Professional Liability And Legal Liability Insurance
The profession that I have chosen to concentrate on is that of a personal trainer, specifically issues
concerning liability insurance. Personal trainers provide direction and supervision to clients within
the realm sports and exercise realm. The chosen place of employment is often work out facilities. It
may also include working with clients at other locations, such as the client or trainer's homes.
Personal trainers work both as employees and as independent contractors. I think that I would
probably have an employer in the beginning, such as working for a work out club chain. After I
acquired some experience and built up a clientele, I would probably consider working as an
independent contractor. Either way there are risks that must be covered by insurance. Whether a
client is injured due to negligence, or inherent risks (no fault), a trainer must protect themselves in
case of a lawsuit. Additionally, frivolous lawsuits have become common place, and if an individual
does not have insurance they could be left vulnerable. Both professional liability and general
liability insurance are necessary to help to cover your costs in the event of an injury claim, whether
you are truly responsible or not. This is an essential part of a comprehensive risk management
strategy.
Some of the specific duties a personal trainer is responsible for are:
Overseeing exercise programs and weight training.
Instruction on proper lifting techniques, proper usage/handling of

Liability Insurance As A Personal Trainer
Why You Need Liability Insurance as a Personal Trainer
When you decided to become a personal trainer, you did it because you wanted to help people
achieve their fitness goals and live a healthier life. You did it for the love of it. You care about
people and want to help them succeed.
This can be a very rewarding and lucrative career, but it can also be a risky one. When advising
people on physical activity, you need to be careful. The last thing you probably thought of when
going into this career, was that you should look into liability insurance.
What is Liability Insurance?
Liability insurance protects the policyholder in the event that lawsuits or similar claims are brought
against them.

– They weren't properly supervised.
A lot of clients are probably new to the gym and go in not knowing where to start. You have to
supervise them to make sure that they are using the proper form so they don't get injured.
– You didn't know their medical history.
Before you begin training someone, you need to know their medical history as well as their injury
history. You need to make sure that they aren't doing something that will put them at risk. They need
to complete a fitness test as well so you know where they stand going into training.
– You gave nutrition or supplement advice.
Unless you are a certified dietician, do not give recommendations on nutrition or supplements. This
can get you into trouble because you don't know how someone may react to these products.
– You didn't explain risk and consent forms

Essay on Understanding Relevance Legal Standard
In the grand scheme of trial, evidence is needed to convince jurors to give a verdict of guilt or not
guilt. Evidence can take several forms such as physical evidence, substantial evidence. Regardless
of what type evidence is presented must be relevant to the case to be admissible. "Relevance refers
to any material fact or evidence having a tendency to make the existence of a matter at issue more
probable than it would be without said fact (probative value)"(Britz, 2008, p. 344).
In this paper, an examination of the legal standard of relevance evidence will be discussed.
Furthermore, the rules of inclusion and exclusion of evidence based on the wording of the rules will
be scrutinized. In the final section, examples of ... Show more content on Helpwriting.net ...
According to Rule 401(Test for Relevance Evidence) of the Federal Rules of Evidence, the test
relevance depends on depends on two factors. The first question ask do the Evidence have any
tendency to make a fact more or less probable in the absent of the evidence and, do the fact of
consequence in determining the action relate to the case(Federal Rules of Evidence). The court
could possibly exclude relevant evidence if its probative value is substantially outweighed by a
danger of one or more of the following: unfair prejudice, confusing the issues, misleading the jury,
undue delay, wasting time, or needlessly presenting cumulative evidence. When relevant evidence is
questioned for some type unwarranted chauvinism it is covered under the F.R.E. Rule 403(Federal
Rules of Evidence).
The Rule 403 of the F.R.E., states that relevant evidence may be excluded if its probative value is
outweighed by unfair prejudice. This is to say, when something has been present to the jury that
would produce unfair prejudice and could develop an adverse opinion prior to having sufficient
knowledge of relevant facts. (Britz, 2008, pp. 273 – 274). In the case of Spencer v. Texas, the

and it is immensely important for business owners to have a lucid understanding of what each policy

Although there are a wide variety of types of business insurance in Texas, the problem is that it can
be difficult to understand which types of coverages are best suited for a specific type of business.
Following, is a synopsis of different common coverages and how they protect a business. Depending
on the type of business you own and specific needs of that business, the type business insurance in

Types Of Insurance For The Food Industry
It might not be the most exciting part of opening a restaurant, but one of the most vital steps of
opening a new eatery is getting insurance coverage. There are many potential problems that you
need to be prepared for in the food industry, ranging from equipment failures to slip–and–fall
lawsuits. Depending on your restaurant 's location, you will need certain types of insurance to
comply with local laws. Also, you will need insurance to qualify for bank loans and mortgages.
Read on to learn about the various types of insurance you may need when operating a restaurant.
Common types of restaurant insurance
These types of insurance should be seriously considered when opening any type of restaurant.
–Property Insurance

Drones and Your General Liability Insurance
Drones. Once thought to be years away, are increasing in number. From cutting–edge real estate
tours to crop surveillance, many businesses are investing in drones to assist with day–to–day
operations. Drones offer business owners a real competitive advantage within their industry.
The Benefits of Having a Drone
More and more operating a business is becoming increasingly challenging. Fewer barriers to entry
make earning more money harder each day. With increased competition, many businesses are forced
to reduce costs in every aspect of their business. Many businesses find that drones are a great way
for them to be competitive, without adding an annual salary to their books. Drones are also capable

While in use, drones can cause accidents and injuries, exposing your business to potential liabilities.
For instance, a drone taking surveillance pictures could fall from the sky and strike someone in the
head down below. Without the proper general liability insurance, how would your business cover the
costs of the damages?
General Liability Insurance and Drones
There are many forms of business insurance. Whether you need insurance for a car or for your
business property, you won't have trouble finding an insurance solution that is perfect for you.
Although drones are new technology, and many insurance companies may not have a tailor–made
insurance product specifically for drones, general liability insurance may help you with liability
issues involving drones.
Loosely speaking, general liability insurance helps businesses cover the costs when management or
employees are found liable for an act that caused another to be harmed. A business drone that injures
someone while being used for commercial purposes may help you cover court and settlement costs.
If you are considering using a drone in your business, contact your licensed insurance representative
to inquire about insurance coverage. Just like cars, accidents stemming from the use of this
technology can create a legal nightmare that costs you handsomely. Fortunately, you can minimize
your exposure by partnering with an insurance agent who provides general liability insurance.
Drones are all the rage, but you must ensure that your business isn't exposed to liability risks from
using your

Onsite Daycare Essay
What is an Onsite Daycare and Why Should We Have One?
An onsite Daycare is a place directly located at the employers of parents with toddlers or babies who
need full time child care while their parents are at work. It allows the parents the advantage of being
close to their children while still being able to maintain stability with their careers.
According to Statistics Canada, the amount of two parented full time working families has gone up
17% since the 1980's. As a result of such an outcome, more employees in larger and smaller based
companies are finding it harder to keep up with both risen work loads and home life necessities,
which in turn have caused more absentees in the work place. The reason being for this is due to ...

On–Site daycares would also be more time efficient for employees as they and their children will be
going to one destination, opposed to travelling a further distance to drop of their kids before arriving
at work. Dually this also compliments time effectiveness because employees can work later hours
without the inconvenience of having to leave early to retrieve their child from a further daycare
facility. In cases such as illness for the child, it also saves time for the company and the worker for
the employee to be able to take their child from work to a hospital or other destination without the
extra travelling.
Negative Aspects and Insurance Liabilities and What Can Be Done to Prevent It
Although there will be an inevitable exposure to liabilities, there are ways to decrease the amount.
Some liabilities observably entail issues such as injuries to a child while attending the daycare.
These liabilities can be minimized through the legal structure of the daycare and also how organized
the operation is arranged, purchasing liability insurance when licensing the daycare, and making the
daycare clear of any objects which may result in injury. Fortunately, there are also three other types
of liability options to explore: 1. Self Insurance eliminates the risk of being

Pharmacists now experience more lawsuits than ever before due to healthcare facility errors that
were looked over, giving a prescription to the wrong customer, writing the wrong directions on a
prescription, putting the wrong drug in the correct bottle for a patient, etc. (Rx Recruiters, (N.D.). I
have worked in a pharmacy over many years and have seen many mistakes happen with a good and
bad ending. The two most common mistakes that are not the fault of the pharmacist are giving the
wrong prescription to the wrong customer at check out and not following HIPPA standards. There
are many cases where customers can have common names and are given the wrong prescription due
to lack of verification. I have personally heard of a customer calling back because they realized they
have the wrong medication. An instance of such could go in a very bad direction if a customer takes
the medication and causes health problems or death, which would result in a malpractice lawsuit.
Although it was not the pharmacist error because it was an employee working under the pharmacist,
the pharmacist could lose their license and much money due to this mistake. As long as the
pharmacist has professional liability insurance this mistake would be covered and licenses would
not be threatened to be taken. Another main area for possible lawsuits would be disregarding or not
following HIPPA regulations properly. In

Insurance Liability And Liability Insurance
There are many lines of different property and casualty insurances. Even though the general purpose
and utilization of these insurances is the same across the nation, prices fluctuate from state to state.
We will get into more detail in regards to Errors and Omission Insurance (E&O) in the State of
California.
Errors and Omission Insurance, also called Professional Liability Insurance or Malpractice
Insurance, is used to cover legal expenses caused by potential errors and omissions during
operations and stipulation of cases.
When a company or firm is sued for making a mistake, performing services in a negligent way or
misrepresenting or financially harming a client, the consequences can harm a company in an
irreversible way.
This is ... Show more content on Helpwriting.net ...
Since E&O insurance is important to carry when running a business most professions have this type
of insurance to cover a potential lawsuit that would otherwise cause them to file for bankruptcy. It
may come as a surprise that some states do not require businesses to have E&O insurance, but a
large portion of contracts with clients required insurance for the contract to be in effect. Having an
E&O insurance policy may sometimes be a selling point for potential clients. When a client sees that
a business has this type of insurance it gives them peace of mind knowing that if there happens to be
any error or omission throughout the process they will be compensated. The same applies to the
actual company. It makes it easier to accept new clients and cases knowing that in case of any
alleged misunderstanding or disputes, the policy would bring in protection and coverage.
According to techinsurance.com about 70% of businesses raise prices or cut hiring when sued and
yet, $35 billion = annual out–of–pocket cost of lawsuits for small businesses. These numbers are a
clear indication of how important E&O is for a business to operate.
Before getting into pricing, perhaps we should take a look at the overall market around the E&O,
including how companies are hedging themselves against the possibility of a lawsuit.

Statute of Limitations Tolled on Subrogation Claim Until Underlying Actions Terminated
The California Court of Appeal for the fourth District recently held in Underwriters of Interest
Subscriving Policy Number A15274001 v. ProBuilders Specialty Insurance Company that the statute
of limitation on the insurer's equitable subrogation claim was tolled until the underlying action came
to final judgment. The case involved construction defect case against a construction company,
Pacific Trades. Appellant Underwriters undertook Pacific Trades' defense in the action under the
terms of its general liability insurance policy. Appellee ProBuilders, also an insurer of Pacific
Trades, denied defense on the basis that under the terms of its policy, it had no duty to defend when
another insurer provided defense. The underlying case was concluded when the parties reached a
settlement, in which ProBuilders agreed to pay $270,000 of $1 million. Following the conclusion of
the case, Underwriters sought equitable contribution from ProBuilders for defense costs, which was
denied. ProBuilders argued in its motion for summary judgment that it was excused from
contributing to defense costs on the basis that the action was time–barred by the statute of
limitations. Underwriters argued its action was timely because it was filed less than two years after it
made its final payment towards attorney fees. The trial court agreed with ProBuilders that the clause

Legal Duty Of The Store
Due to the store not being able to maintain the premises safe without proper use of safety
precautions to warn people. This would go under premises and operations coverage, where there is
liability due to conditions in or arising from the premises. If the store is not able to maintain safety
while it is operating then it is still liable for the injuries and can be sued by Raj. In order for an act to
be considered negligent it must have four elements to it. This includes: (1) legal duty of care – there
is a legal duty to protect others from harm if there is an absence of it, then there is a legal wrong. (2)
A failure to perform that duty by an act or a failure to act (3) claimant suffers damages to his or her
property and/or bodily injury or death. These can be for special damages (losses that can be
determined and documented) and general damages (for losses that cannot be determined and
documented e.g. pain) (4) proximate cause where relationships must exists where there is no broken
chain of events between negligent act and infliction of damages. In this case a reasonable person
would have warned others of there being a wet floor and in this case there was no sign. This is a
negligent act causing Raj to fall and injure them self as a result. Had the staff member put the sign

Trial Court Case Study
The trial court erred and abused its discretion in granting the State's motion to admit evidence of
prior uncharged incidents of domestic violence, because the evidence denied Mr. Davis of his rights
to due process of law as guaranteed by the Fifth and Fourteenth Amendments of the United States
Constitution, and Article I, Section 10 of the Missouri Constitution, in that the evidence was more
prejudicial than probative because it was too remote in time to be relevant to the charged crimes and

But such evidence is only relevant if its probative value outweighs its prejudicial effect. Id.
Generally, the "remoteness in time of the other bad acts is ordinarily a factor affecting the weight of
the evidence." State v. Shaw, 847 S.W.2d 768, 778 (Mo. Banc 1993). But when "remoteness is so
great that it erodes the probative value of the evidence, the prejudicial effect outweighs its probative
value and the evidence is not admissible." Id.
For example, in State v. Chiles, the State attempted to put on evidence of a prior crime that occurred
nearly seven years before the crime that the defendant was on trial for. 847 S.W.2d 807, 809 (Mo.
App. W.D. 1992). The Missouri Court of Appeals found that the past crime was too remote to be
relevant to the crime that the defendant was on trial for. Id. Similarly, in Lewis v. State, the Missouri
Court of Appeals found that a ten–year old crime was too remote to be relevant. 806 S.W.2d 89, 93
(Mo. App. W.D. 1991). And in State v. Culter, the Missouri Supreme Court found that a prior crime
that occurred seven to eight years prior to the offense charge was too remote to be relevant. 499
S.W.2d 387, 388 (Mo. Banc 1973).
Here, the trial court allowed multiple witnesses to testify to multiple incidents of past conduct that
were decades old. Amber Casada testified that Mr. Davis abused her mother was she was growing

business can cause to other people or their property. Let us say that somebody got injured or his

This is because the possibility of younger drivers having accidents is much greater than a more
experienced driver. Also the more power a car has is greater the chances of an accident so the cost of
the premium will be higher. The price of the premium also depends on the business sector that the
insurer is concentrated on as some firms specialize in particular sectors and can evaluate the risks
more accurately. This way they will give better offers, (usually a smaller premium), than to the more
mainstream insurers. If the business has small or medium risk involved, the insurers will usually
have the standard rate applied to determine the cost of the premium. The insurer will use this rate to
apply a factor that is determined by level of activity taking place in that business. This involves
looking at the turnover in public and product liability insurance or the company's employees liability

Increased Cost of Medical Care
In the United States malpractice suits have increased as well as payouts to those claimants who win
their malpractice suits. There were instances were claimants received awards for merely claiming
incidences of malpractice. It opened a flood gate of malpractice lawsuits, and a disproportional
increase in the awards given to the claimants. Doctors and other medical practitioners opted to take
professional liability insurance. The insurance does not cover the doctor directly; it covers the
institution against lawsuits. In most cases, the legal process is between the insurance company
lawyers and the claimant lawyer. The claimant and insurance lawyers estimate the payout the judge
will award a claimant (Studdert, 2006, p. 2030). The insurance lawyer tries to pay the lower limit
while the claimant seeks to get the higher limit. In the event the opposing lawyers are unable to
reach a compromise, the judgment is left to the judge and jury.

Equality in the Media Sector
Gender – There cannot be any type of gender discrimination, of either sexes. everyone must be
given an equal opportunity, this also goes towards race and religion. Sexual orientations may be
explored, as it has a place in the modern world and need to be represented, especially towards the
youth generation. As with race, any producers or designers should try and avoid stereotypical roles
that may offend some viewers, such as a stereotypical housewife– unless this is necessary for a
production, image within a website, ETC. Any legal restrictions that are not followed in the
workplace, such as inappropriateness between colleagues, should be dealt with firmly, to avoid
further complications such as resignations from a job or an important role. An example of this could
be a colleague who is unethically/illegally harassing another colleague, without their consent, and
this may make the other colleague feel uncomfortable. This may make the college feel that he/she
does not want to pursue the job any longer. This creates further complications, such as more time
spending looking for someone to replace that role. Religion – People have different beliefs and
views, so respecting them is very important. Most models/actors/accesses/designers will try to be
open minded whilst being interviewed for a role, but many religious restrictions may be
unavoidable, E.G. a Muslim actress may have very strong beliefs about revealing herself too much
in front of men. Producers should be as

I Am A Girl, The World Of Esthetics Intrigued Me
About Me
Every since I was a little girl, the world of esthetics intrigued me. I have always loved the way
people can manipulate their features and transform them, whether that is hair, skin, nails or
cosmetics. As I grew up to began to become more and more attracted to cosmetics. My passion for it
did not begin until high school, where I realized my full potential. Throughout my four years of high
school I was on the dance team, where our makeup had to look uniform. As a freshman, my 15–
year–old friends did not know a thing about makeup and I knew the basics. They would have me do
their makeup and would always tell me that I should be a makeup artist. As the years went by my

My makeup line will be sure not to anything harmful to a consumer's skin, which is why the proper
research is necessary.
Starting a Makeup Line
Research and Design
One of the most important steps in starting a makeup line is finding a research lab to work with,
which is where most of my time will be spent. (Marlena, 2012) In a research lab I will decide what
ingredients that I want in my line. It is very important to find a lab that is credible and trustworthy.
There are many expensive brands in the industry that are in the higher range of prices. I want my
line to be affordable therefore I need a affordable lab that will help me create quality products.
Another important step is finding a factory for packaging and filling. This is where I will be able to
decide how I want my line to look. "Smart packaging helps its targeted consumers feel an emotional
attachment to a brand." (Jarski,2014) choosing the smartest color scheme, shape, and design of my
product can determine how well my product can sell. About one–third of a consumer's decision to
purchase something is its display or packaging. Especially in the beauty market today, I have to
make sure my products appeal to consumers. Cosmetics is all about empowerment therefore I need a
product that is going to appeal to that side of a woman.
According to the graph, many women have an emotional attachment to makeup which makes them
feel in control (Gaillie, 2013) It is important for me to

Nearly every state requires a financial responsibility from drivers.
Liability insurance has two type of coverage:
Bodily injury coverage: This covers someone who has suffered during an auto accident.
Property damage coverage: This covers damages to another's person property during an auto
accident.

Auto Insurance Liability
If a person gets injured as a passenger in a vehicle, he or she
may be entitled to compensation for the damages received.
The ability to recover and the amount of the recovery is based
on many factors.
Liability
If the plaintiff sues the driver or seeks to recover under an
auto insurance claim, he or she must be able to show that the
driver is liable. One or both drivers can be liable for the accident.
If only one vehicle was involved in the accident, the claim will
be on the driver's insurance policy. This type of claim is
straightforward because the driver of the automobile has usually
done something incorrect or failed to do something that
resulted in the accident. In cases involving more than one
driver, the insurance ... Show more content on Helpwriting.net ...
Whether the passenger files a
claim or multiple claims will depend on the actual
circumstances. For example, if one of the drivers was
obviously not negligent based on the circumstances, such as
being in a legally parked vehicle or being rear ended, the
passenger may file a claim against the other driver.
The process of filing a claim may be different if the accident
occurred in a no fault state. These claims do not require on
the showing of negligence in order to provide for the medical
portion of the claim.
Settlement Issues
The next part of the process is to attempt to settle the claim. If
two vehicles were involved in the accident, neither party may
want to settle because each party claims the other was
negligent. Another issue could be be if more than one
passenger was in the vehicle and received damages or
injures. Most insurance policies have a maximum amount of
recoverable compensation for all injury claims. If multiple
passengers suffer serious injuries, each passenger may need
to file a seperate lawsuit against the driver at fault in order to
recover the full amount of their damages.
Comparative Fault
In some instances, insurance companies may try to

Insurance, Liability, And Liability Essay
Insurance and Liability As previously noted, we anticipate that the instances of car accidents will
decrease with the use of HAVs. Nonetheless, car accidents are always a possibility and car accidents
with HAVs pose the unique question, "Is the driver liable or is the manufacturer liable?" HAVs will
ultimately develop into more autonomously functioning vehicles, operating without much human
assistance. If such an autonomously functioning car were part of a car accident, the manufacturer 's
liability would certainly increase. However, the first commercially available HAVs will involve the
vehicle sharing the driving responsibility with the human driver. Establishing liability in this gray
area is a challenge that Maryland will take on. Also, car insurance premiums will likely increase for
the consumer, which is an important consideration because that translates to less disposable income
in the pocket of the driver. Technology One of the primary concerns is ensuring a two–tier system
guaranteeing that if one system fails (i.e. the car's autonomous system), there is a warning system to
inform the driver to take control of the vehicle. The safety of the driver has to remain the number
one concern. The intricate technology used on HAVs is what makes their smart driving capabilities
work safely. Frequent software updates will be necessary so that the HAV can acknowledge new
roads and infrastructure.(cite: Anderson) If the HAV owner waits several months after being notified

This is because the risk of a building contractor being responsible for someone being injured is
greater, and when this happens, damages are typically more. As an example, medical costs for an

Professional Liability Insurance In Nursing Essay
Professional Liability Insurance for Nurses
Many people do not ponder on the possibility of some form of malpractice or misdiagnosis
occurring during their time as patient. They put their trust solely in the healthcare provider. More
importantly nurses hardly ever consider being the one that causes harm or the one whom neglects a
patient, let alone misdiagnose a patient. When entering the nursing field one needs to look at all
options that will help protect them from sustaining any loss. Many nurses in today's time are
purchasing profession liability insurance or more commonly known as professional indemnity.
Professional indemnity helps pay for expenses that occur during malpractice, negligence, and
misdiagnosis lawsuits.
The Oxford Shorter English Dictionary defines indemnity as "security or protection against
contingent hurt, damage, or loss" (Cornock, 2011, p. 25). Professional indemnity is an agreement
between a healthcare provider and an indemnity provider that financial cost will be covered when a
malpractice, negligence, or misdiagnosis lawsuit is filed against the healthcare provider. Countless
nurses take for granted the benefits of having professional indemnity. Most nurses believe that he or
she will not need the protection of professional indemnity until it is too late (Cornock, 2011). In
2008 the average expense by accident year was approximately $45,000 for nurse practitioners
insured through CNA Healthpro. These expenses do not include fees for attorneys,

Assessment is a legal requirement for employers under the Management of Health and Safety at

(1)every employer shall make and give effect to such arrangements as are appropriate, having regard
to the nature of his activities and the size of his undertaking, for the effective planning, organisation,

(2)Where the employer employs five or more employees, he shall record the arrangements referred

and safety of persons not in his employment arising out of or in connection with the conduct by him
of his undertaking,
It is also a way of ensuring the safety of everyone involved with your event.

Liability Insurance Essay
One thing that liability insurance providers require is an extensive application that allows the
providers to acquire data in eight categories: general information (i.e. population of municipality
and areas of operations like university or amusement parks), policies and procedures, education and
training requirements and accreditation, 911 dispatching protocols, jail operations, personnel, prior
insurance information, and claims history. All of this information will affect the underwriting and
ratings process, which allows "insurers to evaluate a risk to decide what coverage, if any, to offer or
renew, and for what price" (Rappaport, p. 1587). The underwriting and ratings process create an
need for municipalities to act favorably because ... Show more content on Helpwriting.net ...
There is one final section in the article, and that section pertains to questions and implications idea
proposed at the beginning of the paper.
This section starts by asking whether or not police insurance reduces actual police misconduct.
Unfortunately, there seems to be a lot of speculation as to whether or not this is the case. Rappaport
(2017) goes back and forth in this subsection detailing how this could be possible and how it might
not be possible. For example, he mentions there is just cause for skepticism in that, "not all 'loss
prevention' to the insurance company results in loss prevention to society" (p. 1599). In other words,
just because something is seen as loss to insurance providers does not mean that municipalities will
view the same thing as a loss, and therefore, this thing would not give the insurers the power to
regulate the police. Skepticism does not fill the brim of this subsection, as there are ways in which
this notion could be affirmed, as well. Essentially, Rappaport (2017) quotes a scholar, Carol Heimer,
who proposes that municipalities might allocate the implementing or discovering of loss–prevention
strategies to outside entities to avoid neglecting them and that through this it can be seen that police
agencies would utilize these strategies to reduce covered harms. Overall, it could also

The Importance Of Auto Insurance Coverage
Here's what you need to know:
Auto insurance coverage is mandatory in most US states. As a single parent, getting auto insurance
coverage for you and your children can be expensive.
There are specific coverage options that are essential to a single mother, taking any combination of
these coverage options can provide sufficient protection.
Failure to add your 16–year–old or above teenager on your policy will result in the denial of a claim
should the child get into an accident while driving your car.
As a single mother, there are several ways to bring your auto insurance costs down, whether you
have a teenage driver added to the policy or not.
You significantly reduce your auto insurance rates by comparison shopping. Compare quotes from
multiple providers until you find an appropriate policy.

The level of required car insurance coverage varies across states. New Hampshire is the only US
state without any auto insurance requirements. If you have smaller kids, you need to get the right

Sometimes leaving them behind is not an option. Here are the most essential auto insurance
coverage types for a single mother:
Liability Coverage
In most states, auto insurance liability coverage is the mandated level of car insurance. You don't
want any trouble with the law. Therefore, make sure that you have purchased the right amount of
liability coverage. Auto insurance liability pays for the damages caused to the other party's vehicle
in the event of an at–fault accident. This policy will also cover any other type of damage to third
party property as well as the medical expenses for any bodily injuries resulting from the accident.

Professional Liability And Legal Liability Insurance

  • 1. Professional Liability And Legal Liability Insurance The profession that I have chosen to concentrate on is that of a personal trainer, specifically issues concerning liability insurance. Personal trainers provide direction and supervision to clients within the realm sports and exercise realm. The chosen place of employment is often work out facilities. It may also include working with clients at other locations, such as the client or trainer's homes. Personal trainers work both as employees and as independent contractors. I think that I would probably have an employer in the beginning, such as working for a work out club chain. After I acquired some experience and built up a clientele, I would probably consider working as an independent contractor. Either way there are risks that must be covered by insurance. Whether a client is injured due to negligence, or inherent risks (no fault), a trainer must protect themselves in case of a lawsuit. Additionally, frivolous lawsuits have become common place, and if an individual does not have insurance they could be left vulnerable. Both professional liability and general liability insurance are necessary to help to cover your costs in the event of an injury claim, whether you are truly responsible or not. This is an essential part of a comprehensive risk management strategy. Some of the specific duties a personal trainer is responsible for are: Overseeing exercise programs and weight training. Evidence can take several forms such as physical evidence, substantial evidence. Regardless of what type evidence is presented must be relevant to the case to be admissible. "Relevance refers to any material fact or evidence having a tendency to make the existence of a matter at issue more probable than it would be without said fact (probative value)"(Britz, 2008, p. 344). In this paper, an examination of the legal standard of relevance evidence will be discussed. Furthermore, the rules of inclusion and exclusion of evidence based on the wording of the rules will be scrutinized. In the final section, examples of ... Show more content on Helpwriting.net ... Pharmacists now experience more lawsuits than ever before due to healthcare facility errors that were looked over, giving a prescription to the wrong customer, writing the wrong directions on a prescription, putting the wrong drug in the correct bottle for a patient, etc. (Rx Recruiters, (N.D.). I have worked in a pharmacy over many years and have seen many mistakes happen with a good and bad ending. The two most common mistakes that are not the fault of the pharmacist are giving the wrong prescription to the wrong customer at check out and not following HIPPA standards. There are many cases where customers can have common names and are given the wrong prescription due to lack of verification. I have personally heard of a customer calling back because they realized they have the wrong medication. An instance of such could go in a very bad direction if a customer takes the medication and causes health problems or death, which would result in a malpractice lawsuit. Although it was not the pharmacist error because it was an employee working under the pharmacist, the pharmacist could lose their license and much money due to this mistake. As long as the pharmacist has professional liability insurance this mistake would be covered and licenses would not be threatened to be taken. Another main area for possible lawsuits would be disregarding or not following HIPPA regulations properly. In ... Get more on HelpWriting.net ...

  • 21. Insurance Liability And Liability Insurance There are many lines of different property and casualty insurances. Even though the general purpose and utilization of these insurances is the same across the nation, prices fluctuate from state to state. We will get into more detail in regards to Errors and Omission Insurance (E&O) in the State of California. Errors and Omission Insurance, also called Professional Liability Insurance or Malpractice Insurance, is used to cover legal expenses caused by potential errors and omissions during operations and stipulation of cases. When a company or firm is sued for making a mistake, performing services in a negligent way or misrepresenting or financially harming a client, the consequences can harm a company in an irreversible way. This is ... Show more content on Helpwriting.net ... Since E&O insurance is important to carry when running a business most professions have this type of insurance to cover a potential lawsuit that would otherwise cause them to file for bankruptcy. It may come as a surprise that some states do not require businesses to have E&O insurance, but a large portion of contracts with clients required insurance for the contract to be in effect. Having an E&O insurance policy may sometimes be a selling point for potential clients. When a client sees that a business has this type of insurance it gives them peace of mind knowing that if there happens to be any error or omission throughout the process they will be compensated. The same applies to the actual company. It makes it easier to accept new clients and cases knowing that in case of any alleged misunderstanding or disputes, the policy would bring in protection and coverage. According to techinsurance.com about 70% of businesses raise prices or cut hiring when sued and yet, $35 billion = annual out–of–pocket cost of lawsuits for small businesses. These numbers are a clear indication of how important E&O is for a business to operate. Before getting into pricing, perhaps we should take a look at the overall market around the E&O, including how companies are hedging themselves against the possibility of a lawsuit. • 23. The Case Of Construction Case Against A Construction... Statute of Limitations Tolled on Subrogation Claim Until Underlying Actions Terminated The California Court of Appeal for the fourth District recently held in Underwriters of Interest Subscriving Policy Number A15274001 v. ProBuilders Specialty Insurance Company that the statute of limitation on the insurer's equitable subrogation claim was tolled until the underlying action came to final judgment. The case involved construction defect case against a construction company, Pacific Trades. Appellant Underwriters undertook Pacific Trades' defense in the action under the terms of its general liability insurance policy. Appellee ProBuilders, also an insurer of Pacific Trades, denied defense on the basis that under the terms of its policy, it had no duty to defend when another insurer provided defense. The underlying case was concluded when the parties reached a settlement, in which ProBuilders agreed to pay $270,000 of $1 million. Following the conclusion of the case, Underwriters sought equitable contribution from ProBuilders for defense costs, which was denied. ProBuilders argued in its motion for summary judgment that it was excused from contributing to defense costs on the basis that the action was time–barred by the statute of limitations. Underwriters argued its action was timely because it was filed less than two years after it made its final payment towards attorney fees. The trial court agreed with ProBuilders that the clause in its policy relieving it of defense ... Get more on HelpWriting.net ...

  • 25. Legal Duty Of The Store Due to the store not being able to maintain the premises safe without proper use of safety precautions to warn people. This would go under premises and operations coverage, where there is liability due to conditions in or arising from the premises. If the store is not able to maintain safety while it is operating then it is still liable for the injuries and can be sued by Raj. In order for an act to be considered negligent it must have four elements to it. This includes: (1) legal duty of care – there is a legal duty to protect others from harm if there is an absence of it, then there is a legal wrong. (2) A failure to perform that duty by an act or a failure to act (3) claimant suffers damages to his or her property and/or bodily injury or death. These can be for special damages (losses that can be determined and documented) and general damages (for losses that cannot be determined and documented e.g. pain) (4) proximate cause where relationships must exists where there is no broken chain of events between negligent act and infliction of damages. In this case a reasonable person would have warned others of there being a wet floor and in this case there was no sign. This is a negligent act causing Raj to fall and injure them self as a result. • 27. Trial Court Case Study The trial court erred and abused its discretion in granting the State's motion to admit evidence of prior uncharged incidents of domestic violence, because the evidence denied Mr. Davis of his rights to due process of law as guaranteed by the Fifth and Fourteenth Amendments of the United States Constitution, and Article I, Section 10 of the Missouri Constitution, in that the evidence was more prejudicial than probative because it was too remote in time to be relevant to the charged crimes and had a prejudicial effect. A. Standard of Review A trial court has broad discretion over questions of relevancy and the admissibility of evidence. State v. Dunn, 817 S.W.2d 241, 245 (Mo. Banc. 1991). There were instances were claimants received awards for merely claiming incidences of malpractice. It opened a flood gate of malpractice lawsuits, and a disproportional increase in the awards given to the claimants. Doctors and other medical practitioners opted to take professional liability insurance. The insurance does not cover the doctor directly; it covers the institution against lawsuits. In most cases, the legal process is between the insurance company lawyers and the claimant lawyer. The claimant and insurance lawyers estimate the payout the judge will award a claimant (Studdert, 2006, p. 2030). The insurance lawyer tries to pay the lower limit while the claimant seeks to get the higher limit. In the event the opposing lawyers are unable to reach a compromise, the judgment is left to the judge and jury. Equality in the Media Sector Gender – There cannot be any type of gender discrimination, of either sexes. everyone must be given an equal opportunity, this also goes towards race and religion. Sexual orientations may be explored, as it has a place in the modern world and need to be represented, especially towards the youth generation. As with race, any producers or designers should try and avoid stereotypical roles that may offend some viewers, such as a stereotypical housewife– unless this is necessary for a production, image within a website, ETC. Any legal restrictions that are not followed in the workplace, such as inappropriateness between colleagues, should be dealt with firmly, to avoid further complications such as resignations from a job or an important role. An example of this could be a colleague who is unethically/illegally harassing another colleague, without their consent, and this may make the other colleague feel uncomfortable. This may make the college feel that he/she does not want to pursue the job any longer. This creates further complications, such as more time spending looking for someone to replace that role. • 58. Insurance, Liability, And Liability Essay Insurance and Liability As previously noted, we anticipate that the instances of car accidents will decrease with the use of HAVs. Nonetheless, car accidents are always a possibility and car accidents with HAVs pose the unique question, "Is the driver liable or is the manufacturer liable?" HAVs will ultimately develop into more autonomously functioning vehicles, operating without much human assistance. If such an autonomously functioning car were part of a car accident, the manufacturer 's liability would certainly increase. However, the first commercially available HAVs will involve the vehicle sharing the driving responsibility with the human driver. Establishing liability in this gray area is a challenge that Maryland will take on. Also, car insurance premiums will likely increase for the consumer, which is an important consideration because that translates to less disposable income in the pocket of the driver. Technology One of the primary concerns is ensuring a two–tier system guaranteeing that if one system fails (i.e. the car's autonomous system), there is a warning system to inform the driver to take control of the vehicle. The safety of the driver has to remain the number one concern. The intricate technology used on HAVs is what makes their smart driving capabilities work safely. Frequent software updates will be necessary so that the HAV can acknowledge new roads and infrastructure.(cite: Anderson) If the HAV owner waits several months after being notified of ... They put their trust solely in the healthcare provider. More importantly nurses hardly ever consider being the one that causes harm or the one whom neglects a patient, let alone misdiagnose a patient. When entering the nursing field one needs to look at all options that will help protect them from sustaining any loss. Many nurses in today's time are purchasing profession liability insurance or more commonly known as professional indemnity. Professional indemnity helps pay for expenses that occur during malpractice, negligence, and misdiagnosis lawsuits. The Oxford Shorter English Dictionary defines indemnity as "security or protection against contingent hurt, damage, or loss" (Cornock, 2011, p. 25). Professional indemnity is an agreement between a healthcare provider and an indemnity provider that financial cost will be covered when a malpractice, negligence, or misdiagnosis lawsuit is filed against the healthcare provider. Countless nurses take for granted the benefits of having professional indemnity. Most nurses believe that he or she will not need the protection of professional indemnity until it is too late (Cornock, 2011). • 74. Liability Insurance Essay One thing that liability insurance providers require is an extensive application that allows the providers to acquire data in eight categories: general information (i.e. population of municipality and areas of operations like university or amusement parks), policies and procedures, education and training requirements and accreditation, 911 dispatching protocols, jail operations, personnel, prior insurance information, and claims history. All of this information will affect the underwriting and ratings process, which allows "insurers to evaluate a risk to decide what coverage, if any, to offer or renew, and for what price" (Rappaport, p. 1587). The underwriting and ratings process create an need for municipalities to act favorably because ... Show more content on Helpwriting.net ... There is one final section in the article, and that section pertains to questions and implications idea proposed at the beginning of the paper. This section starts by asking whether or not police insurance reduces actual police misconduct. Unfortunately, there seems to be a lot of speculation as to whether or not this is the case. Rappaport (2017) goes back and forth in this subsection detailing how this could be possible and how it might not be possible. For example, he mentions there is just cause for skepticism in that, "not all 'loss prevention' to the insurance company results in loss prevention to society" (p. 1599). In other words, just because something is seen as loss to insurance providers does not mean that municipalities will view the same thing as a loss, and therefore, this thing would not give the insurers the power to regulate the police. Skepticism does not fill the brim of this subsection, as there are ways in which this notion could be affirmed, as well. Essentially, Rappaport (2017) quotes a scholar, Carol Heimer, who proposes that municipalities might allocate the implementing or discovering of loss–prevention strategies to outside entities to avoid neglecting them and that through this it can be seen that police agencies would utilize these strategies to reduce covered harms. Overall, it could also ... Get more on HelpWriting.net ...
