4. • Article 4.1 of the DIAC Rules: RFA
• Article 4.1.(a) of DIAC Rules: RFA hereby requests from the
Centre that the dispute be referred to arbitration under DIAC
Rules.
• Article 4.1.(c) of the DIAC Rules: Arbitration Agreement-
invoked by the Claimant, together with a copy of the
contractual documentation.
• Articles 4.3 and 4.4 of the DIAC Rules: Submit 5 copies and
a 5000 UAE security bond.
• Article 23 of the DIAC Rules: CLAIM: The full documents
supporting the Claimant’s claim shall be provided with the
Statement of Claim
• Article 23 of the DIAC Rules: Claim submitted in 30 days.

5. 1 Introduction
• 1. This Request for Arbitration is made
under Article 4.1 of the DIAC Rules by MR.
CLAIMANT SMITH , in connection with
disputes arising out of the Construction
Contract for Torero Power Plant dated 15
June 2018, signed between MR. CLAIMANT
SMITH and MR. DEFENDANT JONES, (the
“Contract”).
• 2. MR. CLAIMANT SMITH hereby requests
from the Centre that the dispute be referred
to arbitration under DIAC Rules according to
Article 4.1.(a) of DIAC Rules.

• 13. Sub-Clause xxxxx of the General Conditions of
the Contract (hereinafter the GCC), amended by the
Conditions of Particular Applications (CPA) refers to
Arbitration for the settlement of disputes:
• Sub-Clause xxxx Conditions of Particular Application
• Any dispute connected with the formation,
performance, interpretation, nullification,
termination or invalidation of this Contract or arising
there from or related thereto in any manner
whatsoever which:
• (a) the decision, if any, of the Employer
Representative has not become final and binding
pursuant to Sub Clause xxxx and
• (b) amicable settlement has not been reached
within the period stated in Sub Clause xxxxx

to Arbitrate
• shall be referred to arbitration in Dubai UAE, in accordance
with the provisions set forth in the rules of Arbitration of the
Dubai International Arbitration Centre (DIAC).
• Neither party shall be limited in the proceedings before the
arbitrator(s) to the evidence or arguments put before the
Employer Representative for the purpose of obtaining his said
decision pursuant to Sub-Clause xxxxx. No such decision shall
disqualify the Employer Representative from being called as
witness and giving evidence before the arbitrator(s) on any
matter whatsoever relevant to the dispute.
• Arbitration may be commenced prior to or after the
completion of the Works, provided that the obligations of the
Employer, the Employer Representative and the Contractor
shall not be altered by reason of the arbitration being
conducted during the progress of the Works.

• 18. Article 4.1.(c) of the DIAC Rules. copy of

Arbitration Agreement is contained or in

4.1.(c) of the

Description
of the
Dispute
• 19. The following is “a brief description of
the nature and circumstances of the dispute
giving rise to the claim” in accordance with
Article 4.1(d) of the DIAC Rules. The
Claimant reserves the right generally to
amend and/or supplement the facts, the
claims, and legal and contractual grounds.
The full documents supporting the
Claimant’s claim shall be provided with the
Statement of Claim under Article 23 of the
DIAC Rules and further submissions during
the arbitration proceedings.

13. 5 Relief
Sought
• 20. In consideration of all of the above, the Claimant
respectfully requests the Arbitral Tribunal to:
• 1. declare that the termination of the Contract Torero
CCPP, dated 15 June 2018 by the Claimant was valid and
justified;
• 2. declare that the Respondent's purported
termination of the Contract Torero Power Plant, dated 15
June 2018 was invalid, unjustified and or unlawful;
• 3. declare that the Claimant is entitled to an
Extension of Time for Completion to the Termination of
the Works being 26 September 2018;
• 4. order that the Respondent return the Performance
Security Bond to the Claimant within 10 days following
the receipt of the Award;

interest on all amounts it is ordered to pay pursuant
to these proceedings, from the date of the event
giving rise to the claim;
• 7. order that the Respondent pay the Claimant all
costs and expenses (including, but not limited to,
costs payable to DIAC, legal fees and expenses and
fees and expenses of experts, consultants and
others) incurred by the Claimant in connection with
the preparation for and conduct of this arbitration;

• 8. order that the Respondent pay the Claimant
post-award interest on all amounts it is ordered to
pay pursuant to these proceedings, from the date of
the Award until receipt of payment of such amount
by the Claimant;
• 9. order that the Respondent pay the Claimant
such other relief as the Arbitral Tribunal deems
appropriate under the circumstances;
• 11. For the purpose of computation of the
arbitration fees, and without prejudice to its rights
in law or equity, the Claimant estimates its total
claim to amount to AED XXXXXX and in a separate
Statement of Claim, will detail the heads of claim
outlined above and will denominate each in figures,
supported by evidence.

• 12. There is no determination on the
number of the arbitrators in the Arbitration
Agreements between the Parties.
• 13. Article 8.2 of DIAC Rules provides that:
• 8.2 Where the parties have not agreed on
the number of arbitrators, the Tribunal shall
consist of a sole arbitrator, except where the
Centre in its discretion determines that, in
view of all the circumstances of the dispute,
a Tribunal composed of three members is
appropriate.

1. In view of all the circumstances, the amount
and the complicated nature of the dispute
explained above, the Claimant requests
from the Centre that a tribunal of three
members is to be composed.

language of arbitration shall be English and

governing, the procedure and administration of

XXXX as the law of the United Arab Emirates and

• 20. The Contracts at Clause XXXX states that:
• The Contract shall be governed by and
construed according to the laws in force in the
U.A.E. and in Dubai.
• 21. Consequently, the law applicable to the
merits and the procedure of the arbitration shall
be the laws in force in UAE and in Dubai.

of Rights
• 22. The Claimant reserves its right generally
to amend and/or supplement this Request,
and among other issues, to request other
relief, including damages, as the Claimant
may consider necessary or appropriate to
enforce and/or defend its rights.
