The overarching guidelines to the modern approach to liability for negligence in tort go back to
Donoghue v Stevenson [1932] with Lord Atkin setting out the 'neighbour' principle, such that one
has a duty to take reasonable care to avoid acts or omissions which one can reasonably foresee
would be likely to injure a neighbour (one who I ought reasonably have in contemplation as
sufficiently close and directly affected by one's act and omissions). However, the development of the
common law approach to liability of the state, and public authorities, for harms inflicted by third
parties for whom the state is not responsible, can be seen to be restricted, both in the interpretation
of required proximity of the party so harmed, and on the basis of 'public policy'. The current position
with reference to public policy restrictions can be found in Gorringe v Caldedale MBC [2004], the
judgement on which gave a significant review of the state of the law. In this case, Mrs Gorringe was
injured following a collision between her car and a bus; she contested that the local authority's
statutory duty in terms of highway maintenance created a corresponding actionable common law
duty. This claim failed at both the Court of Appeal and House of Lords, with key rulings that: "if a
statutory duty does not give rise to a private right to sue for breach, then the duty cannot create a

At baseline the women who participated in the study weighed an average of 185 lbs. to 189 lbs., so
that even after losing 10 lbs. the women remained overweight and or obese. Overall, the A to Z
weight loss study was well presented and the outcomes provided interesting information. However,
an analysis of the research report revealed factors that challenge the importance or relevance of the
results. These factors include the minimal weight loss of the women, limited sample size that was
not representative of the general population, and the lack of data regarding participants' knowledge
of the study diets prior to enrolling in the study. The study also does not address whether
consistently consuming fatty foods long–term would lead to health problems. For these reasons I
would not be likely to recommend the Atkins diet to my patients, or family and friends. Further

It allows the person to eat food that normally are not allowed when on a typical diet (I.E bacon,
dressing, cheese). Having this ability to eat more could result in easier success in following this diet.
Atkins also provides products that follow the diet like snack bars, candy, premade meals, snacks,
and recipes to help the person still give into their cravings without the guilt and negative impact on
the body. I believe that over time, like with any fad diet, a person might get bored of eating foods
that are low carbohydrate and then start to struggle with that. I also think this diet may be hard to
follow if the person is unable to cook for themselves or are in a tough situation financially. Atkins
requires a lot of cooking and if the person can not cook for themselves it's more costly so if someone
does not have these resources like a college student it may be harder to maintain. The biggest issue I

The purpose of this assignment is to discuss the creation and application the case law resulting from
the decision in Donoghue v Stevenson . This decision is often cited in relation to the tort of
negligence and a duty of care. As such it could be misunderstood as being the preeminent case for
the principles of negligence or duty of care alone. It is however the landmark precedent case for the
tort of negligence outside of a contract when taking into account 'duty of care' and the 'neighbour
priciple'.
The reality is the tort of negligence and a duty of care technically existed in cases such as Blyth v
Birmingham Waterworks Co and Winterbottom v Wright .
The case of Donoghue v Stevenson created a definition of a 'neighbour' towards a duty of care in
negligence within the bounds of an indirect causal link without the added implication of a willful act
or inherently dangerous goods. This provided a mechanism for a third party to go beyond the
doctrine of privity and sue even if not a direct party to a contract.

research from the New England Journal of Medicine found that several heart disease indicators

INTRODUCTION Fascination with health and dieting has been around for hundreds of years; with
changing times, come changing ideas on foods, health, and nutrition. For example, the food pyramid
has changed several times since the early 20th century. The USDA has revised its recommendations
more than several times since 1917. Originally, the nutrition guide, established in 1916, was based
on five food groups. During the Great Depression, the number of food groups increased to twelve,
as fruits and vegetables were broken down into more specific categories, each with their own daily
recommendations, to serve as a "purchase guide" that would be able to accommodate a much poorer
country. In the mid–20th century, food groups decreased from twelve to seven, and then to four–
milk, proteins, grains, and fruits/vegetables. These groups stayed the same until the 1970s, when the
food pyramid was first introduced, separating fruits from vegetables, and also including some sort of
intake of fats and oils. For at least 30 years, this had been the standard recommendation until "My
Plate" was recently introduced. As research continues to search for the "perfect" diet for humans, the
USDA's newest model offers guidelines that are aimed at improving ones overall health–but clearly,
guidelines have constantly changed over time.

However, the development of the common law approach to liability of the state, and public authorities, for harms inflicted by third parties for whom the state is not responsible, can be seen to be restricted, both in the interpretation of required proximity of the party so harmed, and on the basis of 'public policy'. The current position with reference to public policy restrictions can be found in Gorringe v Caldedale MBC [2004], the judgement on which gave a significant review of the state of the law. In this case, Mrs Gorringe was injured following a collision between her car and a bus; she contested that the local authority's statutory duty in terms of highway maintenance created a corresponding actionable common law duty.
