(1) Anyone who, for the purpose of deception in legal transactions,
1. makes a fake technical recording or falsifies a technical recording
or,
2. uses a fake or falsified technical recording,
shall be punishable by imprisonment for up to five years or by a fine.

202c shall apply accordingly.

  1. This presentation focuses on a suspicious package allegedly originating from Amazon. My contact with the Amazon customer service to clarify my questions subsequently led to a suspicious phone call and suspicious email messages. In this context, I, as a legal layman, initially consider the sections 202a, 202b, 268, 269, 270 and 303a of the German Penal Code to be possibly relevant.
  2. On 10/15/2018, not on 10/16/2018, as indicated on the label - I will go into this in more detail later, a parcel was handed over to me by a non-uniformed delivery service - see photo on the left of the slide - in familiar Amazon packaging. I hadn't ordered anything myself, but it could be a gift. But the label doesn't look familiar to me at all, rather imaginatively self-made. There is also another label of the same size under the label: Amazon does not label twice. The customer's order is first identified by an anonymous bar code. This can be seen on top of the package. The ordered goods are placed in a basket and then packed. The anonymous bar code is placed on the package. The parcel then passes over a conveyor belt on which the parcel is weighed and affixed with the label containing the address information by a machine that evaluates the anonymous bar code. The method of delivery and the strange label made me suspicious, so that I have not opened the package so far and instead on 10/20/2018 contacted Amazon Support by telephone on 0800 36 38 46 9. Although at that time my request had nothing to do with my Amazon account, the employee asked me to read out the second factor, sent to me by SMS, of the two-factor authentication activated on my account . The first factor, the password, was not mentioned. I was told on the phone to email impressum@amazon.de for further information. I also received an email with this instruction and the email address impressum@amazon.de as addressee of my support request. In fact, I wrote a message to impressum@amazon.de, although this is obviously not a support email address. This resulted in an email conversation, which was conducted to my astonishment over different email addresses. The return path for the messages from Amazon was cs-reply+A3TX78179EV9MS@amazon.de cs-reply+A3APJ2V14YG00Q@amazon.de cs-reply+A1XANNWCVZGBYI@amazon.de cs-reply+A2UUREPW33K85X@amazon.de cs-reply+A1GYI559KTOB7O@amazon.de cs-reply+AZM0ANMAYE4IU@amazon.de cs-reply+A12YVNLZTQ6YBM@amazon.de However, my email client (Microsoft Outlook) always showed cs-reply@amazon.de. In the course of the email conversation about the above email addresses and a conversation via an instant messaging service offered by Amazon, Amazon finally decided, after initial information to the contrary, that the package was a gift shipment delivered from the Amazon logistics center in Poznan, Poland, via Amazon Logistics. In Baden-Württemberg, all Amazon Logistics deliveries go via a distribution center in Mannheim that went into operation in 2018. Rhein-Neckar Television has published a text contribution with video on 09/12/2018 about the new Amazon distribution center in Mannheim under the URL https://www.rnf.de/mediathek/video/amazon-stellt-neues-verteilzentrum-in-mannheim-friedrichsfeld-vor-2/ The picture in the middle of the slide is cut out of this video. You can see that the address area of this label looks different than on the package delivered to me on 10/15/2018: Apparently a uniform font size is used. On Youtube a contribution entitled "Amazon Logistics ist ein Hurensohnverein!!!" was published on 08/31/2018 under the URL https://www.youtube.com/watch?v=BQJIE-jaarE&t=3s The picture on the right of the slide is cut out of this contribution. Since the author wanted to hide his address, he tore off a part of the label. You don't see much, but you can assume that a larger area would have had to be torn off for a label like the one on the parcel delivered to me. Unfortunately, I don't know the format of the package tracking numbers used by Amazon Logistics - AH0200269333 on the package delivered to me. If this number were consecutive, there would be a contradiction between the parcel tracking number on the picture in the middle - AI0123726923 - and that of the parcel delivered to me: The picture in the middle was taken on 12.09.2018 at the latest. The delivery of my parcel took place on 10/15/2018. However the letter H comes before the letter I in the alphabet.
  3. On several occasions, I tried to send emails to the Amazon customer service using the form provided on the Amazon website. The screen recording on this slide shows that my messages are not displayed under "Sent Messages" in the Message Center, although sending the email messages is acknowledged with success notifications. This made me suspicious, so I repeated the process with Chrome DevTools enabled. At first, I thought that the messages were already discarded on the client side. Later I corrected this opinion: The messages are probably actually sent to the server. Does the server discard my messages?
  4. Because of my doubts about the package, I contacted a friend by phone who regularly offered me books from Amazon for my birthday on October 23rd. Since the call was not answered, I spoke my questions to the answering machine. A few days later I received the email message shown on this slide. It quotes an email which is supposed to come from Amazon. I point out a missing personal salutation in this quoted email, to which I will be returning later. The quoted email claims that Amazon Logistics sends a notification by email on the day of delivery and that you can even specify delivery preferences at 12 noon. This allegation is in no way consistent with the reports of angry Amazon customers in various Internet forums about experiences with Amazon Logistics, with tips on tracking packages with Amazon Logistics found on the Internet, and with the description of delivery by Amazon Logistics from Amazon itself, as the next slide shows. The package tracking links listed here also differ from the links found under "My Orders / Track Delivery" on the Amazon website. This observation will be commented on later in more detail on some slides.
  5. This slide shows on the left the description of the delivery by Amazon Logistics from Amazon itself: You receive a shipping confirmation and can register for further notifications by SMS. For package tracking, you go to "My Orders / Track Delivery" on the Amazon website. On the right you can see a note about package tracking with Amazon Logistics by the online computer magazine Chip Online. It corresponds to the description by Amazon itself: No further emails are mentioned between the shipping confirmation and the successful delivery.
  6. This slide shows another email I received supposedly from my friend. Amazon had already informed me by email that my parcel was a gift, but that they could not give me any information about the donor for data protection reasons. In the email quoted in this message, Amazon obviously has no privacy concerns about telling my friend that I haven't opened the package yet because I didn't know who sent it.
  7. This slide shows the package tracking via the URL from the emails allegedly received from Amazon Logistics on the day of delivery. Supposedly I can track a package I did not order: My friend's gift shipment to me. The parcel left the logistics center - as we know in Poznan, Poland - on Sunday, 10/14/2018. The delivery date on the label is 10/16/2018. However the package was already on 10/15/2018 at 04:27 o'clock in Mannheim and could be delivered to me at 14:53 o'clock. It may be possible that those responsible for delivery in the logistics center in Poznan, Poland, also work on Sundays. In any case, there is a Sunday driving ban in Germany and the Czech Republic from 00:00 to 22:00 (Germany) and 13:00 to 22:00 (Czech Republic) for vehicles over 7.5 tons gross vehicle weight. If the parcel has left the logistics center in Poznan, Poland, on a Sunday, in a vehicle over 7.5 tons gross vehicle weight and there is no special approval, arrival in Mannheim on Mondays at 04:27 is impossible. In addition to the code "POZ1" for the logistics center in Poznan, Poland, the label also mentions the code "MUC3" for an Amazon Fulfillment Center near Augsburg. Does this mean that the parcel passed through this fulfillment center near Augsburg? But then this should be reflected in the parcel tracking. The Amazon customer service is not able to tell me when, where, why and by whom the parcel was re-labeled in the short period of time available.
  8. I later ordered the books that were supposedly presented to me by my friend via Amazon from Amazon myself. On the left you can see the shipping confirmation dated 11/06/2018, 10:54 am. The delivery took place again via Amazon Logistics. On the right we see that I also received an email from shipment-tracking@amazon.de on the day of delivery. Since at this time my Amazon account was set to "English" as the language setting, I receive these emails in English. What is striking is that I am personally addressed with "Hi Andreas". Since in the German versions shown in this presentation of these allegedly automatically sent emails no personal salutation takes place, one should expect "Hello", as in the dispatch confirmation.
  9. This slide compares the URL from the email from shipment-tracking@amazon.de shown on the last slide to the right with the URL under "My Orders / Track Delivery" on the Amazon website. In the URL https://www.amazon.de/gp/css/shiptrack/view.html?ie=UTF8&orderID=303-9188299-7338769&orderingShipmentId=10355014165302&packageId=1&ref_=302_E_DDE the parameters for the script which strangely has the file extension ".html" like an HTML page are specified after the question mark. If you call the script without parameters, you get the misleading error message shown on the slide. Obviously, the script does not check its parameters. You might think that Amazon can afford better programmers. The URL you are redirected to and the URL under "My orders / Track delivery" both start with https://www.amazon.de/progress-tracker/package/ and differ only in the parameters. Therefore the same format is expected for the parameters. But the parameter "shipmentId" of the URL to which you are forwarded consists only of numbers, while this parameter in the URL under "My orders / Track delivery" is made up only of letters.
  10. This slide shows a screen recording. On the left we see an email message, which I sent on Friday, 11/09/2018, at 01:59 o'clock to various email addresses of the police in Karlsruhe, the state of Baden-Württemberg and federal authorities. On the right you can see the Chrome Browser. During the recording the window of a virtual machine running Firefox under Ubuntu Linux is also shown. The various links listed in the email message are opened in the Chrome browser under Windows and in the Firefox browser under Ubuntu Linux. I would also like to point out that I am not logged into my Amazon account in the Firefox browser under Ubuntu Linux. The original link comes from the forwarding of a link I received in an email supposedly from my friend on Thursday, November 8, 2018, at 6:26 pm. My friend informs me in this email that he has received another delivery from Amazon via Amazon Logistics and that he has again received an email notification on the day of delivery: So this would be quite normal. The screen recording shows that via this link I can follow a shipment I have nothing to do with: I have not ordered the shipment and I am not the addressee of the shipment. In addition, this link is subsequently modified by me. This makes it clear that certain parameters of the link have no meaning at all, because the results are always the same.
  11. On the left we see a photo of the package that was sent to me when I ordered the books that my friend supposedly presented to me via Amazon. On the right we see the parcel tracking. This package was labelled only once. The delivery took place on 11/07/2018, as indicated on the label. Different font sizes are used in the address area, as on the package delivered to me on 10/15/2018 and shown on slide 2. The label again mentions the codes "POZ1" for the Amazon Logistics Center in Poznan, Poland, and "MUC3" for the Amazon Fulfillment Center near Augsburg, Germany. I don't know what the code "CYCLE_1" means. Since the package passed through the distribution center in Mannheim, you should expect a code in the form "MA.WXYZ". On the last slide the dispatch confirmation with date of 11/06/2018, 10:54 o'clock, was shown. In the package tracking we see that the package arrived on 11/07/2018 at 04:57 o'clock in Mannheim. The parcel was therefore about 18 hours on its way to Mannheim - without Sunday driving ban.
  12. On the left we see the parcel tracking shown on the last slide on 11/07/2018 at 16:57. On the right we see the repetition of this package tracking on 12/07/2018 at 18:18. Why have text messages, times and parcel stations changed in the meantime? I would also like to point out that for all package tracking operations, also shown on the following slides, which were carried out on 12/07/2018, the text "Amazon Logistics" in the title line has changed to the text "Amazon".
  13. This slide compares the parcel tracking in German language, retrieved on 12/07/2018 at 18:19 o'clock, with that in English language, retrieved on 12/07/2018 at 18:18 o'clock. These are literal translations.
  14. The picture on the left of the slide shows the tracking carried out on 11/08/2018 at 23:08 hours of the parcel with the books allegedly presented to me by a friend. On the right you can see the tracking of the package on 12/07/2018 at 18:19 o'clock for my order of the books allegedly presented to me. I would also like to point out that on 12/07/2018 I can no longer carry out the parcel tracking shown on the left. Why do the messages for leaving the logistics center differ if both deliveries are made from the same logistics center (Poznan, Poland) via Amazon Logistics?
  15. On 11/06/2018 I wrote an email to the editors of Chip Online referring to the article shown on slide 5 by Sven Schulz, which was published on 10/05/2018 at the URL https://praxistipps.chip.de/amazon-logistics-tracking-des-pakets_94392 In this email, I asked for an opinion on the email notifications allegedly sent on the day of delivery in case of dispatch by Amazon Logistics, which are not mentioned in this article. I haven't received an answer yet. Assuming that my Facebook contact and schoolmate T. was still CEO at Chip, I contacted him the same day with a text message via Messenger asking if he knew the author of the article. We also had a conversation via Messenger on 11/06/2018. I told him about my doubts about the authenticity of the emails not mentioned in the article.
  16. The next day I received the two emails shown above from him. I asked him to forward older emails from shipment-tracking@amazon.de to me as well. However, this was impossible to him, because he had always deleted these emails. T. thus also claims that emails from shipment-tracking@amazon.de are common for delivery by Amazon Logistics - contrary to all relevant information on the Internet and from Amazon itself.
  17. The picture on the left of the slide shows again the tracking of the package with the books allegedly presented to me by a friend on 11/08/2018 at 23:08 o'clock. On the right you can see the tracking of the parcel on 11/09/2018 at 04:32 for the order of T. Why do the messages for the arrival at the distribution center differ if both deliveries are made via Amazon Logistics? Why is the English name of Munich, "Munich", used three times instead of the German name, “München”, which is used only once, when the whole text is in German?
  18. As a long-time Amazon Prime and Amazon Music Unlimited subscriber, I have a business relationship, and therefore legal relations, with Amazon.
  19. In this presentation, I have raised well-founded doubts about the labelling and the authenticity of the label.
  20. In particular, I doubt the authenticity of the email notifications from shipment-tracking@amazon.de that you allegedly receive on the day of delivery by Amazon Logistics.
  21. The screen recording on slide 3 shows that the email messages that I reportedly successfully sent using the contact form on the Amazon website are not displayed in the Message Center under "Sent Messages". These email messages are therefore likely to be discarded, deleted, or suppressed.
  22. My questions, which I formulated on 10/20/2018 in a telephone call with Amazon Support at 0800 36 38 46 9, had nothing to do with my Amazon account at that time. Nevertheless, I was asked to read out a second factor sent by SMS of the two-factor authentication enabled on my account, without being asked for the first factor, the password.
  23. The Amazon Support employee told me on the phone that I should send an email to impressum@amazon.de for further information. I also received an email with this instruction and the email address impressum@amazon.de as addressee of my support request. In fact, I wrote a message to impressum@amazon.de, although this is obviously not a support email address. The email conversation that followed was conducted using several strange email addresses. In this conversation Amazon provided some information about the package that was delivered to me on 10/15/2018: Misdirected or gift shipment. In the misdirected version I was asked to return the package.
  24. As explained in this presentation, 99% of an Amazon order is processed by an IT system. People do not play a decision-making role, but only carry out auxiliary activities guided by the IT system:   The EDP system receives the order, assigns it a unique code and decides which logistics centers will deliver the ordered goods.   Employees, in some cases also robots, in the selected logistics centers are informed by the IT system about the new order and the ordered goods, retrieve the ordered goods from shelves and place them in baskets which are identified by a machine-readable bar code containing the code issued by the IT system for the order.   The baskets, in which the ordered goods were placed, are brought together mechanically, controlled by the EDP system.   The contained goods are packed by employees and the package is provided with the bar code.   The order is always identified by this bar code: The employees do not know to whom the order goes.   The parcel is then placed on a conveyor belt, where it is weighed, and the address label is affixed to it by a machine connected to the EDP system using the bar code.   Machines controlled by the computer system transfer the parcel into a container, which is transported by an external logistics company or Amazon Logistics, in trucks - or even aircraft - to a distribution center near the customer.   From there, the parcels are delivered to the customer by delivery vans.   In this process, the EDP system generates technical records, data or a record of events, of the order and parcel status.   Among other things, it records when the order arrived, when the order left the logistics center and, in the case of delivery by Amazon Logistics, when and where the parcel passes through Amazon locations until it finally reaches the customer.   These records are partially visible in the parcel tracking and machine sent emails.   The records, labels and data generated by the EDP system are evidence-relevant data: they document the order, its processing and the route of the parcel to the customer in a legally binding manner.   The authenticity of this machine-generated evidence-relevant data depends on the proper, manipulation-free operation of the EDP system.   In manipulation-free operation   this EDP system does not label a package several times without this being recorded in some form that can be viewed and communicated by Amazon Customer Service, this EDP system does not create the label on the package delivered to me on 10/15/2018, this EDP system does not send any emails from shipment-tracking@amazon.de after confirmation of dispatch if delivery is made by Amazon Logistics, the EDP system lists the email messages sent by me via the contact form in the Message Center under "Sent Messages",   as I explained in this PowerPoint presentation.   Therefore, the EDP system was wrongly influenced and technical records and evidence data were falsified.   § 268 protects the security of the information acquisition by technical devices as well as the confidence in the origin of the recordings free from manipulations. § 269 protects in accordance with §§ 267 and 268 the security and reliability of the legal and evidence exchange concerning the handling of evidence relevant data. § 270 contains an equal treatment clause for the wrongful manipulation of data processing for all facts which presuppose the characteristic "for deception in legal transactions" (§ 152a ¶ 3, §§ 267, 268, 269, 271, 273, 281).   Without this protection, I can understandably have no confidence in the authenticity and integrity of the package delivered to me on 10/15/2018, allegedly from Amazon, because the Amazon customer service is not able to tell me when, where, why and by whom the package was re-labeled.
  25. On November 6, 2019 I had another conversation on Messenger with T. T: Hi Andi, now it hasn't left me alone. So: about the possible reasons for the different language we will talk on 16.11. until then, but a little empiricism: two deliveries from that year are knitted after the same pattern: Me: Thank you. Interesting. I look forward to our conversation. Have you noticed that the messages are different in your package tracking and mine: For you, it says "Lieferung hat das Versandzentrum verlassen und ist unterwegs." and "Paket ist in der letzten Lieferstation angekommen". For me, it says "Lieferung hat das Logistikzentrum verlassen und ist unterwegs." and "Sendung ist beim Verteilzentrum eingegangen." Please also note the different punctuation. You can also see this in other examples in my PowerPoint presentation. There I also show package tracking in English: There is consequently no punctuation in the messages. In the presented German examples it is inconsistently mixed. However, the last message you read is always "Zugestellt." instead of "Zugestellt" as in your case. In addition I point out that in the package tracking in the picture on the right a location information is given for the first time on the first message. In Graben there were always two shifts from 06:30 to 23:00. Therefore I wonder how the package could be processed in the middle of the night. Additionally, the use of the US American time format is striking in all German language package tracking shown in this presentation: For example, if you track a DHL package on the Amazon website, you will get time information in 24-hour notation.
