to the Internet is certainly a notable business accomplishment, and its efficient performance has been strategic to the stunning development of the Internet throughout the past twenty years. To ensure that the system operates properly and to accomplish its objective of widespread name uniformity, the doings of millions of discrete domain operatives has to be coordinated by some means. NTIA on July 2, 2012 gave ICANN a genuine reasonable procurement procedure, the current contract of IANA functions (Ntia.doc.gov, n.d). The indenture extends from October 1, 2012 to September 30, 2015, and has option periods of two years if the two periods are put into practice the expiration for the agreement will be on September 30, 2019 (Ntia.doc.gov, n.d.). ICANN, as the IANA functions operator executes organizational duties allied by means of the registries that are linked to the three main IANA functions. It is a crucial receptacle for protocol number and name registries utilized in scores of Internet procedures. ICANN upholds several of the numbers and codes within Internet proprieties. It organizes distributions of Internet procedures and Autonomous System numbers to the Regional Internet Registries, and in turn, ISP is allocated the numbers along with others within their geographical districts. • 3. Eminent Domain Individual Property Rights vs Eminent Domain These days there have been many issues surrounding the topic of private property and eminent domain. I feel that eminent domain is a good way to keep the needs of the community and each person's individual property rights balanced. Even though I believe individual property rights are more important that the needs of the community, I also believe the government sometimes has to take that property away for the better good of the community. At the same time I also understand how people feel when they talk about "NIMBY" (not in my back yard), and also about their personal needs. Let me take you back into the history of the American land. After the18th century, Americans turned their backs ... Show more content on Helpwriting.net ... This compensation was not seen in the case with the English and the Indians. These public uses have normally been railroads, highways, bridges, parks ext. Lately this eminent domain has been used for things completely different. An example is in Pittsburgh, property owners are fighting to keep their land from being taken away to build malls, casino's and factories. This is one of the many examples of the abuse of eminent domain. This is where NIMBY is introduced. NIMBY, which stands for "not in my backyard" is used to 1. "Express opposition by local citizens to the locating in their neighborhood of a civic project." Some examples of these "civic projects" are: a jail, garbage dump, drug rehabilitation center, or anything that the community considers unsightly, dangerous and likely to lead to property values decreasing. From this is how they derived the compensation and eminent domain laws. It is strange how they come up with these laws to compensate you after they have taken your land. This is where we come to the development of the property law. How did the protection of your private property come about? Protection and content are given to the ownership of property by custom or law. The type of property law in a society may be taken as an index of its social and economic system. • 4. Research Paper Outline & Thesis: Eminent Domain Research Paper Outline & Thesis: Eminent Domain Some people simply are not prepared for the new neighbors moving into America: the abuses of eminent domain. Although it has been around a great deal of time, eminent domain is unjustly taking land from the American people at an alarming rate. Eminent domain really is defined as being the government power exercised to purchase land or property from the people in order to develop the land or property for economic or community expansion. This topic is of importance to me and the general audience as it directly confronts rights of the citizenry, which I believe we all are concerned about. Really, powers are given and they can be taken away; eminent domain is up for grabs and only one thing must ... Show more content on Helpwriting.net ... In addition, societal welfare can at times be undervalued in a case such as this where lives are so easily seen as commodities and this is the best time to address it. This idea is supported by the Framer's who recognized the governments have this duty to correct for inequalities that occur naturally and in the market. In fact, this is just one of the facts explored by Elizabeth F. Gallagher of the Fordham Law Review in her publication titled Breaking New Ground: Using Eminent Domain for Economic Development. Reliance on the political process to safeguard private property rights is consistent with the original intent of the drafters of the Fifth Amendment. The words 'public use' may never have been intended to be an absolute limit on eminent domain power at all. Rather, the words described when compensation was required – when property taken by eminent domain is put to public use. The Takings Clause does not leave property owners without any protection against abuses of eminent domain (Gallagher). Gallagher continues with her arguments but one significantly standing out is that eminent domain may be the only way redevelopment can occur because in order to redevelop, investors must acquire large parcels of land and a single landowner can thwart all efforts. Redevelopment brings jobs, increases the tax revenue, and this benefits the most needy with better schools and housing ... Get more on HelpWriting.net ...
  • 5. Eminent Domain : Zoning And Land Use Eminent Domain – Zoning and Land Use Missouri concept and process of eminent domain Eminent domain is where the government has the power to take a private property and convert that into a public property, but the government can only exercise this power if they provide the just amount of compensation to those property owners. This is the main concept however each state has its own laws. In Missouri it's now a little stricter when they revised their laws in 2006 to make it more balanced to protect the private property rights of an owner and as well as the need for cities to eliminate the blight conditions. The term "public use" differs between states for what a government can take and use for public use purposes. In the state of Missouri the term "public use" can be taking land to build public roads, to taking land for use by private railroad companies, and to taking land to build private businesses to spur the economic growth (Missouri law review 1). The government can only use eminent domain where there are blight conditions, which in Missouri; blight is property which constitutes an economic or social liability or menace to public health, safety, morals, or welfare in its present condition and use (Law of Missouri 2). Most states have the just compensation towards the private property owners as giving them compensation that is market value for their property. • 6. Essay On Eminent Domain Eminent Domain is the actual inherent power of the government to take over a citizens' property for public use without the owner's consent. This was initially a part of public policy that originated in the middle ages throughout the world. It was adopted by into British Common law before reaching the Americas where it was then established into the U.S. Constitution in 1791 called the Due Process Clause of the Fifth Amendment. This grants the federal government the right to exercise eminent domain, provided protect to citizens, and protect the property rights of citizens. Also, state and local governments are required to pay just compensation for property they take under the power of eminent domain. The use of eminent domain power is used to promote economic development, especially in urban area of the United States leaving this to be a very controversial topic even in present day. In most circumstances when eminent domain used for the public good projects intended for the good such as highways, bridges, schools, and even government buildings. This policy pertain to every federal, state, local governments and it does not require very much constitutional recognition and is usually considered an attribute to the sovereign law makers in power. There have been many cases that have been brought up against the government in an attempt to regulate the power of the governments use to seize private property. • 7. On the performance and analysis of DNS security extensions... On the performance and analysis of DNS security extensions The domain naming server plays a vital role in the internet as it is needed and is involved in every internet application. DNS now works well and it is also sometimes mentioned that any new changes added to the present DNS may contribute to interruption to its functionality and can also contribute towards additional complexity which is undesirable. Current networks and the future networks relay essentially on DNS and it is important that the DNS should be a secured one. The DNS can be easily attacked and such an attack can cause dire consequences so it specifies the importance to use a secured version of DNS to avoid such consequences. To employ such a version involves more cost.... Show more content on Helpwriting.net ... Cost for increasing security to DNS varies depending on the kind of name server used. When the data is static then PK–DNSSEC is suitable and when the data is dynamic, better option would be to consider SK–DNSSEC. Caching resolvers computational cost is large in PK–DNSSEC and non–recursive servers computational cost is high in SK–DNSSEC [2]. Hybrid approach is used to eliminate these computational costs. SK–DNSEC cryptographic core contributes less to the total cost in producing symmetric certificates and thus a better performing efficient and fast cryptographic core can be used to improve the performance. If a new resolver is added or when existing root certificate becomes invalid then public key cryptography is used by the SK–DNS. In these cases root server can take care of the load caused by valid requests whereas the root server enabled with SK–DNSSEC is sensitive to reject of service attack. Security and performance both can be achieved by using hybrid approach. It can be used with PK–DNSSEC for the top level domain of DNS tree and for SK–DNSSEC for lower level domain of DNS tree. Size of the response packets of DNS are increased by producing higher network traffic and latency in PK–DNSSEC. SK–DNSSEC is considered to be a possible alternative for PK–DNSSEC for few of the important reasons like key management is made easy with SK–DNSSEC, smaller response packets which require small memory for caching. • 8. Pros And Cons Of Eminent Domain Proponents of eminent domain point to the potential use of eminent domain as a component of urban renewal projects. They view eminent domain as a tool that can be used as part of urban renewal to help revitalize the economy of depressed areas by creating new jobs, building infrastructure, remedying unsafe conditions and housing, and improving the overall economic well–being of an area. For example, the construction of Minute Maid Park (a baseball stadium in Houston, Texas) "brings millions of people every year into downtown Houston, a place that had previously been a long way from being a lively 24/7 environment...Around the ballpark, developers have created loft dwellings for young professionals, old buildings have been transformed into hotels, and a new high–rise residential tower is under development" (Lewis). Proponents assert that the societal gains that occur from these projects are a fair tradeoff for individual's relocation and loss of property. Eminent domain expert David Lewis points out that using eminent domain enjoys strong public support when used in projects such as constructing dams in ... Show more content on Helpwriting.net ... When evaluating urban renewal projects, Professor Steven Cord found that "By far most of the housing destroyed was low cost housing," (184). The statistics in Kelo also showed that 56 percent of nonwhites and 38 percent of whites displaced by urban renewal were qualified to receive public housing due to their low incomes. Further, the destruction of housing forces individuals to seek relocation housing. Relocation housing is not guaranteed to be readily available or to be superior to the housing destroyed (Cord 185). Eminent domain has broken up neighborhoods and forced out longtime residents (Cord 184). Businesses that are relocated often lose their customer base and often must pay higher rents (Cord 185). • 10. Expansion Of Top Level Domain IST 618 Information Policy Debate Notes Expansion of Top Level Domain AGAINST THE MOTION Aman Shrimal Expansion of domain name for the benefit of users and companies as proposed by Internet Corporation for Assigned Names and Numbers (ICANN) has many major flaws. According to Association of National Advertisers:ICANN's proposed program for increasing competition, promoting, innovation, addressing an alleged shortage of Internet addresses and helping differentiate products and services – is deeply flawed. (Association of National Advisers , 2011). The justification to expand the domain name, that new gTLDs would facilitate customer search, promotes consumer welfare, even though the registration cost for a new domain is excessively high and would harm the brand name is flawed. The expansion of domain name will open internet for criminal activity where felons can cyber squat in the name of trusted brands. Objections raised by stakeholders had not been addressed adequately and the decision is mostly influenced by the parties getting directly benefits from this program and not those going to get affected. Since beginning ICANN is proposing introduction of new gTLDs without completing the comprehensive economic study of the domain name registration market and, without having a completely developed understanding of the economic realities of the domain marketplace. • 11. Pros And Cons Of Eminent Domain Would you be okay with the government taking your house and relocating you even if it meant that you got compensated for the sacrifice you are doing. This is known as eminent domain. What is eminent domain policy to be more specific? This is most often used with land property. Some that have never seen it in action will not fully understand how it truly works. Here is an example to help clarify. A highway is being made through a portion of a town and one person or family is refusing to sell their land/home. Eminent domain gives the government the right to forcibly remove the owner and cease their land even if the land owner doesn't agree to it. In the Penn Central vs. New York City 1978 Penn Central Transportation Company wanted to construct a very tall office tower above its already existing railroad station and smaller office building, known as Grand Central Terminal. The Commission ruled that Penn Central could not go through with the project because the new development would change the existing landmark way too much. Penn Central sued in court, saying that the city's regulation of landmarks amounted to an Eminent Domain Clause "taking" of their private property rights. They said if the city was allowed to regulate them in this way, they should be compensated according to the 5th Amendment Eminent Domain Clause. At the end The Supreme Court ruled against Penn Central. The Court said first of all that there is no set procedure for ruling when an economic loss. Another case that changed the eminent domain was Kelo vs. City of New London. In this case the Supreme Court ruled that a city could seize land, through the use of the Eminent Domain Clause, private homes that were in good condition, and transfer them to another private property developer, for a local economic development project. The home owners then sued the city, claiming that the only reason for taking their land was not for "public use," as required by the Eminent Domain Clause, but rather for private use ... • 12. Eminent Domain Paper When Should Eminent Domain be Used? When should a city or state use their eminent domain powers? Over the past few years there have been a couple of cases that raised the questions of when eminent domain should be used. One of the most controversial cases in the history of the United States was the Kelo v New London Supreme Court ruling. In order to generate tax revenue, add jobs, and to prevent bankruptcy, the government's right to initiate eminent domain for public good is a necessary evil. Eminent domain in definition is "the right or power of public purposes without the owner's consent on payment of just compensation" ("Eminent Domain History"). This could create more jobs, because more companies might be interested in locating there due to all of the growth. Eminent domain should also be used by a city or state if it prevents it from going bankrupt. A city or state should use eminent domain if it prevents it from going bankrupt. If a city is near bankrupt then it cannot provide all of the necessary items that a city needs in order to run like it is supposed to. For example, if a city is short of funds then it would have to reduce its budget in places that would harm the city. It would have to cut money from the police, and fire departments. However, by using their eminent domain powers a city could keep all of this from happening by letting a business come that would create thousands in tax dollars, and add jobs to the city. This means that a reduction in the police and fire departments would not happen and the city would still run smoothly. The cities and states that use eminent domain to acquire land in order to keep themselves running smoothly is sad; however, these cities and states are looking out for what is best for their areas. Domain name is unique address within the internet network, similar to a physical address in real world. Some of the example of domain name are: google.com, apple.com or amazon.com. The domain name management industry has thrived over last few years. Companies across the globe are increasing their online presence, coupled with individuals' desire to establish personal web space (Panteva, 3013). Now a day's online presence is critical for business expansion and their branding. NAICS code of companies involved in sale of domain name management is 541511 (Custom computer programming servers) (Panteva, 3013). Total revenue of the United States industry is expected to reach to 3.3 billion by the year end of 2013. Annual growth of the industry from year 2008 to 2013 was 2.9 percent (Panteva, 3013). During next five years (from 2013 to 2018), it is projected to grow at the rate of 6.2 percent (Panteva, 3013). Out of seventeen top level domains (YLDs), ICANN has accredited 1543 registrars in one or more TLDs (ICANN, 2015). More than 650 new gTLDs are delegated. This will create lot more opportunity in domain name management industry. Industry is in growth life cycle state. But competition among existing players is too high due to large number of registrars. • 15. Eminent Domain Should Be Used For The Good Of Mankind Essay Imagine getting a visitor at your front door, and the visitor offers you a very generous amount of money for them to take you property for public use. For some people it is the property they grew up on, and for others it is the property that has been passed down through family generations. That is what happens when private property owners experience eminent domain. Eminent domain can be a wonderful thing for big companies and powerful leaders. On the other hand, people lose their homes, or perhaps their farmland. Those who offer eminent domain often have big plans that can benefit a community, but the huge loss here is people losing their homes. Most companies will only enforce eminent domain if they have no other choice. Other companies do it purely for themselves. Eminent domain should be used for the good of mankind, because it has the power to put some good places in this world if done correctly. Doing some research on eminent domain I came across the April 2010 issue of the Yale Law Journal. One of the notes in that issue mentioned the history of eminent domain, and it was called "Eminent domain due process" by Zachary Hudson. Hudson talks about how after eminent domain was founded; it was argued that it the power of eminent domain was or was not in the Constitution. Hudson says that "Congress did not pass a statute authorizing the use of eminent domain more generally until 1867 when it did so to aid in the development of national cemeteries following the civil war" ... Public parks may seem purely aesthetic and ornamental, adding no true value to society, therefore some would argue that the government has no justification for taking their property. Are the shopping and housing complex not going to directly benefit the public as people shop or look for residences? If you put an apartment building there, nobody in that apartment building would do the same thing for the people that the church will do." • 18. Eminent Domain Purposes 1.When does a taking occur for eminent domain purposes? Refer to the Lucas case. Eminent domain refers to the inherent power of the state to take or seize the private property of its individual citizens. Property taken through eminent domain is mainly set aside for the development of public utilities or assigned to a third party who is then supposed to use it for the general good of the public (Larson, 2004). There are generally four types of takings employed by the state through eminent domain. These are: a.Complete Taking – This is where the state seizes an entire property in for public use. In the case of Lucas v. South Carolina Coastal Council (1992), the plaintiff was entitled to compensation as a result of the complete taking of his land. However the Supreme Court denied him any compensation stating that the restriction imposed on the use of the land was in the interest of the general public due to the intended use of the land. Therefore the Takings Clause does not apply in this case in spite of the economic benefits lost incurred as a result of the complete taking of his property. b.Partial Taking – The state in this case takes a portion of a particular property mainly for the expansion of the existing utilities. The owner of the property is liable for compensation in regard to the piece of land seized and any resulting decline in the value of the remaining property. c.Temporary Taking–The government may require a piece of land to be used as a site when ... The government should exercise eminent domain cautiously to ensure that individual property rights are seldom taken away. In 2005, the ruling of Kelo v. This is why it is referred to as the fair price because it was where the buyer and seller would reach at a consensus. The government is allowed to seize personal property for private use if they can prove that doing it will serve what's called "the public good". Amongst topics of conversation regarding eminent domain, one will find regulatory usage of land, seizing of land for public use, and the most controversial of late, the seizing of land from a private owner and giving it to a more economically beneficial, often politically connected private owner. Kelo v New London (US 2005), has prompted dozens of proposals to reform eminent domain practices legislatively. Most of these proposals would restrict the use of eminent domain to transfer property from one private individual to another. It is one thing to have a city claim property to further the development of the city by building roads, schools, etc. It is another thing altogether for the government to seize a property so as to gain money from higher taxation. For many years, however, courts have read the public–use restraint broadly, enabling governments to take property from one owner, often small and powerless, and transfer it to another, often large and politically connected, all in the name of economic development, urban renewal, or job creation. Multiple times, the paper asserts that the be–all, end–all metric of value ought to be economic value, specifically the value derived from synergistic arrangements of real property. But viewing a situation through this lens dehumanizes the situation. It leads to situations where we can, with a straight face, describe human settlement as clutter to be disposed of. Indeed, alternative metrics of value exist which add nuance to the situation. Sentimental or cultural value, for example, may be entirely at odds with economic value. • 30. The Optical-Time Domain Reflectometer The OTDR is a device that measures distances to a reflection surface by measuring the time it takes for a lightwave pulse to reflect from the surface. Reflection surfaces include the ends of fiber cables, breaks in the fiber, splice locations, and connector locations. The ability to provide these measurements simplifies the fault location procedure for fiber systems. The OTDR measures the scattered and reflected light returning from a pulse of transmitted light. Pulses of light are generated from the OTDR, and reflected light is displayed on the oscilloscope portion of the OTDR. Knowing the time delay of the reflected light pulse and knowing the speed light travels in the fiber determines the distance to the discontinuity of the fiber. Discontinuities or impedance changes of the fiber cable reflect light back to the OTDR. It is important to know the index of refraction of the fiber core to accurately determine distance. This setting must be correctly set on the OTDR. Keep in mind that power level is displayed on vertical axis, and distance is displayed on the horizontal axis of the screen. Abrupt changes in reflected power can represent fiber "open" conditions. The OTDR will display small losses from couplers and connectors. This is done by uploading something off a foreign data transfer device such as a flash drive. This could cause problems with the entire system if the malicious program is a virus. A more non logical problem would be if a disgruntled employee purposely tries to take down the system or steals information that is considered sensitive. While this happens it is less logical than accidently exposure. The worst thing that could happen is that the malicious code wipes out your servers, removes all data and causes massive production loss and most likely a loss of profit. This is countered with strong policies and physical security to derail these problems. The second domain is the workstation domain. The threats to this would be similar to the first domain because if a user does something malicious on that workstation, it would affect a larger area of the domain. Another problem is that workstations run programs that are susceptible to bugs and crashes. If ... Get more on HelpWriting.net ...
  • 33. Jason Swartwood Wisdom Wisdom is a bit of an elusive topic. There seems to be a general consensus of what counts as wisdom, however, when asked for a definition 'acting with regards to knowledge and understanding' is commonly used. While this definition is certainly workable, it does not go very deep into this vast concept. How exactly do knowledge and understanding interact to reach the level of wisdom? There is not a whole lot of work done analyzing the process of acting wisely. One such attempt is made by Jason Swartwood, who claims that wisdom can be thought of as an expert skill. He claims that wisdom is the same kind of epistemic achievement as expert decision–making. This approach to wisdom allows for interesting insight into this topic and can begin to look ... Show more content on Helpwriting.net ... One of the more pressing questions is the ability to identify wisdom. Identifying wisdom is something that is fairly common among people even without such in depth knowledge. Along the lines of identifying wisdom, how do heuristics play into this discussion? Heuristics are any sort of approach to solving a problem that is sufficient in achieving immediate goals. Typically when applied to games, they are approaches at playing in the most optimal fashion in the widest variety of scenarios. One of the great things about heuristics is that it is not always necessary for these heuristics to be developed by an individual and can be passed to people who may be very new to these situations or scenarios. Someone fairly new to the game of chess could be given a set of heuristics with which to play by such that they could fair very well in the tournament. There are a couple main components to the notion of heuristics, which could cause interesting cases under Swartwood's account for wisdom. This beginning chess player could very well appear to be acting wisely in this tournament, but would they actually acting wisely? The first aspect of heuristics is their ability to achieve short–term goals. Now the part of Swartwood's argument that this would focus on is the domain in which his argument is concerned and the ability to grasp success reasons to perform an ... For an organized structure of these records , Zone is assigned At the point when another DNS server is added to the system and it is arranged as another optional server for a current zone, it plays out a full introductory exchange of the zone to get and repeat a full duplicate of resource records for the zone. Most prior DNS server usage utilize this same technique for full exchange for a zone when the zone requires updating after changes made to the zone. For DNS servers running Windows Server 2003 and Windows Server 2008, the DNS Server benefit bolsters incremental zone exchange, a modified DNS zone exchange process ... Show more content on Helpwriting.net ... In the recent times, hackers or attackers, because of technological advances, are trying to mislead the user by various attacks. As we discussed some of the attacks in the above mentioned "Type of Attacks", now we shall look into a common process of DNS Hijacking where DNS Zoning along with signatures and keys can be more helpful. In the following figure , it shows the basic outline of how the domain name system acts and how information is being exchanged in the normal conditions. Arrows indicate exchange between systems in bi direction. Figure 2: DNS working When attackers enter into open WiFi or Public accessed networks, they bypass all the Proxy configurations and steal the information from the main computer after making multiple harmful queries and spoofing the DNS. By doing this, the whole DNS system can be cloned. After cloning or replicating the DNS, attackers can try to create a malicious or harmful information into the user's computer or host device. Figure 3: Replicated DNS attacking the host. When a user is trying to access a website, like www.cnexample2017bank.com to check the accounts, the replicated DNS will give the phishing page or replicated page of original website into the Host device. • 35. Eminent Domain Of Economic Development According to Bowman and Kearney, economic development is the "process by which a community, state, or nation increases its level of per capita income, high–quality jobs, and capital investment (Bowman & Kearney, 2014, p. 370). Throughout our readings, it is presented that economic development exists because of the gradual decline of our metropolitans. More recently, it's been explained that economic development has become a local issue that localities are attempting to resolve due to the stale mate federal government and partly the Great Recession, and doing this with a deteriorating tax base in the form of population and jobs which increase the deteriorating infrastructure. Cities have lost population, such as Detroit which lost 25% in ... Show more content on Helpwriting.net ... "When asked whether the tax breaks and subsidies actually created jobs, elected officials and economic development experts couldn't say for sure" (Fulton, 2014, p. 171). Stadiums fall in this realm as well. Owners of the "big four" (NFL, MLB, NBA, NHL) have secured nearly $20 billion in taxpayer subsidies for new stadiums (DeMause, 2014, p. 73). In 1984, a study by Robert Baade on 30 cities with recent stadiums constructed found that 27 had no measurable economic impact, and in 3 cases, economic activity actually decreased. These findings have been repeated since then and tell the same story. A study on 'mega–events' like Super Bowls, South FL economist, Phil Porter found 'no measurable impact on spending' which he attributed to the "crowding out" effect of non–football tourists steering clear of town on game weeks" (DeMause, 2014, p. ... • 36. Analysis Of Disney Company 's Recreation Of Public Domain... Once upon a time there were gripping tales shared between generation to generation and continuously passed down. The listener 's focus was on the story's message and not its possible profit allowed those listeners to live happily ever after. Storytelling began long ago traditionally told orally before there was a shift to written stories and eventually as technology developed became a digital market. Some of the most famous digitalized tales are fairy tales. Previous to digital development, copyright laws on fairy tales were slim because there was less concern over copying. This is also how the story's focus was more on the message and its creative development than the potential profit. The Walt Disney company's recreation of public domain fairy tales demonstraights how copyright laws have hindered artistic creativitity within America. The Walt Disney company, is a beloved as well as infamous company worldwide also notoriously known for their strict copyright laws. Original American copyright laws stated artistic works were protected for 28 years and these laws were eventfully extended to a 56–year time frame. The term continues to increase with the present law set at 75 years. Large companies like Disney continue to fight for stricter and longer laws because of the revenue they will continue to bring it. (Washington post). One apparent problem from the extensions is public lacks the ability to build on Disney stories since they are not in public domain. In the 1997 report ... • 37. Effective Domain Affective domain is the only domain that does not reflect what we teach our students as in specific skills or knowledge, but more of how the students use the information that we have given them, and then add in an emotional component. Not all students come from a caring, loving or compassionate back ground or family life, so the classroom may be the place to start the learning of respect, positive attitude and values necessary for a successful medical professional. The affective domain learning brings the lesson into an active student centered learning environment where emotions can be a highly motivating tool. Bloom's Taxonomy disseminates the affective domain into five learning levels; receiving, responding, valuing, organizing, and characterizing. Although cognitive in nature, the first or basic level is simply receiving the information, whether done by hearing, seeing or reading. Three additional levels brings the student to the final level of characterizing, which is considered mastering the domain. Characterization is obtained when the student's behavior pattern has inscribed the values they have learned, allowing these values to enhanced their patient care. ... • 38. Statistical Weather Prediction And Regional Climate... One–way nested Limited–Area Models (LAMs) are used in numerical weather prediction and regional climate modelling to downscale coarse–resolution global/regional simulations or analyses that are provided as the time–evolving Lateral Boundary Conditions (LBC). The LAM integrations are sensitively dependent on infinitesimally small modifications. The so–called twin simulations, i.e., LAM integrations identical in all respect, except having slightly different initial conditions, may with time lead to substantially different solutions. This phenomenon has been referred to as internal variability (IV) in the existing literature [e.g., Giorgi and Bi, 2000; Christensen et al., 2001; Rinke et al., 2004; Lucas–Picher et al., 2008a; CrГ©tat et al., 2011; Done et al., 2014]. Internal variability is usually quantified in terms of the inter–member standard deviation between the simulations pertaining to the different initial conditions. In extended–range LAM integrations conducted over months to years, the IV varies with several factors that include the synoptic situation, season of a year, the size and position of the computational domain and the spatial and temporal scales under consideration. For computational domains centered over midlatitudes, IV is typically larger in summer [e.g., Caya and Biner, 2004], increases with the size of the computational domain [Alexandru et al., 2007; RapaiД‡ et al., 2011] and increases downstream with respect to the inflow lateral boundaries [e.g., ... • 39. Domain Name System Or Dns Is A Mechanism For Resolving... Domain Name System or DNS is a mechanism for resolving host names into Internet Protocol (IP) addresses and IP addresses back into host names. This is important because personally I feel as though it can be kind of challenging to remember IP addresses so like a phone book if you don't know a person's number but you can remember their name it can make things a whole lot easier. So basically DNS is essentially providing that same service to computers. Paul Mockapetris originally designed DNS at the University of California, Irvine in 1983 but many others have helped in the development of DNS to make it what it is today. Before that a protocol name Advanced Research Projects Agency Network (ARPANET) was being used but a rapid growth of networks required a new system for maintaining the host names and addresses. ARPNET was created by Dr. Jon Postel. In 1984, a couple UC Berkeley students wrote the first Unix name server implementation. It was called the Berkeley Internet Name Domain (BIND) Server. In 1985 it was revised and has since been then it has been a widely distributed mostly on Unix systems, and which is still the most widely used DNS software on the Internet. Before I go into more details about DNS, I will go through a quick run through on how to install DNS. It is actually pretty simple to install/configure DNS but you need to make sure you have the prerequisites installed before DNS can be setup. Installing a DNS server involves adding the DNS server role to an ... Get more on HelpWriting.net ...
  • 40. Dns, A Domain Name System 2.1.2 DNS SPOOFING: DNS is a Domain Name System. DNS contains all IP addresses and name of the websites in its database in the form of records called resource records and are placed in the hierarchal manner. DNS spoofing is a similar type of MITMA when compared to ARP cache poisoning. DNS spoofing is a technique used by hackers to provide false DNS information to the host while accessing a website. When users try to gain access to a particular website, a request will be first sent out the local DNS server for the IP address of the website which the user wants to access. Once it receives the request the DNS server does a search in the database to find the particular IP address of the website, once if identifies the ip address of the website it immediately send a response to the user browser regarding the IP information. FIGURE 2: DNS Request Query If the requested IP address is not found in the database of the DNS server, it will then forward the request to a higher level DNS server in the hierarchy. It is due the hierarchical nature of the DNS structure of the internet, DNS server need the ability to communicate with each other in order to find the ip addresses of the websites requested by the users. It is reasonable to expect the local DNS server to know the name mapping to the local intranet server. It is termed as Recursion, the request from one local DNS ... Get more on HelpWriting.net ...
